SAN DIEGO (CNS) - Two San Diego-area pet stores were cited over the weekend for selling puppies in defiance of a prior cease-and-desist order, an animal welfare agency announced Monday.Broadway Puppies in Escondido and Pups & Pets in Santee received citations from the San Diego Humane Society's Humane Law Enforcement department on Saturday, three days after being ordered to suspend all sales of pets until they could prove the animals were obtained from a legitimate source, SDHS officials reported.Approved suppliers include a public animal control agency or shelter, a facility run by a society for the prevention of cruelty to animals, a humane society shelter, or a rescue group that is in a cooperative agreement with at least one private or public shelter.Broadway Puppies was cited on four counts of allegedly violating California's ban on retail sales of dogs, cats and rabbits, and Pups & Pets got citations for two instances of the same offense, according to the Humane Society. 1007

SAN DIEGO (KGTV) – A catholic priest overseeing a mission in San Diego has been granted temporary relief from the state's COVID-19 restrictions on in-person worship.On Friday, ABC 10News spoke to the attorney representing Father Trevor Burfitt in his legal fight to reopen his Southern California parishes, including St. John Bosco Mission inside the Four Points Sheraton hotel off the 163 and Aero Drive.On Thursday, a Kern County judge issued a preliminary injunction protecting Father Burfitt's churches from COVID-19 restrictions but the ruling does not apply to all churches in the state.“Under the existing blueprint for a safer economy, all of [his] churches are subject or were subject to a total worship ban until the court's ruling yesterday,” said attorney Christopher Ferrara. He added, “That ruling has overturned those restrictions and the churches are now free to operate.”On Friday, San Diego County Supervisor Jim Desmond said that he supported the ruling and added in part, “I think and I always have thought that churches are essential, particularly in these times of high anxiety with having to deal with COVID.”The new ruling stems from a recent lawsuit that Father Burfitt filed against Governor Gavin Newsom and other state and local officials over lockdown measures.The judge ruled in part, "The restrictions at issue here, by effectively barring many from attending religious services, strike at the very heart of the first amendment's guarantee of religious liberty. Before allowing this to occur, we have a duty to conduct a serious examination of the need for such a drastic measure." The ruling goes on to read in part, "The free exercise of religion clause in the California constitution prohibits defendants from treating religious activities worse than comparable secular activities. California's current COVID-related restrictions do exactly that."“Right now, I would say that this decision provides guidance to the public authorities throughout the state and they should follow it,” added Ferrara.Father Burfitt is seeking a permanent injunction. SAN DIEGO (KGTV) - 10News sat down exclusively with Father Joe Carroll to talk about his legacy and fight against homelessness.He got involved with the homeless in San Diego in 1982. "The bishop called me in his office told me, the next day he's going to appoint me head of St. Vincent de Paul and my job was to build a shelter."Immediately assigned as the guy to find a solution to the problem, "When I first started, I'd be writing letters, 'please help me, please help me' and I'd get stacks back, 'no, no, no'."Despite dealing with rejection and other challenges early on, Father Joe has remained committed to fighting homelessness for decades. As Father Joe says, "the rest is history."He remembers ten years ago when he first recognized the problem of homelessness was growing. "We ignored it and we ignored it and had all these crazy ideas which I still think they have, so, I still think it's not reachable for a few more decades."Father Joe may be retired but he's still involved weekly in the fight against homelessness.As he watches the City of San Diego continue to try and solve the problems, he tells 10News, "housing is not the answer to homelessness."He says, instead, the answer is rehabilitation.After decades of fighting homelessness, Father Joe says the answers come from the individuals themselves, "slowly but surely I learned you had to talk to the homeless first to know what you're doing."While he's more removed from Father Joe's Villages since retirement, he still talks with the homeless community daily."Everyday I get out of here, I shake hands with people who are success stories, and that's what makes me want to do more." 1663

SAN DIEGO (KGTV) -- A frustrating mystery is plaguing commuters in Carmel Valley.A seemingly perfectly good brand new lane meant to ease traffic to the 56 has been coned off for months. The project adds a third lane on southbound Camino del Sur from around Highland Village place to Highway 56. Greg Agius, who commutes that way, says it's been coned off for months. A city staffer told him it would be complete by the end of August, but on Monday it was still inaccessible to drivers. RELATED: San Diego road repairs are ahead of scheduleAgius, who also bikes in the area, said it is making for a tight merge that has led to near fender benders. "It's backing up my commute," he said. "I've actually over the last three to four months had maybe half a dozen close calls."The lane is meant to lighten the congestion in Carmel Valley, which is getting increasingly congested as more housing is built. Developer Lennar hired contractor MGI to add the lane as part of its approval for area housing projects. RELATED: San Diego projects receive funding due to controversial gas tax"This is the one that baffles me the most because it's more dangerous what they've done with the cones than if the cones weren't here," Agius said. The problem rests with the traffic light at the intersection. It doesn't stretch far enough over to be visible to all cars in the new lane. Caltrans Spokesman Ed Cartagena gave an example of cars next to a semi-truck.They wouldn't be able to see the traffic light if not in front of them. Cartagena said it needs to be extended before anyone can benefit from the new asphalt. He also noted recent other work on the lane, above and below ground, including removal of an electric box ten inches above ground.  Either way, Cartagena said the new light should be installed by the end of the week, clearing the way for the lane to open. A city spokesman said the contractor had delays in obtaining the signal pole and mast-arm for the traffic light. SAN DIEGO (KGTV) - A family wants the Governor of California to keep the man who murdered three San Diego State professors behind bars. Frederick Davidson was sent to prison in 1997 for three consecutive life sentences without parole after he gunned down his three engineering professors Chen Liang, Preston Lowry, and Constantinos Lyrintzis.The San Diego County District Attorney’s Office recently notified the victims’ families that Davidson applied for executive clemency.“Just asking for clemency?  Out of what?  On what grounds?” asked a distraught Esther Alonso, Lyrintzis’ sister-in-law.  Lyrintzis was married to her sister, Deana Alonso, and the couple had a young daughter.A District Attorney’s Office spokesman said the DA’s office already filed a letter opposing Davidson’s request.Alonso told 10News she could not believe Davidson would request clemency.  Alonso said the family agreed to not seek the death penalty in 1997 if Davidson agreed to plead guilty and go to prison for life without parole.“How can they tell them 20 years later that the deaths of their husbands and their fathers…that this guy has more rights than they do?” asked Alonso, a professor at Southwestern College. “I don’t understand a system where that is even possible.”Alonso created a Change.org petition directed at Governor Jerry Brown asking him to deny Davidson’s request.The DA’s spokesman said their office opposed more than 50 clemency requests last year and none of those requests were granted.  The spokesman added there is no deadline for Governor Brown to respond or send it to a hearing. 1627
