DENVER (AP) — A Colorado police officer will not face charges for fatally shooting a homeowner who had just killed an intruder inside his suburban Denver home, prosecutors said in a letter released Monday.Adams County District Attorney Dave Young described Richard "Gary" Black's death as a "harrowing tragedy" but said his role was to determine whether the Aurora Police officer who shot the 73-year-old Vietnam War veteran was justified in using deadly force.Based on witness interviews and more than 90 videos captured by officers' body cameras, Young said Officer Drew Limbaugh did not know who Black was and fired when the homeowner refused police commands to drop his handgun.Young said Limbaugh's belief was reasonable and prosecutors cannot prove that the officer was not justified in firing. He said there also is no evidence that Limbaugh was reckless or criminally negligent."Officer Limbaugh engaged in conduct that was consciously focused on minimizing the risk to public safety," Young wrote.At the time of the shooting, Young said police did not know that Black had woken after midnight to investigate banging sounds and soon heard his 11-year-old grandson screaming as an intruder attacked him inside the bathroom. Police also did not know that the intruder, later identified as Dajon Harper, was lying on the bathroom floor after being shot twice by Black, he said."The evaluation of Officer Limbaugh's reasonable belief must be based not upon what we now know, but the circumstances as he perceived them at the time: hearing gunshots and then seeing an armed man emerge from a back room who refused commands to drop the weapon," Young wrote.The witnesses and police officers interviewed by investigators paint a chaotic scene. Young said police arriving at the home in Aurora around 1:30 a.m. on July 30 had little information and no description of a suspect.Within seconds, he said police heard gunshots inside the house and saw Black come into the hallway holding a handgun in one hand and a flashlight in the other. Young said the body camera footage shows police repeatedly told Black to drop his weapon before he came toward officers, raising the flashlight, and Limbaugh fired three times.Police have said Black had hearing impairment due to his military service. Young wrote that Black may not have heard the commands or recognized the officers as police but said that does not change Limbaugh's "reasonable belief that Mr. Black presented a threat."Witnesses told police that Harper was at a party at a family member's home nearby and may have been using drugs. Early that morning, he ran away and apparently broke down the Black family's front door.Black's grandson told police he woke up after feeling a cold breeze. He described walking toward his father's bedroom but then seeing a stranger showering as he passed the open bathroom door.The boy said the man grabbed him, locked the bathroom door and was strangling him before his father and grandfather were able to get inside the room.Harper, who was 26, died after being shot twice in the chest by Black. DETROIT — Tyesha Dukes says her baby boy, Julies, was born in December 2017 but lost him hours later. She says she trusted Perry Funeral Home to bury her son, but never received a death certificate stating where he had been buried.Dukes says once news hit of 11 fetuses being found inside the ceiling of Cantrell Funeral Home, she got worried and called Perry Funeral Home. She placed the call Thursday, the day before the police raid occurred that turned up 63 infant remains and fetuses improperly stored inside the funeral home. “I had called just to see," Dukes said. "If it’s baby bodies at this funeral home, let me call and see if my baby, you know, (is) buried or not." She says that she was assured her baby was buried at Gethsemane Cemetery off of Gratiot in Detroit, but now she is not so sure. “This funeral home is under investigation." Dukes said. DETROIT — The Michigan Department of Health and Human Services is activating an emergency plan in response an outbreak of hepatitis A.The number of cases continues to rise in Michigan. The department is activating what is called the Community Health Emergency Coordination Center."To help coordinate Michigan’s response to the hepatitis A outbreak, we are opening the Community Health Emergency Coordination Center to assist the multiple local public health jurisdictions involved in the response and prevention of further cases," said MDHHS Director Nick Lyon.The emergency coordination center will provide support to health departments, hospitals, EMS and other health care providers.Health care providers are asked to encourage hepatitis A vaccination."We know that the hepatitis A vaccine is more than 90 percent effective in protecting someone who may be exposed to hepatitis A," said Dr. Eden Wells, Chief Medical Executive with the MDHHS. "Without a single source associated with these cases, the importance of vaccination and proper hygiene is vital to ensuring we stop the person-to-person spread of hepatitis A." There have been 457 confirmed cases of hepatitis A since August 1, 2016. This number includes 18 fatalities associated with the outbreak and affected a number of cities; City of Detroit, Huron, Ingham, Lapeer, Livingston, Macomb, Monroe, Oakland, Sanilac, St. Clair, Washtenaw, and Wayne Counties reported to MDHHS.Hepatitis A is an infection of the liver caused by a virus and is a vaccine-preventable disease.Symptoms may appear from two to six weeks after exposure, with the average time being about one month. (KGTV) - The Flower Hill Promenade in Del Mar is helping restaurants in its parking spaces by creating extra outdoor dining space.Milton's, a restaurant and deli in the shopping center, opened up a new outdoor area by covering up parking spaces with turf and tents and setting tables and chairs. That area opened up this week after new health orders forced restaurants to close their indoor dining areas due to rising coronavirus case numbers.Owner Barry Robbins says that they are also working on building a lounge area with a big-screen TV. With fans not allowed at the Del Mar horse track this season due to the pandemic, Robbins is hopeful their proximity to the race track will attract horse racing fans."We want to create a lounge, and put up a tv, and show the races there," he said. "Then you'll have more a night time venue with music, which we've never done before."Rose Javin, the General Manager at Flower Hill Shopping Center, says the outdoor dining spaces are an investment in their clients. Another restaurant in the Flower Hill Promenade, Cucina Enoteca, also recently rolled out turf and put up tents to create a comfortable outdoor setting for their customers. They are currently working with a third client to see if they can help them."The shopping center has put up the money to do all this and create this area for the tenant," Javin said. "We're a family here, and we want our tenants to thrive and survive."Robbins says they were hard-hit by the pandemic. When restaurants were allowed to reopen, Robbins says they invested thousands of dollars in putting up glass dividers inside the restaurant. Still, they were only open for two weeks before they had to shut their indoor area again.Robbins says having the outdoor space is a relief."It means sleeping at night. I was so scared," he said. DESCANSO, Calif. (KGTV) -- Firefighters Wednesday battled a house fire near Descanso that spread to nearby brush. According to Cal Fire, the blaze started on the 24000 block of Sherilton Valley Road in the area of Cedar Creek. Part of the home became involved in the fire before flames spread to nearby brush, scorching two acres.
