SAN MARCOS, Calif. (KGTV) - A local portable toilet rental company is charged with tampering with equipment on its trucks to skirt emissions regulations. Employees also allegedly faked some of the smog test results.Team 10 Investigative Reporter Jennifer Kastner went to San Marcos’ Diamond Environmental Services on Friday afternoon, but was asked to leave. 10News was looking for answers to the alarming accusations that the company and some of its employees were committing crimes against the environment. Part of a video on the company’s website states, “Diamond's dedication to doing the right thing goes above and beyond.” Yet prosecutors say Diamond was preparing false smog test results to get passing results. Additionally, executives were allegedly tampering with emission control devices on its diesel truck fleet, re-programming the emission monitoring devices to avoid extra costs that come with burning off dirty, soot-filled diesel filters. Ed Rodriguez is the owner of Auto Park Smog in Escondido. He says, “If you’ve ever seen a vehicle going down the road, like a truck, and it has black smoke coming out of it, that’s all soot and that's not good.” Rodriguez says he's worked on Diamond's smaller trucks but not the ones that are part of this new six count federal indictment. The U.S. Attorney’s Office claims that Diamond took the devices out of trucks and shipped them out of California to be re-programmed. Owner and manager Arie Eric De Jong III, manager Warren Van Dam and technician Jorge Leyva Rodriguez are facing time behind bars and thousands of dollars in fines.The company declined an interview during our visit to the headquarters on Friday afternoon. 1692

SAN YSIDRO (CNS) - A speeding Orange County driver attempting the enter the country was killed after his car struck a man and woman and crashed into a metal barrier at the San Ysidro Port of Entry today.The crash occurred about 2:14 p.m. in a lane that was closed to traffic, according to California Highway Patrol Officer Salvador Castro.A gray Hyundai sedan driven by a 27-year-old man from Santa Ana was attempting to cross into the United States, Castro said. The Hyundai was traveling at a high rate of speed when it struck a metal swing arm barricade.It is unknown if alcohol or drugs were factors in the collision. The driver's name was not released.Tijuana police said the driver's vehicle struck a 70-year-old man and a 49-year-old wheelchair-bound woman on the Mexican side of the border. Witnesses said they were vendors.Mexican Red Cross ambulances took the injured pair to a hospital for treatment of moderate injuries, according to the Tijuana Fire Department. 982

But researchers say there are many unknowns about how the pandemic is affecting people without a place to sleep. San Francisco has reported more than 200 infections of homeless people, and New York City has tallied more than 1,400. San Diego’s convention center is housing homeless residents, where officials have administered more than 6,000 tests and uncovered just 18 positive for COVID-19. At the onset of the pandemic, cities thinned out shelters and moved homeless people into hotels because they often have chronic health issues. (KGTV) — Four Congressmen, including House Majority Leader Steny Hoyer, Scott Peters, Juan Vargas, and Mike Levin, participated in an all-access tour of the San Ysidro Land Port of Entry Friday afternoon. Upon finishing the tour, House Majority Leader Steny Hoyer of Maryland said sternly, “There is no crisis at the border. There is no justification for an emergency declaration at the border.” This was a direct contradiction to President Trump's reasoning to build a southern border wall. It has been almost one month since the Department of Homeland Security began implementing the new Migrant Protection Protocol (MPP). The policy forces migrants from Central and South America entering the United States without papers, or those claiming asylum, to in Mexico for the duration of their immigration proceedings. According to the Mexican Citizen Council for Public Safety and Criminal Justice, Tijuana has the fifth highest murder rate in the world. Because of that, Representative Juan Vargas (CA-51-D) strongly rejected MPP.“To be sent back to a place like Tijuana, where they don’t have family, friends, where they don’t have the social connections to be helped and to be safe, I don’t think we should be doing it. I think it is the wrong thing to do. I don’t think it’s our American values," said Vargas.Previous to the new MPP, migrants were released into the United States after their initial process, under the assumption they would return to US Immigration Court at a later time to receive their final status. But Homeland Security said that too many migrants would skip court, and disappear into the US as fugitives. This afternoon, Majority Leader Hoyer used the President’s coined slogan to refute the claim. “That’s fake news. 97% of people show up. That’s a better percentage than the people who show up who are on parole in the United States of America for crimes,” Representative Hoyer said. After touring the facility, the Democrats agreed, solving the immigration issue is not as simple as building a physical wall. Overcrowding the ports with seemingly endless asylum seekers is not the answer either. They were all impressed by the work being done at San Ysidro and hoped all other ports implement the high tech protocols conducted there.“This national emergency declaration serves no purpose other than a political one,” Representative Mike Levin (CA-49-D) said. “If we truly want to solve the problem to the extent to one exists, we need to invest in the technology of the future, just as we have done here at San Ysidro, at all 330 ports of entry.” 2601

(KGTV) -- Cell phone video reportedly taken Wednesday morning shows San Diego County Sheriff's deputies at a San Marcos home that's been at the center of an ongoing battle. When Team10 arrived, there was an eviction resolution notice taped to a window on the property. Neighbors tell us that they're thrilled the eviction process is finally underway. This is a story that Team10 has been following since May - when we spoke with a local hopeful home buyer, John Masnica. He says Julie Frisino and her family unlawfully moved into the house while Masnica was in the process of closing escrow on the bank-owned foreclosure. Wednesday, he told us, "She's just a deadbeat from a family of deadbeats that take advantage of the system." He went on to say, "I hope that now that they're out of this house that there aren't any other available houses for them to try to break into."Frisino took the situation to court, claiming she had rights to be there. This summer, a judge said the bank trustee, not Frisino, had rights to the home.Masnica and his wife are due with their fourth child.
