SAN DIEGO (KGTV) - A couple who evacuated from the Woolsey Fire in Los Angeles says their Airbnb hosts kicked them out of their unit and cleaned out all their belongings, forcing them to live with relatives in San Diego.Ben and Jessica Wells said they rented out the Airbnb unit in July, paying in advance through May.The newlywed couple had been living there as they searched for a home to buy.It was a studio apartment located in West Hills, a community on the western edge of the San Fernando Valley, which backed up to where the Woolsey Fire was burning.“I could see the fire burning on the hill. I saw the smoke,” said Ben, who got an evacuation alert on his phone while at the gym.He went home to meet his wife, frantically packing up some important belongings.“We were not trying to check out of the place at all. Obviously things were a mess, clothes were everywhere. We were just trying to basically make sure we had everything we needed just in case everything burnt,” said Jessica. After they left, the Airbnb hosts contacted them to see if they could go inside the unit and turn off the lights. Ben said he agreed to let them in for that purpose. But once inside, owners Larry and Jeri Hannah said they were shocked by what they saw.“I don’t even know how they were living there,” said Larry. “We couldn’t believe the mess we saw.”In addition to the clothes scattered about, the Hannah’s say the grout on the tile floor in the bathroom had been stained black. They said the walls needed painting and some of the flooring needed to be replaced.“When It became obvious that we weren’t going to let them come back then we just decided we were going to clean it up because we didn’t want to leave it like that,” said Larry. In order to do that, they removed all of the Wells’ belongings and told them the rest of their reservation had been canceled. The Wells’ said they agreed to pay through the end of November if they could keep their stuff there. But when Ben arrived on November 17th he said he was surprised to see their belongings strewn across the property.Expensive recording equipment had been left outside, he said. Other belongings had been thrown in trash bags. Some appeared to be missing.“At that point I was in shock, just completely shaken,” said Ben.He grabbed what he could find, not knowing that more of their belongings had been stored in a shed on the property.“Their stuff is all still here,” said Larry. In a statement, a spokesperson with Airbnb wrote ““We are urgently investigating this incident to better understand what happened. There have been more than 400 million guest arrivals in Airbnb listings to date and negative incidents are extremely rare.”  2699

SAN DIEGO (CNS) - The San Diego-based owners and operators of the conservative One America News Network filed a million defamation lawsuit Monday against MSNBC and political commentator Rachel Maddow for saying on air the network ``really literally is paid Russian propaganda.'' The lawsuit filed in San Diego federal court by Herring Networks Inc., owners of the One America News Network -- or OAN -- calls Maddow's on-air statements ``utterly and completely false'' because OAN ``is wholly financed by the Herrings, an American family'' and ``has never been paid or received a penny from Russia or the Russian government.'' Maddow and MSNBC could not immediately be reached for comment. Maddow made the statements during a July 22 segment of her show, in which she cited a Daily Beast article stating that an OAN on-air reporter was ``on the payroll for the Kremlin.'' Herring Networks' court papers say the reporter, Kristian Rouz, is originally from the Ukraine and started his journalism career by writing articles for Sputnik News, which is affiliated with the Russian government. According to Herring Networks, Rouz was merely a freelancer for Sputnik who selected his own article topics for submission, and his work there had no significance toward his work for OAN. OAN demanded a retraction of Maddow's statement, according to the suit, which says that an attorney for NBC Universal refuted that Maddow's use of the word ``literally'' was not simply a figure of speech. The Herrings' attorney, Skip Miller, said in a statement that ``One America is wholly owned by the Herring family in San Diego,'' who he called ``as American as apple pie.'' Regarding Maddow's statements, Miller said, ``This is a false and malicious libel, and they're going to answer for it in a court of law.'' The suit also accuses Comcast, which owns MSNBC, of refusing to carry OAN on its cable service ``because it counters the liberal message of MSNBC,'' an act the plaintiffs call ``blatant censorship.'' 2004

SAN DIEGO (KGTV) - A federal judge has ordered the San Diego Police Department to stop citing people for living in their vehicles. The decision comes after a lawsuit was filed against the city by a group of homeless people and their advocates. On Tuesday, United States District Judge Anthony Battaglia agreed with the plaintiff’s argument that the city’s municipal code was too vague in defining what constitutes habitation of a vehicle.Tristia Bauman, an attorney with the National Law Center on Homelessness & Poverty which helped work on the case told 10News, “we are very happy and pleased that the judge understood what we were arguing.”However, that was only one half of the lawsuit. The other half targeted the city’s municipal ordinance that outlaws RV parking from 2-6a.m. Known as the Nighttime RV Ordinance, or Oversized Vehicle Ordinance (OVO), the judge denied the request to enjoin it, saying the same argument did not apply. In the decision, Battaglia wrote “while the court sympathies that this Ordinance leaves Plaintiffs with nowhere to park between these hours and is decidedly unfair, the law is not ambiguous, unclear or vague in any way.”A spokesperson for city attorney Mara Elliot declined to comment beyond saying they “will review the ruling and advise our client.”An early neutral evaluation conference had been scheduled for Thursday with all the parties. Bauman said it could result in a settlement or go back to the court for a final ruling. 1486
