INDIANAPOLIS -- Former Subway pitchman and convicted child predator Jared Fogle is continuing his quest to be released from prison early – most recently by asking a federal judge allow him to withdraw his guilty plea.Fogle pleaded guilty in 2015 to federal charges of conspiracy to distribute/receive child pornography and of traveling to engage in illicit sexual conduct with a minor. He also agreed, as part of his plea, to pay 0,000 each to fourteen unnamed juvenile victims as restitution.Judge Tanya Walton-Pratt sentenced Fogle to serve more than 15 years in prison on the charges. Fogle has been serving that sentence at the federal penitentiary in Englewood, Colorado.Since his sentencing, however, Fogle has filed dozens of motions seeking to have his sentence either reduced or thrown out altogether.Last month, Fogle, who is now representing himself in the case, argued that Pratt “has bias” against him because she was the mother of two teenage daughters at the time of his sentencing. That claim was easily disproven, though: Pratt has only one daughter, and said daughter was 24 at the time Fogle pleaded guilty.Fogle’s most consistent claim – which he has repeated in multiple filings and is now pursuing in two separate cases (Fogle v. Walton-Pratt et al and Fogle v. USA) – is that he was wrongfully allowed to plead guilty to a conspiracy charge in the case. Fogle contends that no such charge exists under federal law.Fogle’s claim appears to stem from a reading of the statute under which he was sentenced – 18 U.S. Code § 2252(a)(2) – that overlooks or ignores a latter passage that states, “Whoever violates, or attempts or conspires to violate, paragraph (1), (2), or (3) of subsection (a) shall be fined under this title and imprisoned not less than 5 years and not more than 20 years…”Fogle, as noted in the plea agreement he signed, is accused of conspiring to violate paragraph (2) of subsection (a).In a filing to the court on March 5, Fogle excerpts section (a) of the statute, while omitting section (b) entirely. In another filing under his “conspiracy” argument, Fogle included portions of letters between former FBI Director J. Edgar Hoover and former Republican U.S. Rep. Karl M. Le Compte dated 1946 – along with a portion of the Communist Control Act of 1954.Fogle also included portions of a transcript from the 2016 United States v. Frank Edwin Pate case in which he appears to have underlined sections containing language about “aiding and abetting.” Pate – who is incarcerated at the same prison as Fogle on a 2015 conviction for wire and mail fraud – was ultimately unsuccessful in that case.Although Fogle asks the court to “take judicial notice” of the facts presented in his filing, he does not make clear what, if anything, he believes the information presented within has to do with his case – nor is it immediately apparent.A previous attempt by Fogle to appeal his sentence in the 7th Circuit Court of Appeals in Chicago was rejected by the court, which dismissed Fogle’s arguments in June 2016 as “unpersuasive.”In addition to Judge Pratt, Fogle’s request on Monday for immediate release and a hearing on the constitutionality of the charges he pleaded guilty to was also addressed to the warden of the Englewood Federal Correctional Institute and to President Donald Trump. It was not made clear in the filing what, if anything, he hoped President Trump could do for him. 3436

It's a split! Players in Iowa and New York will share Saturday's massive Powerball jackpot. Two tickets matched all winning numbers on Saturday and the winners will split the estimated 7.8 million jackpot or a one-time cash option of 6.2 million -- the fourth largest in US lottery history. Each ticket is worth 3.9 million or 8.1 million cash. It's still unclear how many people won Powerball's top prize. The winning numbers drawn Saturday were 8, 12, 13, 19, 27 and the Powerball was 4.The total jackpot was slightly adjusted from an estimated 0 million based on the actual drawing sales. The largest Powerball jackpot was .586 billion and it was split three ways in January 2016.Saturday's total jackpot was surely mind-blowing. Just imagine, if you had it all in 0 bills it would make a stack nearly as high as the tallest tower in the world, the Burj Khalifa in Dubai, according to the Powerball website. The Burj Khalifa is twice the height of New York's Empire State Building and three times as tall as the Eiffel Tower in Paris.Powerball has paid out its top prize only seven times this year, lottery officials said. Before Saturday's drawing, there were 21 drawings without a winner. The last winning ticket that took home the jackpot was sold in New York in August. But don't throw away your ticket yet, there are plenty of secondary prizes. Lottery officials say two tickets in Florida and Texas won million and 13 others in nine states won million each. Each Powerball ticket is . The game is played in 44 states, Washington, D.C., Puerto Rico and the US Virgin Islands. 1611

