Authorities say a U.S. Navy training plane traveling from Florida has crashed in an Alabama residential neighborhood near the Gulf Coast, killing both people in the plane. Navy spokesman Zach Harrell says both people in the T-6B Texan II training plane died Friday. No injuries were reported on the ground. Foley Fire Chief Joey Darby told news outlets that responders encountered and extinguished a “large volume of fire” that had engulfed a home and cars. The crash occurred near the city of Foley and the town of Magnolia Springs. A Navy spokeswoman says the plane had flown out of Naval Air Station Whiting Field, about 30 miles northeast of Pensacola. 664

BAKERSFIELD, California — A Kern County, California judge decided Thursday to set free a man who's been on death row for 26 years.Vicente Benavides, 68, was freed from San Quentin Prison Thursday afternoon.The judge said all Benavides' charges were changed to not guilty.  His defense attorney told KERO television station that Benavides will not have to return to Kern County.On Tuesday, District Attorney Lisa Green made the announcement that her office would not file charges against Benavides, saying the case would be nearly impossible to retry in court. She said it would be very difficult to convince a jury beyond a reasonable doubt of Benavides' guilt.According to a decision released by the California Supreme Court last month, the convictions of Vicente Benavides in 1993 "were based on false evidence and that he received ineffective assistance of counsel."The decision also says that "false evidence was introduced at trial and that petitioner's convictions of substantive sexual offenses, special-circumstance findings, and judgment of death must be vacated."Benavides was convicted in 1993 of first-degree murder, rape, and other charges. He was sentenced to life. He was serving his term on death row in San Quentin. It was asked that his murder conviction be reduced to second-degree murder. That was also thrown out. The judgment has been vacated entirely. Benavides' defense attorney says his client's case is extremely rare, saying only two similar cases have occurred since the death penalty was reinstated in the 1970's.The California Supreme Court cited multiple doctors who evaluated 21-month-old Consuelo Verdugo in November 1991 when she died. The baby was taken from the Delano Regional Medical Center to Kern Medical Center then eventually the UCLA Medical Center where she died November 25, 1991.Multiple reports were made by doctors who said based on the inability to insert a catheter, bruising found near Consuelo's genitalia and other factors, they believed she had been sexually assaulted. 2101

They tested a group of 8 children and measured spinal pressure at three different amounts of backpack weight meant to mimic 10, 20, and 30 percent of their weight.They found that as the weight of the backpack load increases, back pain in children increases and spinal disc height shrinks as lumbar asymmetry grows.Which brings us back to the original question: How do you make sure a backpack is right for a child? Shoulder straps should be wide and padded to help distribute the pack's weight evenly, according to the website Healthy Children. Abdominal straps also help distribute weight across the waist, hips, and back.It's also recommended not to wear backpacks on only one shoulder, which shifts all that weight and leads to neck and back pain.Wearing it rightThe top of a backpack should sit one to two inches below the top of the shoulders. Also, the pack should not sit more than four inches below the waistline.The bottom of the backpack should align with the curve of the lower back.Preventing injury on the goWhile at school, its important for kids to be careful while lugging around their backpack. If possible, students should stop by their lockers often to unload any unneeded gear from their backpack. If bending down, kids should use both of their knees while wearing a backpack and not bend at the waist.Learning back-strengthening exercises can also help build up muscles primarily used while carrying weight.Consult a pediatrician if necessaryTalking with your child's doctor about back health is vital. Speak with your child as well about being vocal about back discomfort. At a contentious meeting on Monday, the Department of Justice's antitrust chief gave AT&T a choice: to get your purchase of Time Warner done, either sell off CNN's parent unit or DirecTV, or we'll see you in court.The government is holding up AT&T's pending acquisition of Time Warner, stirring speculation that the Trump administration is trying to retaliate against CNN for its coverage of the president.According to two sources with knowledge of the meeting, the DOJ is demanding that AT&T divest all of Turner, the unit of Time Warner that includes CNN as well as TNT and TBS."Threatening Turner is a fig leaf for threatening CNN," one of the sources said.AT&T is said to be reluctant to sell assets, especially Turner, which represents a significant portion of Time Warner's profits.Earlier on Wednesday AT&T said the timing of the deal's closing is now "uncertain.""We are in active discussions with the DOJ," John J. Stephens, chief financial officer for AT&T, said at a Wells Fargo conference.The stock of Time Warner, which owns CNN, fell more than 6.5% by Wednesday afternoon. AT&T was flat.The New York Times and the Financial Times also reported Wednesday afternoon that the DOJ was demanding the sale of CNN or Turner as a condition of approving the deal.The wireless giant previously said that it expected the acquisition to take effect by the end of this year. The deal was announced more than a year ago.The U.S. government is causing the delay. Stephens' comments effectively confirmed last week's Wall Street Journal report that the government is "actively considering" an antitrust lawsuit to block the impending acquisition.While the Justice Department declined to comment, sources had told the Journal that the department will sue if it can't reach an agreement on so-called "conditions" that are attached to the deal.The Journal story was an unwelcome surprise for AT&T executives. Transactions like Comcast's acquisition of NBCUniversal in 2011 are routinely approved with conditions attached."For over 40 years, vertical mergers like this one have always been approved because they benefit consumers without removing any competitors from the market," AT&T said last week. "While we won't comment on our discussions with DOJ, we see no reason in the law or the facts why this transaction should be an exception."The Justice Department's hardline approach to AT&T -- belying the business-friendly image of the Trump administration -- has spurred questions about Trump's personal interest in the deal.Time Warner's portfolio also includes Warner Bros., HBO, TNT and TBS.As a candidate, President Trump publicly vowed to block the deal. ATLANTA — The long-standing dispute over voting rights and election security has come to a head in Georgia.The state's messy primary and partisan finger-pointing offer an unsettling preview of a November contest when battleground states could face potentially record turnout.According to The Associated Press, many Democrats are blaming Georgia's Republican governor, Brian Kemp, and Republican secretary of state, Brad Raffensperger, for hours-long lines at polling stations. Republicans are blaming local Democratic officials in Atlanta, particularly in areas with large numbers of racial minorities, which saw some of the longest lines in the state.Georgia's Tuesday elections were plagued with a series of problems caused by the coronavirus pandemic, which forced the closure of dozens of polling stations across the state. Fewer polling stations resulted in long lines at stations that remained open.The pandemic also caused an increase in requests for absentee ballots — which some voters claimed they never received. Some of those voters then stood in line for hours hoping to cast an in-person ballot, only to be told they could not because they had requested a mail-in ballot that they never received.The election was further exacerbated by the use of new voting machines, which some precincts had trouble operating. Some polling stations had trouble turning on or logging into machines, and voters were forced to stand in line while workers waited for technical support.As of Wednesday morning at 7:30 a.m. ET, many races of national importance were still too close to call, with only 24% of the state's 2,354 voting precincts reporting complete results.
