SAN DIEGO (KGTV) - A former employee of the San Diego Metropolitan Transit System is suing the agency for retaliation after he said he stood up for a co-worker.Ivan Augustino moved to the United States from Sudan and still volunteers with projects for his native country. He started working for MTS in 2015.“It was pretty good,” Augustino said.Augustino worked as a Senior Applications Developer.“I am the main guy that deals with the complicated back end computer codes,” Augustino said.In 2017, he said he made a move that changed everything. It started with a co-worker.“One morning, she walked into my office pretty much in tears,” Augustino said.He said that a co-worker confided to him the Chief Information Officer discriminated against her when she asked about a promotion. The lawsuit filed against MTS claims the CIO told Augustino’s co-worker she was “not qualified for the job because of her age, her marriage and family planning status, and her relationship to an active duty military service member.”“The other question she also asked was, how old are you? You seem like you are at an age where you would be having kids,” Augustino said. It was a shocking conversation.“You know, that is wrong,” Augustino said.After his co-worker told him what happened, he first asked advice from another co-worker who then took it to human resources. Augustino said his co-worker did not want to bring the complaint to HR.“The last thing that anyone within the IT department wants is to take an issue to HR because once you report it to HR, there is going to be retaliation,” Augustino said.And that’s what happened, according to the former MTS employee. Initially, he was concerned how MTS investigated the complaint.“I was expecting someone to at least come and talk to me, but no one spoke to me,” Augustino said.He said retaliation began by the CIO and his direct supervisor.“The way they treated me just changed,” Augustino said.He claimed management suggested they would give him recommendations if he found another job. On another occasion, Augustino said they “mocked [his] English as a second language” in an email. On top of that, he said 98 hours of paid time off promised to him for working overtime on a big project was revoked, along with a promised promotion.“Coming from where I come from, I just felt like I did not even know what to do,” Augustino said.Feeling “degraded” and “intimidated”, he submitted a letter of resignation. However, he said he gave management an option.“If you can address this issue and the executive team and bring what I view as retaliation to a stop, I will pull my resignation,” Augustino said. Instead, he said he was fired and walked out of the building by security. His termination came a little over a month after he voiced his concerns about his female co-worker.A spokesperson for MTS told Team 10: “There is absolutely no validity to any of Mr. Augustino’s claims.”When asked if he would defend his co-worker again, Augustino said “absolutely.”Attorneys Zachary Schumacher and Daniel Goularte represent Augustino."This is absolutely a David versus Goliath situation," Schumacher said.Schumacher said fear is why people don't speak up."I like to compare it to battered wives syndrome, where you essentially have this person or in this case this entity who has this major power and balance who is doing all sorts of awful things and figuratively at least, battering its employees and yet they don't leave. SAN DIEGO (KGTV and CNS) -- A suspected arsonist was arrested for allegedly starting a series of brush fires in Otay Mesa West, Sunday afternoon. MAST (Metro Arson Strike Team) investigators booked 49 year-old Ramon Guevara for arson.According to the San Diego Fire-Rescue Department, the blaze broke out just after 10:30 near 4th Avenue and Private Road. The fires were ignited in the valley at Otay Valley Regional Park.Crews say at least 10 spot fires started along the road and, as of 12:30 p.m., and had burned three acres. Sunday marked the third day in a row small brush fires popped up in the area. Units from the Chula Vista and San Diego fire departments and two firefighting helicopters joined to battle the flames. SAN DIEGO (KGTV) - A beloved comic book is making a comeback, 13 years after disappearing off the shelves.San Diego artist Dennis Caco created Max Boost! in 1998, the original Import Tuner racing comic. "I just love creation. Creation has always been my thing. I love being very creative, making things from something to nothing," said Caco. "We were ridiculed and made fun of, but the performance was there!" says Caco. SAN DIEGO (CNS) - The unemployment rate in the San Diego-Carlsbad Metropolitan Statistical Area dropped to 7.7% in October, a drop of 1.2% from September, according to figures released Friday by the state Employment Development Department.According to the EDD, total non-farm employment in San Diego County increased by 21,500 jobs month-over-month -- from 1,386,600 to 1,408,100 -- while farm employment contracted from 9,600 to 9,500.The unemployment rate at this time last year was 3%. The region lost 106,500 non-farm jobs and 400 agricultural jobs over the year.The region's unemployment rate rose to 15% in May during the COVID-19 pandemic, according to EDD data, while data from the San Diego Association of Governments showed rates of nearly 30% unemployment in May.In September, the state's unemployment rate dropped to 9% from 10.8% the previous month, and the nation's decreased to 6.6% from 7.7%.Professional and business services led all industry sectors in month- over-month job gains at 5,200. The majority of job gains were centered in professional, scientific and technical services -- up 3,400 -- while 1,000 jobs were posted in scientific, research and developmental services.Government jobs grew by 4,300, with 2,700 in local and 2,500 in state government gains. SAN DIEGO (KGTV) -- A fire that burned near SDSU Sunday afternoon, forcing the evacuation of a nearby apartment complex has been contained. According to the San Diego Fire-Rescue Department, the fire burned roughly two and a half acres. University Police evacuated the Villa Alvarado Apartments during the blaze. Evacuees were asked by the school to report to the Tula Community Center at 6126 Montezuma Road. As of 2:18 p.m. evacuations were still in place. San Diego Fire-Rescue Tweeted around 1 p.m. that the blaze was burning on the 5500 block of Canyon Crest near SDSU. RELATED: Check traffic nearby“SDFD has many firefighters on the ground as well as air resources on this fire. Please avoid the area if possible,” the department said in a tweet. The fire also forced MTS to miss several stops during the fire including it's College and Alvarado stop, College and SDSU stop and SDSU Transit Center stop. Update: The fire is now contained, and no SDSU buildings are at risk of fire.Villa Alvarado remains evacuated at this time.
