Tenants of two dozens units at the La Privada Apartments are being evicted suddenly after management discovered rain damage. When it rains, it pours, especially for Poway resident, Allan Moore. "We have a week left," Moore said. "We have to be out by the 15th."Right in the middle of last week's city-wide water boil advisory, he and tenants in 23 other units at the La Privada Apartments were surprised with an eviction notice. It said they must leave the premises and turn in their keys by December 15, 2019. Moore said management explained that the same set of storms that destroyed the city's water system caused the water damage to the units. According to the notice, Moore will get his security deposit, December, and part of November's, rent paid back."I'm very clueless about it right now," Moore said. "And I haven't had hardly any communication."According to law experts, people in Moore's situation do have rights. Laws state that the landlord or property manager must give "reasonable" time for tenants to move out. The specifics of that time frame are in the provisions of the leasing agreement. In Moore's case, the property manager or tenant has the right to terminate a leasing contract if repairs are expected to take longer than 60 days. In this case, management company, Capital Growth Properties, states the repairs could take up to six months. How much assistance the landlord gives, such as finding new or temporary housing, is up to the property manager. Experts told 10News, in some cases, if the management companies own other properties, they may relocate tenants into unaffected, open units. However, Moore says he has not heard of this option from Capital Growth Properties. The rest, such as additional living expenses and food during the inconvenience, is up to their renter's insurance. In the meantime, Moore's house is a mess. "Christmas has kind of been put on hold," Moore sighed. A nutcracker and one sad set of lights are the only signs of the holidays in the usually festive home. "We're just going to have to take it down before Christmas, so we're like, 'let's just stop decorating,'" Moore said. Moore just hopes they find a place soon before they get kicked out. Wade debate isn't all about the Supreme Court.“Enough lower courts have not decided what they think about this,” said Carol Sanger, a professor at the Columbia law school. “We, the Supreme Court, doesn't like to lead on a particular issue until the lower courts who have trials and so on have thought about it.”Under a conservative majority, the Supreme Court has ruled on an abortion case. Conservative Chief Justice John Roberts sided with a ruling that kept abortion clinics open by not requiring abortion doctors to have nearby hospital admitting privileges.The high court already ruled on a similar case out of Texas.“There is a special doctrine called stare decisis, which means when you have a case and it’s like a previous case, look to that previous case and say how did that come out,” said Sanger. “And unless there is a very, very strong reason to change that decision, you follow precedent, you follow what happened the last time this issue came up.”Sanger says enough lower courts have to rule and be split on the decision to make it to the Supreme Court.The Supreme Court would need to decide it wants to take up Roe v. Wade before courts before them. PORTER RANCH (CNS) - A 7,552-acre brush fire continued to burn in the northern San Fernando Valley Saturday after damaging or destroying 31 structures, forcing about 100,000 people from their homes and creating dangerously unhealthy air quality over a huge chunk of the Southland.The Saddleridge Fire, which officials said was 19% contained as of Saturday morning, burned in the areas of Sylmar, Granada Hills and Porter Ranch.Ralph Terrazas, chief of the Los Angeles Fire Department, said 13 structures were destroyed, while the rest suffered varying degrees of damage.One person, described only as a man in his 50s, died of a heart attack Friday morning in the Porter Ranch area, according to the LAFD. Terrazas said the man was actually speaking to firefighters when he went into cardiac arrest, and he died at a hospital. According to reports from the scene, the man had been working to protect his home from the blaze.One firefighter suffered a minor eye injury, according to the LAFD.Humidity levels remained in the single digits Saturday, prompting an extension of a red flag warning until 6 p.m. Santa Ana wind levels were gusting lighter at 20 to 30 mph and could reach as high as 40 mph in the afternoon, according to the National Weather Service.A smoke advisory was issued by the South Coast Air Quality Management District through at least Sunday morning for the entire San Fernando Valley, areas west of central Los Angeles, and coastal areas west of the 110 Freeway.
