PHOENIX, Arizona — Cell phone video of a boy repeatedly punching a girl in a sixth-grade class at Alfred F. Garcia Elementary School in Phoenix has gone viral, and the mother of the victim is upset with the school for not contacting her after the beating. The 12-year-old girl who was punched did not want to show her face or give her name, but says a lot of kids in school have seen the video. "It's gotten to the point where it's so viral, that they've made memes about it," said the victim.The girl used to be friends with the boy who is seen punching her, but she claims she made a joke months ago about his sister. She says she feels the attack was planned and some kids pulled out their phones to record it.  "I looked at the phone, and I knew it was coming," said the victim. "That's why I didn't do anything about it."The victim says she didn't tell her mom because she didn't want her to worry. "It was hard telling her because I don't like seeing my mom cry," said the victim. "It hurts."But her mom, Antoinette Contreras saw it days later.  "It just feels like all my fears and worst thoughts happened," said Contreras. "They came true."Contreras says she is shocked the school never contacted her. She finally got through to the principal on Thursday. "My question to her was, 'Why did you not contact me?'" said Contreras. "This happened on Monday. It is now Thursday."And while she wants the boy to face consequences, more importantly, Contreras wants him to get help. "I come from, what we call the ghetto, south Phoenix," said Contreras. "A lot of times these kids are rejected. They're the rejects of the world. The outcasts. The misfits. They're the ones that no one cares about. Because the parents don't care about them at home. And the staff doesn't care about them at school. And no one on the streets cares about these kids."Contreras says she plans to pull all of her children out of the Murphy Elementary School District. She will also bring the issue to district officials and police. There is a new law that goes into effect next school year that requires school officials to notify parents after violent incidents.  2211

Papa John's tanked Tuesday after a report that a plan to sell the company has fallen apart.The Wall Street Journal reported that the asset manager Trian Management Funds is no longer interested in bidding for the company. According to the Journal, others are still considering taking a stake in the company, but not a total purchase.Papa John's (PZZA) stock was down 10% at market close Tuesday.Papa John's declined to comment for this story. Trian did not immediately respond to a request for comment from CNN Business.Rumors have been swirling for weeks about potential buyers for the company. The Journal reported Trian's interest last month.Without a buyer, the struggling pizza company will have to find a way to convince investors that it can solve its problems on its own, and beat out competitors Domino's and Pizza Hut. That's a tall order.The company has been working hard to distance itself from controversial founder John Schnatter, who resigned his role as chairman in July after news broke that he had used the N-word on a conference call.Papa John's said earlier this month that same-store sales in North America fell by 9.8% during the most recent quarter. Total revenue dropped 15.7% from a year earlier to about 4 million.Schnatter also stepped down as CEO at the end of last year after he caused a controversy by blaming the NFL for poor pizza sales. Schnatter said sales were hurt by the way the league handled players' kneeling during the National Anthem in protest of racial injustice.Since then, Papa John's hasn't been able to regain its momentum, and sales have continued to slip.Other pizza sellers have struggled this quarter. Pizza Hut's sales were flat, and though Domino's (DPZ) reported domestic and international same-store growth, the company missed analyst expectations.But Pizza Hut and Domino's are better equipped to win the pizza wars. Domino's has invested heavily in tech, and Pizza Hut is bolstering its partnerships. Pizza Hut replaced Papa John's as the NFL's official sponsor earlier this year. 2159

  

Police asked for the public’s help Wednesday to identify a man they say tried to kidnap a 3-year-old from a grocery store in Brooklyn.The child was in a stroller and with his grandmother at the Thanksgiving Supermarket, at 2239-2247 86 St. in Gravesend, Monday around 3:49 p.m. when the incident occurred, police said.While the grandmother wasn't looking, police said a man grabbed the stroller and took off. 416

  

Police say a white gunman opened fire at a Kentucky grocery store, killing two African-Americans, after he tried and failed to enter a predominantly black church nearby.Gregory Bush, 51 was indicted on five counts Wednesday, including murder and attempted murder; none of them were hate crime charges, despite comments from authorities that the shootings appear to be racially motivated.CNN has reached out to a public defender for Bush and is waiting to hear back.Prosecutor Tom Wine said that because Kentucky's hate crime statute does not include homicides, Bush was not charged with a hate crime for the deaths."A hate crime designation only occurs when the judge makes such a determination at sentencing. If the judge finds a hate crime designation is appropriate, it doesn't add any additional time. The designation is only useful if the judge wishes to deny probation or the parole board wants to defer parole," Wine said in a statement.Hate crimes are considered more difficult to charge and prosecute than other criminal charges, largely because they require law enforcement to prove a specific motivation of bias.Additionally, federal investigators are looking into potential civil rights violations, including hate crimes, said Russell M. Coleman, the US attorney for the Western District of Kentucky.Bush faces two counts of murder for the shooting deaths of Maurice Stallard, 69, and Vickie Jones, 67, inside the Kroger grocery store in Jeffersontown, and in the parking lot outside, Wine said.Bush is also charged with one count of attempted murder stemming from what authorities described as an exchange of gunfire with an armed civilian. The indictment identifies the armed civilian as Dominic Rozier. Bush is charged with two counts of wanton endangerment for firing shots in the directions of two more people, Kiera Rozier and an unidentified juvenile.Jeffersontown Mayor Bill Dieruf said on Monday that the shooting is being investigated as a hate crime based on the circumstances, including the race of the victims and the defendant.Dieruf said investigators are looking into reports that Bush told a bystander before he was captured that "whites don't shoot whites."Bush remains jailed on five million dollars bond.
