SAN DIEGO (CNS) - The San Diego City Council on Monday will honor area residents who assisted victims in the Las Vegas mass shooting that left 58 concert-goers dead and hundreds of others wounded.Councilwoman Lorie Zapf plans to introduce a proclamation declaring "Las Vegas Unsung Heroes Recognition Day" in San Diego.In it, she calls the Oct. 1 shooting at a country music festival "one of the most horrific events in American history" and lauds Taylor Winston, Jenn Lewis, Officer Max Verduzco, Officer Tom McGrath and his wife, Tiffany.RELATED: Brother of Las Vegas shooting victim Jennifer Irvine urges educator-only pension to divest in gunsShe said Winston -- an ex-Marine living in Ocean Beach -- and Lewis, his girlfriend, found a truck with its keys in the ignition and used it to rush about two dozen shooting victims to a hospital.Verduzco knocked over a fence, allowing the crowd to escape the scene, according to Zapf. Tom McGrath treated numerous gunshot victims on the concert grounds.The two cops were among more than a dozen SDPD officers at the festival, along with seven San Diego firefighters.RELATED: San Diego attorney among victims of Las Vegas concert shooting"Many national news outlets and social media outlets have shared these local citizens' stories and hail them as heroes," Zapf says in her proposed proclamation. "They humbly accept this praise, but they are quick to recognize the many unsung heroes who also stepped up to the plate to help their fellow concert-goers to safety."A spokeswoman for Zapf said the five named in the proclamation all plan to attend the event at a City Council meeting.The gunman, 64-year-old Stephen Paddock, opened fire from the 32nd floor of the Mandalay Bay Resort and Casino into the crowd at the Route 91 Harvest Country Music Festival during a performance by Jason Aldean. "And we were trying to lay her down. ... And while we were tying to get (security personnel's) attention and tending to her, the second round of (gunfire) came on, and I remember I just grabbed my wife ... and I just pulled her close to me, and I laid on top of her, and I tried putting her on top of the (wounded) girl, and still everybody had their hands on top of mine."He said he helped Tiffany and others scale a fence, climbed over himself and realized he'd become separated from his wife. SAN DIEGO (CNS) - Testimony wrapped up Friday in the trial of a North Carolina man accused of raping and murdering a 79-year-old woman in her Normal Heights home more than three decades ago.Kevin Thomas Ford, 63, is charged with murder and a special- circumstance allegation of murder during a rape in connection with the May 20, 1987, death of Grace Hayden.Ford is accused of strangling the victim. Last year, investigators with the District Attorney's Office's identified Ford as a suspect through DNA evidence, prosecutors say, as well as a single fingerprint he allegedly left on Hayden's stovetop.RELATED: April trial date set for man accused in 1987 rape, murder of San Diego womanTrial testimony indicated that Ford's fingerprint did not yield results on a San Diego County database, but when submitted to a national database, a match was found in connection with Ford's 2015 arrest in North Carolina for making criminal threats.He was subsequently arrested in the summer of 2018.His murder trial began earlier this week at the downtown San Diego courthouse. SAN DIEGO (CNS) - The California Supreme Court ruled this week that a San Diego court must re-examine its decision to allow a criminal defendant to subpoena Facebook to obtain private social media posts and messages he alleged would help him in his defense.The ruling issued Thursday laid out a series of factors for the trial court to consider when weighing whether to allow the defendant to gain access to his alleged victim's restricted posts and private messages.The ruling stems from the criminal case of Lance Touchstone, a Northern California man charged with attempted murder for allegedly shooting his sister's boyfriend in Ocean Beach in 2016.Touchstone sought to obtain information from the victim's Facebook posts that the defendant alleged would show his accuser was a violent person, bolstering a self-defense claim.A San Diego Superior Court judge ruled in Touchstone's favor and ordered Facebook to release the information, leading to subsequent appeals.In an opinion authored by Chief Justice Tani G. Cantil-Sakauye, she wrote that the trial court should consider a list of seven factors to consider when deciding whether good cause has been shown to grant the subpoena.These "Alhambra factors" include whether the defendant has shown a "plausible justification" for acquiring the information and whether acquiring the material violates a third party's confidentiality or privacy rights, among others.While the state Supreme Court declined to make its own determination on the subpoena's viability, it ruled for the trial court to re-examine the subpoena issue in light of these factors.Touchstone's attempted murder trial in San Diego remains pending for a date still to be determined, as courts remain closed to the public and jury trials have been delayed indefinitely due to the COVID-19 pandemic. 1826

