SAN DIEGO (KGTV) - An inmate at R.J. Donovan State Prison has filed a lawsuit against the California Department of Corrections and Rehabilitation.Anand Jon Alexander filed the complaint on Monday, alleging prison officials failed to keep him safe and to provide adequate medical care after he was assaulted behind bars.In the complaint, Alexander claims he was attacked by another inmate while waiting to make a phone call on May 18, 2019. He was allegedly stabbed multiple times in the face and kicked on the ground.After the attack he sustained “five facial fractures, a lower orbital floor blowout, sinus and nasal fractures, a deviated septum, a 50% abrasion to the right cornea, long term impairment of his vision and respiration, serious nerve damage, PTSD” according to the complaint.Alexander is 12 years in to a 59 year sentence after he was convicted of rape in 2008.An up and coming fashion designer, Alexander had been featured on “America’s Next Top Model” and was listed in Newsweek’s “Who’s Next in 2007.”But his career was put on hold after being accused by multiple women of sexual assault.Many of the charges were dropped, but he was convicted on one count of rape and 15 other counts following a trial in Los Angeles. The jury found him not guilty or were hung on several other counts.Alexander has maintained his innocence. In the complaint, his lawyer writes he “has acknowledged the existence of blurred lines between his personal and professional relationships…Nevertheless, he holds steadfast to his innocence.”The American Justice Alliance, a group which seeks to free prisoners who have been wrongfully convicted, submitted an amicus brief to the Federal Central District Court.In it, they wrote Alexander “was targeted by a collusion of disgruntled business associates and some former girlfriends, who have admitted they were out to “bring him down,” and “get revenge,” seeking notoriety and monetary benefits. He was then subject to a prosecution and trial riddled with extraordinary police misconduct.”The lawsuit names CDCR as well as Marcus Pollard, the Warden of R.J. Donovan Correctional Facility and Daniel Paramo, the former Warden.It alleges prison officials failed to protect Alexander from harm and after he was injured gave “deliberate indifference to Mr. Alexander’s medical condition.”They are seeking unspecified monetary damages and a jury trial.So far, no criminal charges have been filed against the assailant. 10News reached out to CDCR for comment but had not heard back before the story was published. 2557

SAN DIEGO (KGTV) - A Starbucks that played a key role in redeveloping North Park will soon serve its last drink.Carly Clegg is a regular at the Starbucks next to The Observatory North Park."It's a bummer," said Clegg.The collection of notes posted inside the Starbucks tell the story: Customers bidding farewell to their Starbucks. It will close up for good Saturday. The apparent reason for the closing is one regular Robert Green knows well. Several customers who have asked employees why it's closing have been told an increase in homeless individuals are turning off customers, leading to a decline in sales."There are people camped out there all day. I noticed an uptick starting about five years ago," said Green."When I have family and friends that come in, they walk by and say, 'Let's go to another one,'" Clegg added.The closing comes some seven months after Starbucks announced customers would no longer be required to buy something to use the restroom or hang out. Critics said the policy could attract more homeless. Closures like this one are likely to add fuel to the debate."You hate for this business to go out with a whimper," said Green.The Starbucks opened up 13 years ago during the renovation of the North Park Theatre. Green was on the planning committee that approved the redevelopment project."They stuck out their necks. They were one of the first businesses in. They were a catalyst," said Green. Green says the long morning lines he saw at the Starbucks five years ago have disappeared. He hopes the closure won't be sign of things to come."A lot of people have put a lot of work and money into this neighborhood ... It makes you wonder who could be affected next," said Green.In a statement, Starbucks says, "... as part of Starbucks standard course of business, we continually evaluate our business to ensure a healthy store portfolio. SAN DIEGO (KGTV) -- An incredible San Diego holiday tradition is making its way back to the bay.The San Diego Parade Bay of Lights has announced this year’s dates and times to take in the spectacular holiday tradition.This year, the parade will take place December 9 and December 16. The event begins at 5 p.m. and will make its way through the Bayfront.Before making the turn to Coronado, the parade will proceed to the pier at Cesar Chavez Park.The parade is put on annually by the Port of San Diego and brings more than 100,000 residents and visitors to the bay each year. Roughly 80 boats are expected to participate in the parade’s 47th year. 655

SAN DIEGO (KGTV) -- A San Diego man was arrested Saturday after allegedly assaulting an elderly woman at a Central Coast beach parking lot in San Luis Obispo, law officials said.Morro Bay Police Officers responded to a disturbance call at around 1 p.m. at the Morro Rock parking lot on Coleman Drive, authorities said.Witnesses told officers that the suspect assaulted an elderly woman and knocked her to the ground. Numerous people witnessed the attack and went to help the victim, according to police.Officials said the woman was treated by first responders for moderate injuries.In a press release, officials said Brian Robert Sprinkle, 39, of La Jolla, "was participating in a surf competition when he exited the water and assaulted the woman without provocation."Sprinkle was booked in the San Luis Obispo County Jail on felony charges of elder abuse and battery, according to Morro Bay police.Officers also found a firearm with Sprinkle's property and seized it.It is believed the suspect was under the influence of marijuana and hallucinogenic drugs, police said in a statement.Anyone with information regarding this incident is asked to contact the Morro Bay Police Department (805) 772-6225.While police say Sprinkle was taking part in the Big, Bad and Ugly surf competition, surf contest organizers tell KSBY News he was not registered with the contest and is not affiliated with any of the surf clubs that participated.ABC 10News affiliate KSBY News contributed to this report. 1497

SAN DIEGO (KGTV) — An autopsy report for a San Diego State student who died after falling from his bed after a night of partying revealed elevated alcohol levels.The report from the county Medical Examiner found that Dylan Hernandez, 19, died of blunt force injuries of head and ruled his death an accident. At the time of the autopsy, a toxicology report said elevated alcohol levels of 0.06 percent and cannabinoids were found in his system. However, earlier reports from campus police said he had a 0.23 percent blood-alcohol level the morning he fell.Hernandez fell from his bunk bed in the early morning hours of Nov. 7, 2019, after a fraternity party that night. The family said they believed campus police were not pursuing certain angles, including a possible cover-up."The Hernandez family is concerned because witnesses they provided to SDSU and UPD still have not been questioned," George Kindley, the Hernandez family's lawyer, said.Hernandez's family claims SDSU Police never sought out warrants for Snapchat videos or phone records from members of Phi Gamma Delta fraternity, the fraternity Hernandez was pledging to join. They said police were aware that some fraternity brothers may have instructed others to delete videos and messages that were incriminating.University police said they are aware of the autopsy results released Thursday and "will be evaluating the findings as part of the ongoing investigation." 1916
