JULIAN, Calif. (KGTV) - Has anyone seen Engine 57? That's the question the San Diego County Fire Department is asking after the official legal takeover of the formerly volunteer-run Julian-Cuyamaca Fire District. The county and the small town department are stuck in a legal battle since the volunteer department's dissolution in April 2019. Previously, members of LAFCO (Local Agency Formation Commission), a group that overseas special county districts, voted to dissolve the volunteer-run fire department. In March 2019, citizens voted the fire agency in charge should be San Diego County Fire Department. In April 2019, the official handover was supposed to happen. Not everybody agrees, as some residents said the change in hands was decided in a secret meeting -- an illegal move according to the Brown Act. "These are people they trust. People that are their neighbors, their friends," Julian resident Vicki Newman said. Newman said she has been an advocate for the small town department since volunteers saved her brother-in-law's life. She said she does not understand why both departments can't coexist."We need all the boots on the ground. We don't need just Cal Fire. It's not just J.C or Julian against Cal Fire," Newman said. In April, a judge allowed county crews to begin daily equipment inspections. But for the last two months, they say the department's 0,000 Engine 57 has been missing. "Ultimately, about a week ago, we reached the decision that they were probably not going to return the engine, and we filed a missing vehicle report with the sheriff's Ddepartment," Mecham said. Jurors have found Border Patrol Agent Lonnie Swartz not guilty on the Second Degree Murder charge of shooting through the border fence and killing 16-year-old Jose Antonio Elena Rodriguez.Jurors could not come to an agreement on a verdict on the two lesser charges, voluntary manslaughter and involuntary manslaughter.If they wish, prosecutors can retry Swartz on the lesser charges only.Friday jurors told Federal Judge Raner Collins they could not agree on a verdict.  The judge told them to continue deliberating. They could choose to convict Swartz on lesser charges of Voluntary Manslaughter or Involuntary Manslaughter.Swartz testified he was protecting himself and other officers from rocks thrown over the border fence by people on the Mexican side trying to interfere with efforts to arrests smugglers who were trying to climb over the fence and into Mexico.In closing statements to the jury, prosecutors said in his two years as a Border Patrol Agent, Swartz had rocks thrown at him six or seven times, and each time had responded by using less lethal weapons. Border Patrol may use items like guns that shoot an irritating pepper.But the night of October 10, 2012, Swartz had been on duty at the DeConcini Port of Entry.  He had only his gun and used it to fire 16 rounds through the fence. Ten shots hit the 16-year-old Mexican teen.Prosecutors say the threat against Swartz and other officers was not severe enough to justify deadly force and that they could have easily removed any threat by taking cover.They say other agents took cover but Swartz was fed up with rockings, wanted to send a message, and did it by calmly walking to the border fence, taking careful aim, and firing 16 shots into Mexico.Defense attorney Sean Chapman told the jury rocks are enough of a danger to justify deadly force and that there is no evidence to conclude Swartz fired out of anger over rock attacks. KANSAS CITY, Mo. — The Kansas City, Missouri Health Department is speaking out after it poured bleach on food intended to be given to homeless people.Nellie McCool, who helps run Free Hot Soup Kansas City, has been helping the homeless for years until Sunday."Officers and health inspectors demanded we destroy our food and we were violating health code violations by sharing meals with our friends," said McCool.The department said the group wasn't following the law about serving the homeless."They were notified back in a meeting in September that they needed to get a permit and they just outright said they refused to do that," said Dr. Rex Archer, director of health for KCMO.But McCool said she never heard from the department."That is incorrect," McCool said. "We never had any kind of government official ever come and speak with anybody at any of the public parks."According to the health department, the permit is free and all organizations that want to serve food to homeless people (or anyone) needs this permit. Archer said the food was also not being handled correctly and could put others at risk."Preparing food in all these individuals homes when people haven't been trained, prepare food safely. Then, they are taking it and transporting it in trunks of cars when its cool. It's supposed to be warm food but they have no insulation or a way to keep the food warm," Archer said. 1424

KAKE, Alaska. – A rare white killer whale was recently spotted off the southeast coast of Alaska.The University of Alaska Fairbanks (UAF) says people on an 80-foot charter boat witnessed the “less-than-once-in-a-lifetime” event on Aug. 7, just offshore of the village of Kake.UAF graduate student Stephanie Hayes was working as first mate of the boat and was among the lucky few who spotted “glowing” orca in a pod of killer whales.The rest of the whales in the pod, about three or four others, were the typical dairy-cow black-and-white colors, according to UAF.Hayes recognized how rare the sighting was, because she had studied killer whales during her undergraduate work in British Columbia.“There have only been about eight white killer whales ever recorded in the world,” Hayes told UAF. “To have one in Southeast was an incredible phenomenon.”Hayes told UAF that the white killer whale has a condition called leucism, which she defined as a “lack of vibrancy” in its pigmentation.“Caused by a mutation in the whale’s DNA, leucism is different from albinism, in which a creature is all white, with pink eyes,” wrote UAF in a press release.Turns out, the whale had been spotted before by researchers and named Tl’uk, a word for moon in the language of the Salish peoples of the Pacific Northwest.When Tl’uk leaves its pod, Hayes says its glow might be a disadvantage, perhaps alerting its prey of its approach. And, a new pod might not accept it after it reaches sexual maturity. 1492
