SAN DIEGO (KGTV) - A San Diego County public defense attorney is accused of providing a felon with a firearm, according to local law enforcement.  San Diego Police confirm that Andrea Bayer was arrested on August 1 and booked into Las Colinas women’s jail on charges related to selling, supplying or delivering a firearm to either a convicted felon or someone wanted on a felony warrant. She was released the same day on bond.  On the State Bar of California’s website, it shows that the 37 year-old’s license is still active and that she works as an Alternate Public Defender for San Diego County. The District Attorney’s Office says Bayer has not been charged and the case remains under review. A Group Communications Officer with San Diego County sent us the following statement: “The County of San Diego cannot comment on personnel matters. SAN DIEGO (KGTV) -- A measure that would increase San Diego's hotel tax is heading to the ballot on March 3 and a recent poll shows how San Diegans feel about Measure C. Measure C would increase San Diego’s hotel visitor tax from 10.5 percent to 11.75, 12.75 and 13.75 percent depending on hotel location through at least 2061.The money would go toward expanding the convention center, funding homelessness programs and fixing San Diego roads. According to the “Yes on C” campaign, the measure would create 7 million for homeless programs in the first five years of the initiative. The campaign also says the measure would create 7,000 jobs. The measure also includes criminal penalties if politicians misuse the funds, according to the campaign. A new poll shows how San Diegans are feeling about the measure. The measure requires two-thirds supermajority to pass. A 10News-San Diego Union-Tribune poll shows that, as of February, 61 percent support the measure while 21 percent are opposed and 18 percent are undecided. “A majority of San Diegans are uniting behind Measure C because it is straight forward in its approach to tackling the city’s most pressing issues with a tax on tourists, not San Diegans," said Greg Block, a spokesman for the Measure C campaign. "People already know Measure C will help with homelessness, street repair and job creation by expanding of the Convention Center."Michael McConnell, an advocate for the homeless, is leading the opposition and warns the measure has “loopholes and risks.”"They are hiding up to Billion in bonds with no guarantee that money will be spent the right way," he said in a statement. SAN DIEGO (KGTV) — A proposal to create a police oversight commission in San Diego took a step forward Tuesday.The San Diego City Council voted unanimously to begin meeting with the San Diego Police Officers Association, a key legal step along the path to the November ballot.A group called Women Occupy San Diego has been pushing for years to change the city's current Community Review Board on Police Practices, which a 2018 Grand Jury report concluded lacked oversight. That Grand Jury noted the community review board does not have subpoena power and that San Diego Police personnel can sit in on what are supposed to be closed-door deliberations."It's not independent of the mayor, it does not have its own investigative powers," Attorney Genevieve Jones-Wright said at a rally outside City Hall before the Tuesday vote. And the City Attorney is the same attorney for the police department," said Andrea St. Julian, who authored the proposal submitted to the city. SAN DIEGO (KGTV) — A recent bout with the flu nearly turned deadly for a San Carlos man when it took an unexpected turn.Five weeks ago, the usually healthy 58-year-old Dave Truby came down with the flu."Fever, nausea, inability to sleep ... body soreness," said Dave's brother, Mike.Mike his brother says Dave tried to fight through it. Some five days later, Dave went to an ER, but left because of the wait for beds. That same night at home, his brother found him in bad shape."Literally shaking in a fetal position," said Mike Truby.At the hospital, Mike received some devastating news. His brother's kidneys were failing, and the MRI showed brain damage from a massive stroke. "The brain wasn't getting clean blood. It was shutting down. The whole body was shutting down. They said it didn't look good," said Mike.Loved ones and friends braced for the worst."I said my prayers and breathed deep," he said.Those prayers were answered in gradual fashion. His kidneys started working and Dave started responding."The last two weeks, he moved his head, blinked, and mouthed words. Wheeled my mom into the hospital room a week ago, and he looked up and mouthed, 'Mom.' Gives us a lot of hope," he said. "You never think the flu is going to impact your life in a possibly terminal way."Much of his prognosis remains uncertain, but Mike is optimistic, though he's still a bit in shock over how this came about.Two recent studies suggest the flu can trigger strokes and lead to a prolonged risk lasting months. In Dave's case, he will survive his stroke. "Very thankful and very grateful. My brother has always been a stubborn, forceful man ...