  

SAN DIEGO (CNS) - The San Diego County Board of Supervisors voted Tuesday to extend a moratorium on evictions for both residents and small businesses for another month, in response to the ongoing coronavirus pandemic.Supervisor Nathan Fletcher, along with board Chairman Greg Cox, made the request, which was unanimously approved. The board first approved an eviction moratorium in late March."By extending the moratorium, we are giving families and business owners another tool to assist in their recovery from the pandemic," Fletcher said. "The Board of Supervisors did the right thing today."Cox said: "This is not an effort to provide free rent. It's really an encouragement for tenants, landlords, to work together on a payment plan."Fletcher added that people who qualify for the moratorium have to prove economic hardship caused by the pandemic.Supervisor Kristin Gaspar said the San Diego Association of Realtors recently sent letter to the county and city of San Diego in support of a rental assistance program.Gaspar asked Chief Administrative Officer Helen Robbins-Meyer if the county can create its own rental assistance program, saying property owners use the rental payments they receive to meet their own bills and employ others."I don't think any of us imaged this pandemic would go on so long," she said. "I think ignoring one entire population and favoring the other isn't exactly the right thing to do at this point."It could be months, she added, before property owners could receive any rent payments.During the public comment period, David Garcias, president of the Service Employees International Union Local 221, said the pandemic-related economic crisis "shows no signs of coming to an end, (and) we believe you should extend protections to citizens." 1784

  

SAN DIEGO (CNS) - Playgrounds in San Diego County can reopen to the public Wednesday, despite initially being closed under COVID-19 restrictions, after state health officials reversed course.Assemblywoman Lorena Gonzalez, D-San Diego, led a group of a dozen legislators who sent a letter to Gov. Gavin Newsom last week urging him to remove playgrounds from the stay-at-home order. They claimed opening playgrounds "is necessary for the mental and physical health of children to have opportunities to expend their physical energy and play." They also noted that in some low-income neighborhoods, "families may have little to no outdoor space of their own available."Newsom and the California Department of Public Health revised statewide public health guidelines on Wednesday to allow for public playgrounds to remain open."Every parent knows how important playgrounds are for our youngest Californians," Gonzalez said. "A huge thank you to Governor Newsom for hearing our collective concern and rethinking how we can open play structures for our kids."Playgrounds were closed earlier in the pandemic before being reopened in September. Then, with a spike in case rates and the state's issuance of a regional stay-at-home order, which took effect late Sunday night across all of Southern California, playgrounds closed again.Pressure from parents and legislators have now caused the state to reopen the playgrounds.According to the state's website, "playgrounds may remain open to facilitate physically distanced personal health and wellness through outdoor exercise. Playgrounds located on schools that remain open for in-person instruction, and not accessible by the general public, may remain open and must follow guidance for schools and school-based programs."San Diego County Supervisor Jim Desmond made a motion at the Board of Supervisors meeting Tuesday to defy the state order and not enforce the playground closure. It was rejected 3-2.Supervisor Nathan Fletcher said his conversation with state officials proved productive, and gave credit to Gonzales -- his wife -- for her work."Kids in San Diego County can now enjoy local playgrounds. This is something that can be done safely and make the lives of families easier," Fletcher said. "My conversations with California Governor Gavin Newsom and Secretary Dr. Mark Ghaly worked, and I appreciate their partnership on this adjustment.""Thank you to everyone who worked cooperatively with the state, to bring about this adjustment, our collective efforts made a difference, special shout out to my wife, supermom, Assemblywoman Lorena Gonzalez," he said. 2621
