PHOENIX (AP) — Police served a search warrant Tuesday to get DNA from all male employees at a long-term care facility in Phoenix where a patient who had been in a vegetative state for years gave birth, triggering reviews by state agencies and putting a spotlight on safety concerns for patients who are severely disabled or incapacitated.Hacienda HealthCare said it welcomed the DNA testing of employees."We will continue to cooperate with Phoenix Police and all other investigative agencies to uncover the facts in this deeply disturbing, but unprecedented situation," the company said in a statement.Local news website Azfamily.com first reported the woman, who had been in a vegetative state for more than 10 years after a near-drowning, delivered a baby on Dec. 29. Her identity has not been reported, and it's not known if she has a family or a guardian. It's also unclear if staff members at the Hacienda de Los Angeles facility were aware of the pregnancy until the birth.In a statement, board member Gary Orman said the facility "will accept nothing less than a full accounting of this absolutely horrifying situation.""We will do everything in our power to ensure the safety of every single one of our patients and our employees," Orman said.Hacienda CEO Bill Timmons stepped down Monday, spokesman David Leibowitz said. The decision was unanimously accepted by the provider's board of directors.Gov. Doug Ducey's office has called the situation "deeply troubling."Phoenix police so far have declined comment.The Hacienda facility serves infants, children and young adults who are "medically fragile" or have developmental disabilities, according to the website. In the wake of the reports, the Arizona Department of Health Services said new safety measures have been implemented. They include increased staff presence during any patient interaction, more monitoring of patient care areas and additional security measures involving visitors.The state's online complaint database for care facilities shows multiple complaints about Hacienda de Los Angeles going back to 2013. Most of them involve fire drill and evacuation preparation or Medicaid eligibility. But one complaint from December 2013 outlines an allegation that a staff member made inappropriate sexual comments about four patients two months earlier. Nobody relayed the incidents to an administrator. That employee was later fired.Martin Solomon, a personal injury attorney in Phoenix whose clients are mostly vulnerable adult victims of abuse and neglect, said a lawyer representing this woman should call for all pertinent medical records, a list of current and ex-employees and any past litigation involving Hacienda. It would be the police who would lead DNA testing to figure out who fathered the baby, Solomon said.It would be hard for Hacienda to escape any kind of liability in court."There's a lot of information we do not have, But things like this don't happen without someone either knowing about it or should have known about it," Solomon said. "Whether it's an employee or someone from the outside, the facility has an obligation to protect residents."Advocates for the disabled say Arizona needs to find a way to monitor allegations of sexual abuse and sexual violence in these group settings. Doing background checks isn't enough, said Erica McFadden, executive director of the Arizona Developmental Disabilities Planning Council."I think when you've had somebody who's had multiple allegations from different parties, there has to be some way to track that," McFadden said. "If it's the same story from different people, then there's something wrong."The council recently formed a task force to look at how to improve training for health care workers when it comes to identifying and reporting sexual abuse."We don't have a systematic way to train people what's a good touch or a bad touch. We also don't have required training for providers," McFadden said. "We really need a lot of work in this area."Jon Meyers, executive director of The Arc of Arizona, an advocacy group for people with intellectual and developmental disabilities, called the allegations "disturbing, to put it mildly.""I wasn't there. I clearly don't have firsthand knowledge of what happened," Meyers said. "But I can't believe someone receiving that level of constant care wasn't recognized as being pregnant prior to the time she delivered." 4413

