Dramatic moments in a San Bernardino courtroom today as a prosecutor slammed a sledgehammer onto a table. He was simulating what he says is how a Fallbrook family of four was murdered in 2010. Charles Merritt is accused of killing his business partner, Joseph McStay, his wife Summer and their two young sons Giani and Joe Jr. The prosecution says Merritt was being sidelined from the business and owed thousands of dollars to McStay. The defense countered in their closing arguments that the prosecution focused on trying Merritt’s character and not the actual facts of the murder. The defense told jurors the circumstantial case produced no evidence tying their client to the family’s violent deaths. The prosecution told jurors they didn’t have to prove how, where or when the murders took place, only that Merritt committed them. The McStays disappeared from their Fallbrook home in early February 2010. Days after they were last seen, the family’s SUV was found abandoned at a strip mall parking lot in San Ysidro.In 2013, the bodies of the family members were found in the Mojave Desert, near Victorville. Prosecutors said the family died from blunt-force trauma to their heads. Authorities found a sledgehammer, believed to be the murder weapon, in one of the graves.Merritt was arrested in connection with the killings in November 2014 after sufficient evidence linking him to the case, including DNA, was discovered.Authorities alleged Merritt killed the family members inside their home and then buried them in the desert. Merritt also tried to paint over the crime scene, according to authorities.Merritt, 61, has pleaded not guilty to charges of murder and is being held without bail.Prosecutors are seeking the death penalty in the case. 1758

EL CAJON, Calif. (KGTV) -- Two firefighters were injured fighting a blaze that sparked near El Cajon Wednesday afternoon according to Cal Fire. Cal Fire says the blaze started on the 5500 block of Dehesa Road around 4 p.m. and burned 25 acres. As of 6:40 p.m. Wednesday, the fire is 50 percent contained. An incident report shows that two firefighters were injured, though the extent of their injuries was unclear. The blaze did for a brief time threaten structures, but none were damaged. Due to the blaze, the San Diego County Sheriff's Department evacuated Vista De La Montana east of Dehesa Road. Evacuation warnings were also issued for Trafalgar Road, Calle De Nicole, and Vista De La Montana. EL CAJON (KGTV): Christmas season is always busy at Family Christmas Tree Farms in El Cajon. But this year, they've been busy for months, trying to save their crop.Excessive heat and drought in the summer, combined with an unusually warm fall, had a significant impact on their Monterrey Pines.During July and August, when temperatures reached 100 degrees, the farm doubled the amount of water it gave the trees.Meanwhile, warm weather in the fall kept the trees growing longer than usual. Stokes says the prices on the trees they buy from the Northwest are also more expensive. That's because areas of Washington and Oregon also had unusually warm years.Fortunately, he says, the trees handled the heat well, and they didn't lose any of the crops. EL CAJON, Calif. (KGTV) — El Cajon Mayor Bill Wells said he plans to call for a special City Council meeting on Friday to discuss instructing local police officers not to enforce coronavirus-related regulations."The people of El Cajon are suffering and it is highly unfair and nonsensical that big box stores, grocery stores, club stores and now even schools are open while nail salons, restaurants, churches, and other businesses and organizations are shuttered," Wells wrote on Facebook. "My people are suffering from not only financial ruin, but many are enduring severe depression, anxiety, isolation, and many other emotional, spiritual and sociological deprivations as a result of this stunning governmental overreach."Wells wrote that he will propose that the El Cajon Police Department stop enforcing mask, non-essential business, and social distancing laws.Speaking with ABC 10News, Wells said that he understands that the county and state may continue to hand out fines or criminal charges on businesses despite the stance. He added that he takes the virus extremely seriously but the mental health issues surrounding restrictions are too much."I don't enjoy taking a stand like this, this isn't going to be any fun. But I think my responsibility to the people are more important than my comfort," Wells, a mental health professional, said. "I want to emphasize I'm not telling people not to wear masks. I'm not telling people not to social distance. EL CAJON, Calif. (KGTV) - A 16-year-old is battling life-threatening injuries after he was struck by a vehicle in the East County.The teenager was hit by the vehicle at about 8 p.m. Monday near the intersection of East Washington Avenue and Waterloo Ave., El Cajon police said.Police arrived to find the teenager unconscious in the road and transported him to a nearby hospital. The identification of the victim is being withheld, police said.Police added that the teen was with three other male teenagers, who had been running south across East Washington Ave. outside of a crosswalk when the collision occurred. The driver of the Toyota Rav4 that struck the victim remained at the scene and has been cooperating with authorities. Police said they don't believe drugs or alcohol played a factor in the crash.Witnesses told 10News the intersection can be dangerous for pedestrians in the area. 921
