Deputies arrested a Polk City, Florida woman for DUI on a horse in Lakeland on Thursday. Donna Byrne, 53, was riding the horse in the roadway when deputies arrived on scene. Deputies said Byrne smelled like alcohol, had watery bloodshot eyes and was staggering. A field sobriety test was conducted and she was arrested for DUI. Byrne was also charged with animal neglect for failing to provide proper protection to the horse. According to the affidavit, Byrne put the horse in jeopardy of being injured or killed.Byrne blew a .157 and .161 BAC. A breath alcohol level of .08 is the legal limit in Florida. 633

DENVER -- An Aurora Theater Shooting survivor, who made the difficult decision to amputate his leg after years of excruciating pain, is now taking his first steps toward recovery.Joshua Nowlan was shot in the arm and the leg in the 2012 movie theater shooting, and recovery has been hell. "Last night, I couldn't sleep whatsoever," Nowlan said, walking into Creative Technology Prosthetic's Denver office. "I was so excited that today finally has come that I can put my prosthetic on for the first time."After doctors amputated his leg in January, he had major complications, including kidney failure, a serious fall and a hematoma that required another emergency surgery."I am still completely 100 percent on the side that I am happy, that I did the amputation surgery," Nowlan said, rubbing the stump that is still swollen and healing.As he took his first steps on his prosthetic, he began to cry."It feels so weird, but it feels so right, too, at the same time," he said.Zach Harvey made the prosthetic and said that eventually, Nowlan will walk without any assistance and with a different prosthetic."Right now, we want something a little softer, but as he starts to tolerate pressure, walk faster, and wants to do more activities, then we'll provide him with something a little springier," Harvey said.Nowlan said it's another piece in the puzzle he is trying to put back together."Even though it happened five years ago, he took something from me that will never be put back together," Nowlan said. "And here I am trying to makeshift those puzzle pieces and put them back in."  1656

DENVER (AP) — A Colorado police officer will not face charges for fatally shooting a homeowner who had just killed an intruder inside his suburban Denver home, prosecutors said in a letter released Monday.Adams County District Attorney Dave Young described Richard "Gary" Black's death as a "harrowing tragedy" but said his role was to determine whether the Aurora Police officer who shot the 73-year-old Vietnam War veteran was justified in using deadly force.Based on witness interviews and more than 90 videos captured by officers' body cameras, Young said Officer Drew Limbaugh did not know who Black was and fired when the homeowner refused police commands to drop his handgun.Young said Limbaugh's belief was reasonable and prosecutors cannot prove that the officer was not justified in firing. He said there also is no evidence that Limbaugh was reckless or criminally negligent."Officer Limbaugh engaged in conduct that was consciously focused on minimizing the risk to public safety," Young wrote.At the time of the shooting, Young said police did not know that Black had woken after midnight to investigate banging sounds and soon heard his 11-year-old grandson screaming as an intruder attacked him inside the bathroom. Police also did not know that the intruder, later identified as Dajon Harper, was lying on the bathroom floor after being shot twice by Black, he said."The evaluation of Officer Limbaugh's reasonable belief must be based not upon what we now know, but the circumstances as he perceived them at the time: hearing gunshots and then seeing an armed man emerge from a back room who refused commands to drop the weapon," Young wrote.The witnesses and police officers interviewed by investigators paint a chaotic scene. Young said police arriving at the home in Aurora around 1:30 a.m. on July 30 had little information and no description of a suspect.Within seconds, he said police heard gunshots inside the house and saw Black come into the hallway holding a handgun in one hand and a flashlight in the other. Young said the body camera footage shows police repeatedly told Black to drop his weapon before he came toward officers, raising the flashlight, and Limbaugh fired three times.Police have said Black had hearing impairment due to his military service. Young wrote that Black may not have heard the commands or recognized the officers as police but said that does not change Limbaugh's "reasonable belief that Mr. Black presented a threat."Witnesses told police that Harper was at a party at a family member's home nearby and may have been using drugs. Early that morning, he ran away and apparently broke down the Black family's front door.Black's grandson told police he woke up after feeling a cold breeze. He described walking toward his father's bedroom but then seeing a stranger showering as he passed the open bathroom door.The boy said the man grabbed him, locked the bathroom door and was strangling him before his father and grandfather were able to get inside the room.Harper, who was 26, died after being shot twice in the chest by Black. DENVER, Colo. — On Wednesday, a Boulder man released videos of his July 29 arrest, and said he's ready to take action against the Denver Police Department for "savagely" beating him. He also claims an officer sexually assaulted him with a baton.Michael Jacobs, a self-described student activist, was arrested on July 29 during a "Stop the Sweep" homeless protest at Lincoln Park, across from the Colorado State Capitol.He says he was rattling a fence at Lincoln Park to get an officer's attention and says he was taken down by officers."I was grabbed from behind, it felt like it was from my neck, no warning, no 'you're under arrest,'" Jacobs said.It's important to stress that little is known about what led up to the takedown. Video shows people shaking a fence at the park and then the takedown.In the video, you see an officer run towards Jacobs and then several officers holding him down. You can briefly see an officer use his baton against Jacobs in the recording."One of the officers took his baton, lifted it in the air and forcefully shoved it into my a**," Jacobs said.A probable cause statement released by the Denver Police Department claims Jacobs was part of a group trying to push down a gate at Lincoln Park and adds that they managed to bring it down and get inside.But in the video, Jacobs is outside of the fence.The police report states Jacobs violently resisted arrest and even grabbed an officer's pepper ball gun. It's a claim Jacobs and his attorney, Dr. Matt Greife, dispute."That could not be further from the truth," Jacobs said."To say that he attempted to disarm a police officer of their pepper gun or pepper ball gun, that's nonsense, he was on the ground way too fast," Dr. Greife said.According to Dr. Greife, it's been challenging to obtain vital evidence they should be granted to prepare for a lawsuit and a civil claim they plan to file."We should know what the police reports say. We should know what the body cams tell us," Dr. Greife said.Denver police say they launched an internal investigation and added that it would be inappropriate to comment further.Medical records provided by Jacobs' attorney to KMGH show a doctor couldn't conclusively identify sexual abuse from the incident.Jacobs is facing a felony charge of attempting to disarm a police officer.