It has been the biggest secret in American politics for weeks: Who will be Joe Biden's running mate? On Tuesday, Biden announced that Sen. Kamala Harris will be his running make this November. Harris formerly opposed Biden for the Democratic nomination, and could become the first ever woman elected in a US national election. Biden's pick was not leaked beforehand, marking a rare instance in the echo chamber of Washington where news spreads quickly. So how has Biden been able to keep this process such a secret? SMALL TEAMOne major reason is the fact that Biden had a small teaming vetting potential picks. Former Connecticut Sen. Chris Dodd, Delaware Rep. Lisa Blunt Rochester, Los Angeles Mayor Eric Garcetti and longtime Biden aide Cynthia Hogan served as co-chairs on the vetting committee.Former White House counsel Bob Bauer, campaign general counsel Dana Remus and former homeland security adviser Lisa Monaco also were involved. Beyond that however, many top advisers were not invited to vetting meetings. That prevented leaks. VIRTUAL MEETINGSMany of the contenders met with Joe Biden virtually. It's a lot easier to keep a meeting secret when it's not done face to face. The candidates, all women, also kept their interactions with Biden a secret. It wasn't until several days after that Michigan Governor's Gretchen Whitmer's meeting with Biden was revealed.AIRPORTSA popular past time for political journalists is to track private aircrafts flying into airports near Biden's home. In recent years, VP picks have all flown via private aircraft once they've been picked. Biden's home, however, is centrally located to around a dozen airports within a 2-hour drive. Philadelphia International Airport's private terminal is only a 25 minute drive from his house. 1783

In the coming weeks and months, several coronavirus vaccines will begin making their way to our cities in a hope to curtail the spread of a virus that has put a halt on our everyday lives and filled the nation's hospital rooms.Yasir Batalvi, 24, signed up for one of these trials and was among the first Americans to be vaccinated against the coronavirus. The Boston-area resident was among those who participated in Moderna’s coronavirus vaccine trial.Moderna’s vaccine has been hailed as a medical breakthrough. The vaccine has been considered 94.1% effective against the virus. According to Moderna, none of the thousands who were given two shots of the vaccine had severe COVID-19 symptoms. That is compared to 30 patients who were given a placebo who had symptoms. While the vaccine could nearly eliminate the number of hospitalizations and deaths associated with the virus, the shot might result in some symptoms."I actually had some pretty significant symptoms after I got the second dose. Once I got the second dose, I was fine while I was in the hospital. But that evening was rough. I mean, I developed a low-grade fever, and fatigue and chills," Batalvi told CNN.But by the next day, Batalvi said he felt “ready to go.”In an interview with CNN last week, Operation Warp Speed chief scientific adviser Moncef Slaoui said that 10 to 15% of those immunized had noticeable side effects.“Most people will have much less noticeable side effects. That frankly -- in comparison to a 95% protection against an infection that can be deadly or significantly debilitating -- I think is an appropriate balance," he told CNN.Batalvi was entered in a double blind trial, meaning he doesn’t know if he was given a placebo or the actual vaccine."I hope once this vaccine comes out, people feel confident taking it. I mean, I'm right here: I took the vaccine -- it was all right. I think we can get through this," he told CNN.In order to obtain an emergency use authorization, the FDA will weigh the vaccine’s benefits against possible side effects. 2049
