SAN FRANCISCO (AP) — A lawyer for the man who styled the hair of U.S. House Speaker Nancy Pelosi says he believes she was set up when she went to a San Francisco salon that wasn't permitted to have indoor services because of the coronavirus pandemic. Pelosi is facing backlash after Fox News Channel aired footage showing the speaker walking through the salon without a mask on. But a lawyer for the stylist says the owner gave permission for the appointment and made “vitriolic and incendiary comments" about Pelosi. Messages seeking comment from the owner weren't immediately returned. 595

SAN DIEGO (KGTV)-- The special needs teacher accused of having a sexual relationship with a student, pleaded not guilty to 20 felony counts. He also declared he would represent himself in the case. Against the advice of the judge, 49-year-old Juan Carlos Herrera told the courtroom, he will fight this alone. "I would like to represent myself," Herrera said. Relinquishing rights to counsel, the San Diego High school special needs teacher read the 20 felonies for the first time inside the defendant's box. Those charges include having sex, performing other sex acts, and physically and emotionally abusing one student between February 2018 and this March, when she was 15 and 16 years old."They occurred on an almost daily basis," Deputy District Attorney, Jessica Coto said. "They took place in hotels, in his car, and in his classroom." Coto said his ongoing manipulation extended to making threats."The defendant also routinely threatened the victim, that if she told anybody about what was happening, that she would cut off her arms and legs," Coto said. This all came to light on May 5, 2019, when police arrested Herrera at the US-Mexico border. Days prior, the girl's mother found inappropriate messages from Herrera on her daughter's phone.Because of the nature of the charges, and Herrera's second home in Mexico, the prosecution requested million bail. As his own attorney, Herrera fought back, saying he is a Navy veteran with a 25-year clean record with the district."It's not conceivable for someone with my earnings to make million, nor would I flee," Herrera pleaded. "I have been a person of honor and honesty since the beginning."The judge disagreed and kept the bail at million, handing Herrera his first loss, leaving him in utter disbelief. The judge also put a criminal protection order for the now-17-year-old victim. If convicted, Herrera could face a maximum of 16 years eight months in prison. But the prosecution mentioned, more time could be added if they find more evidence of sexual abuse. 2037

SAN DIEGO (KGTV)- Assembly Bill 5 (AB 5) may pose a new threat in plans for at-home learning this fall.AB 5 was created to help turn some gig workers, or freelancers turn into employees with benefits. The bill has been met with controversy as it has impacted thousands of freelance workers across California, and now it could change how tutors can be hired.“Many parents are scrambling right now to find out how do they help their children keep pace,” said Carl DeMaio, Chairman of Reform California.DeMaio held a press conference in Escondido with a group of parents, teachers, and education advocates by his side, calling for California Gov. Gavin Newsom to suspend AB 5.“This is absurd that the governor is allowing an environment where parents have to run the risk for violating AB 5, a state law, facing penalties and fines for doing so, just because they’re trying to help their children learn,” he said.DeMaio said parents who want a tutor for their child during this challenging time might be required to hire them as employees, not independent contractors. He has created an online petition and urges people to sign it before it’s sent to the governor.Assemblywoman Lorena Gonzalez authored AB 5 and sent the following statement to ABC 10News in response to DeMaio’s press conference. 1299

San Diego Unified School Board president and math teacher Kevin Beiser will introduce a resolution at Tuesday night's meeting demanding action from state and federal lawmakers pass stricter gun control laws."It's an opportunity for us parents students and teachers to speak in unison and call on our elected officials to do what we know is right and implement reasonable gun reform now, said Beiser ahead of the meeting. The board did something similar after the Sandy Hook school shooting back in 2012 but Beiser thinks it's worth stating again. And although it's not included in the resolution, Beiser expects the issue of arming teachers to come up at the meeting.Last week President Trump said he favored arming teachers to protect students. 763

SAN DIEGO, Calif. (KGTV) -- A group of University City residents is suing the city of San Diego over its plan to pump sewage under their neighborhood to be turned into tap water. The nonprofit University City Community Foundation filed the lawsuit after raising ,000 from residents to challenge the environmental impact report for the city's Pure Water pipeline. The suit doesn't challenge the city's goal of making heavily treated reclaimed water one-third of its supply by 2035. The city says that will protect against future shortages and price increases. The lawsuit, however, says the city did not explore alternatives and did not adequately notify the public of the project's pipeline. It will pump sewage from the Morena Area, through Clairemont and University City, to a treatment plant at UTC. "There's no 100 percent guarantee that there could not be a leak, there could not be some discharge," said U.C. resident Barry Bernstein, who supports the lawsuit. "There could be some discharge. There may be some problems with the purification system."Ruth DeSantis, who heads the foundation, said the city and foundation are now in settlement talks. A city spokesman declined to comment on the lawsuit, but said there are multiple protections in place - including a system designed to immediately cut off to avoid sewage geysers. He said the city still plans to break ground on the project by early next year.  1476