Papa John won't leave Papa John's alone.The company has tried hard to distance itself from founder John Schnatter, who blamed the NFL for poor pizza sales last fall and then admitted using the N-word on a conference call this spring.Sales slumped, and Papa John's stock declined. CEO Steve Ritchie and the current leadership blame Schnatter, who stepped down as chairman in July.Schnatter told CNNMoney in an interview Tuesday that he's being scapegoated."You can't blame everything on two comments," he said. "I wish I had that kind of power, but I don't."Instead, Schnatter pinned the company's problems on Ritchie, who became CEO in January. Schnatter described him as a poor leader who has created a culture of intimidation at Papa John's, and let quality and customer service slip."We need new leadership," he said. "He struggles as a CEO.""Steve'll make a great executive somewhere else," he added. "He's just the wrong guy for the job."He described upper management under Ritchie as vindictive and controlling."People right now are scared to talk," he said.Schnatter, who is still the largest shareholder and owns almost a third of the company, insists he doesn't want to return as CEO. But he has mounted a scorched-earth campaign to drive Ritchie out of his job.In a letter to franchisees posted to his personal website on Monday, the founder said the company is struggling because of "rot at the top."In a statement, Papa John's called the accusations "untrue and disparaging," characterizing them as "a self-serving attempt to distract from the damaging impact his own words and actions have had on the company and our stakeholders.""John Schnatter also publicly supported Steve Ritchie's appointment as CEO at the end of last year," the statement said.Schnatter flipped that argument around."There's a little bit of a farce going on here," he said. "Steve Ritchie promises great things, and then bad things happen, and then he blames somebody else."Schnatter's lawyer Garland Kelley said the company allowed Schnatter's comments about the NFL and his use of the racial slur to be misrepresented in the press."There's a critical disconnect between what John actually says and how the company permits it to be portrayed publicly," Kelley said. "We think there's a reason this is occurring."In July, Forbes reported that Schnatter had used the N-word while on a conference call with his marketing agency."Colonel Sanders called blacks n-----s," Schnatter reportedly said during a training on how to avoid gaffes like the NFL comments. "I don't talk that way.""I think the company has made the situation a lot worse," Schnatter said. "[The comment has] been misquoted, it's out of context, it's been portrayed in a way that's not truthful. But I'm still going to feel bad about that.""I love my employees. I love my franchisees," he said. "For anything that hurts them, then I'm going to feel bad about that, and I do."Schnatter also thinks his remarks about the NFL leadership have been misconstrued.Last year, some NFL players knelt during the National Anthem to protest treatment of black Americans, particularly by police. The protests sparked a controversy, and the NFL ultimately ruled that players can't kneel during the anthem."I felt like the situation was not a winning situation for the fans, the sponsors, the players and the owners," he continued.A few months after Schnatter called out NFL leadership, Papa John's ended its NFL sponsorship. Pizza Hut took its place.Papa John's is trying to put both comments, and Schnatter himself, behind it.The company is stripping Schnatter's image from its marketing materials and has taken the unusual step of approving a provision that would prevent him from gaining more control of the company.Ritchie went on a listening tour, mandated bias training for all employees and promised to increase diversity among staff. The company also launched a social campaign acknowledging customers' concerns.Papa John's has also commissioned an investigation into its diversity and inclusion practices.Asked whether the investigation would find any examples of misconduct by him, Schnatter said: "At the end of the day, I'm the principal owner of the company.""They've got to point bad results on somebody, and that's probably going to be me." 4908

Phoenix police say a woman has died in an officer-involved shooting Wednesday evening. The incident happened near 43rd Avenue and Union Hills Drive around 7 p.m.Police say no officers were injured in the shooting.According to police, around 6:45 p.m. officers responded to a call of shots fired in the area. As officers arrived, a woman reportedly ran out with an AR-15 style rifle and fired shots which prompted officers to return fire, hitting the woman.Police say the woman was pronounced dead at the hospital. No further information was immediately available.  592

PARKLAND, Florida — As students at Marjory Stoneman Douglas High School return from spring break, they will face several new security changes at the school.On Monday, students will receive clear backpacks for free, and the superintendent says those will be the only backpacks allowed on campus.The thousands of students at the school will also now wear a school identification badge everywhere on campus.This comes after the deadly school shooting in February that killed 17 people, but also after a series of incidents the week leading up to spring break.Two students were charged with bringing weapons on campus, and a third made a threat on social media.Deputies also arrested the confessed shooter’s brother for trespassing on the school property. Zachary Cruz pleaded no contest Thursday and sentenced to time served and six months of probation.A Broward County sheriff’s deputy was also suspended for allegedly sleeping in his patrol car while on duty at the school.Florida Highway Patrol will also have eight troopers stationed at the school entrances. The Broward County School district is providing additional security as well.This district will also consider metal detectors, metal detector wands, and trying to consolidate the point of entry for students and staff.The memorial that honored their classmates for the past six weeks is no longer there. Over spring break, it was cleaned up and moved so the items can be preserved. 1457
