The part was installed that same day. After the part was installed she reached out to North Wind stating that she no longer agreed with the price of the replaced part. Ms. Agostino was offered a solution to the dispute. She agreed that the part would be returned to North Wind. In turn Ms. Agostino would not be charged. This is what occurred. Ms. Agostino has not been charged for the service call or the replacement part.Days later Ms. Agostino posted false statements about North Wind on-line. She represents that she paid for the service call and replacement part, which she did not. These statements significantly effected North Wind's business. North Wind is a small local business. Ms. Agostino's false and defamatory statements have not only effected the North Wind's business, but has had a direct negative effect on its ability to offer full time hours to its employees.Prior to filing the lawsuit North Wind reached out to Ms. Agostino requesting the removal of the false statements. NEW YORK, N.Y. – Legendary television host Regis Philbin has died at the age of 88, People Magazine and ABC News report.According to a family statement obtained by People and ABC, Philbin passed away from natural causes Friday night, one month shy of his 89th birthday.The statement goes on to say that Philbin’s loved ones are forever grateful for the time they got to spend with him, his warmth, his sense of humor and his ability to make every day into something worth talking about.“We thank his fans and admirers for their incredible support over his 60-year career and ask for privacy as we mourn his loss," the statement ends.For years, Philbin hosted “Live! With Regis and Kathie Lee” before Kathie Lee Gifford left and Kelly Ripa took her place on the nationally-syndicated morning talk show. NEW YORK (AP) — A scientist who collected DNA from Scotland's Loch Ness suggests the lake's fabled monster might be a giant eel.Neil Gemmell from the University of Otago in New Zealand says the project found a surprisingly high amount of eel DNA in the water. He cautioned that it's not clear whether that indicates a gigantic eel or just a lot of little ones.But he said at a news conference in Scotland on Thursday that the idea of a giant eel is at least plausible.The DNA project found no evidence to support the notion that the monster is a long-necked ancient reptile called a plesiosaur (PLEE'-see-uh-sawr).Loch Ness is the largest and second deepest body of fresh water in the British Isles. 707

NEW YORK CITY — The co-owner of a Staten Island bar that continues to flout local coronavirus restrictions was arrested again early Sunday morning after allegedly hitting a sheriff's deputy with his vehicle, officials said.After a night of surveillance at Mac's Public House, two uniformed deputy sheriffs approached Daniel Presti, 34, just after midnight to place him under arrest, but he ran from the officers, got into his vehicle and began to drive away, according to the sheriff's office.Presti allegedly drove into one of the uniformed deputies, officials said. The deputy was thrown onto the hood of the vehicle and Presti reportedly continued to drive down South Railroad Avenue with the injured deputy still clinging to the hood of the car.,Presti drove about 100 yards before stopping his vehicle, officials said. He was arrested and taken to a police precinct, where he is expected to be charged.The deputy sheriff who was struck by the vehicle was taken to Staten Island University Hospital for treatment, officials said.The car crash was the latest incident surrounding the controversial Staten Island bar — which has garnered national attention and was even spoofed on Saturday Night Live over the weekend.Presti was also taken into custody by deputy sheriffs on Tuesday after an investigation revealed the bar was offering indoor dining and defying several other coronavirus restrictions despite rising infection rates in the area. Staten Island has the highest COVID-19 positivity rate in New York.Bars and restaurants in state-designated "orange" microcluster zones are only allowed to offer takeout and outdoor dining, with a four-person maximum per table.Despite Presti's initial arrest and the loss of the the bar's liquor license, Mac's Public House opened its doors to indoor diners again this weekend, according to the sheriff's office.On Saturday night, deputy sheriffs reported witnessing dozens of people entering and exiting a neighboring commercial space to access the back door of the bar.According to the sheriff's office, food and alcohol were being served to unmasked and standing patrons in exchange for "monetary donations."Following Presti's arrest Saturday night, Mac's Public House said on Facebook that the restaurant would remain open."We will not back down! You have not scared us!! Nichole Jolly just confirmed what she feared: her childhood home, where three generations made memories, was now reduced to rubble.“This is where I came back when I was born,” she said through tears. “This is where my babies came back when they were born.”Jolly and her husband, Nick, had come to terms thinking the cat that lived with her mom probably didn’t make it. Jolly said her mom was given such little notice to evacuate, so she left with only the clothes on her back.But as if on cue, a head popped up from the rubble.“Oh my god, Nick!” Jolly cried out.  “That’s our cat! Oh my god.”After a few minutes, they coaxed her out of the rubble. Jolly whispered an apology to little Kit Kat, nestled in her arms. The cat was now much thinner than the last time they saw her and her paws were singed.“I can’t believe she made this! She is a strong kitty. We have a strong family,” Jolly said.“I had to walk through fire too,” she said in Kit Kat’s ear.Jolly did, in fact, walk through fire. In fact, she barely escaped.It was last Thursday when the rapidly-moving fire was spreading through the town of Paradise—now 90 percent destroyed--where Jolly works as a nurse. She helped evacuate the surgical unit patients, putting them in any cars they could find, as gently as possible.And for that, she’s been dubbed a hero. However, Jolly thinks that saving her own life soon after was the real miracle.Jolly was in her car trying to escape, when the inferno suddenly surrounded her and many others on the same road.“I don’t even know where I am, it’s on fire,” Jolly said in a video she took from her car. “And we’re stuck in the middle of it. These trees could come down at any moment.”Cars were lined up and going nowhere.“I thought I was gonna be able to get out this way, but I’m stuck here, too,” she can be heard saying through tears in that same video.“We were screaming and running into each other with our cars. They pushed me off the road.”On Tuesday evening, she returned to that very spot for the first time since she almost lost her life.“I was all by myself. I was totally alone, and I called Nick and I said, ‘Honey, there’s flames all around me, and I’m gonna die. There’s no way I can make it out of this.’”Her husband had even begun to think about how he would tell their children their mom wasn’t coming home.“She was hysterical,” her husband Nick said, recalling their phone call. “And I couldn’t do anything to help her.”He suggested she get out and run. So, she did. Her shoes began to melt, and her clothes caught fire.“And I just had my arms out and I’m running, and I touched a firetruck.”She got inside it, but traffic was still at a standstill. Even the firefighters thought their chances for survival were grim.“I was sitting in the fire truck right here and just thinking, ‘OK, this is going to be a really painful death.’”But a bulldozer suddenly appeared, pushing the melting vehicles off the road.They made it out. But she hasn’t stopped reliving it. “I’ll never forget my screaming in the car, when the fire was just coming up on the side of it, and I was yelling for my husband ‘Oh my God, oh my God.’ I’ll never forget that. That’s what I wake up to every night.”But she takes comfort in knowing they, unlike some, still have each other.And they have Kit Kat. Tuesday evening, they brought her to her mom while she was at work to surprise her.“We found your freaking cat, mom,” Nichole shouted.Stunned, her mother could hardly find words.“Oh my god, you guys.
