SAN DIEGO (CNS) - A man accused of opening fire inside a Poway synagogue, killing a woman and injuring three other people, pleaded not guilty today to more than 100 federal hate crime charges alleging he acted out of hatred toward the Jewish and Muslim communities.John T. Earnest, 19, is accused not only of the synagogue shooting but also of an earlier arson fire at an Escondido mosque. He is being charged by both federal and state prosecutors and faces a possible death sentence in both cases. Neither office has made a decision regarding whether they will pursue the death penalty.Earnest, of Rancho Penasquitos, is accused of carrying out the shooting at Chabad of Poway on April 27 -- the last day of Passover -- killing Lori Gilbert Kaye, 60, who was shot twice in the synagogue's foyer and died at a hospital.The congregation's rabbi, Yisroel Goldstein, 57, lost an index finger in the shooting. Two other people -- Almog Peretz, 34, and his 8-year-old niece, Noya Dahan -- were also injured.Earnest is also accused of setting a March 24 fire at an Escondido mosque -- a crime to which Earnest allegedly confessed in an online manifesto he posted prior to the synagogue shooting.Following his initial appearance Tuesday afternoon, he's slated to return to court May 28 for a preliminary hearing. He remains held without bail.He was charged last Thursday with 109 federal hate crimes: -- 54 counts of obstruction of free exercise of religious beliefs using a dangerous weapon, resulting in death, bodily injury and attempts to kill; -- 54 counts of hate crimes stemming from the synagogue shooting in violation of the Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act; and -- one count of damage to religious property by use of fire.Each of the 54 hate crime and obstruction of free exercise of religious beliefs counts apply to a person who was inside the synagogue during the shooting, Brewer said. SAN DIEGO (CNS) - An ex-con accused of abducting and sexually assaulting a woman in two separate locations before letting her out of his truck in Logan Heights pleaded not guilty today to felony charges, including rape and sexual penetration by force.Phillip Terrel McLeod, 47, who has a criminal record that includes a similar kidnapping case from 2002, faces 160 years to life in prison if convicted, said Deputy District Attorney Patrick Espinoza, McLeod was ordered held on million bail.The prosecutor said the 27-year-old alleged victim in the current case was initially attacked on Delta Street near Balboa Elementary School about 11:30 p.m. on Dec. 20.Espinoza alleged that McLeod pulled up and threatened to use a Taser on the woman, then forced her into his white pickup truck and drove her to an area near 39th Street and Broadway in Mount Hope, where she was sexually assaulted.The prosecutor said the victim fought back and McLeod drove her to Logan Heights, where he allegedly tried to rape her again. The victim pleaded with McLeod to let her go, and he did so near 32nd Street and National Avenue, Espinoza said.McLeod -- who is also charged with kidnapping for rape, attempted rape, assault with intent to commit rape, assault by means likely to produce great bodily injury and a misdemeanor count of resisting an officer -- was arrested Dec. 29.He will be back in court Jan. 15 for a readiness conference and the following day for a preliminary hearing. 1481

SAN DIEGO (CNS) - Authorities today publicly identified a U.S. Border Patrol agent who fatally shot a Mexican national last month during a scuffle just north of the international line in San Ysidro.Ryan Gonsalves, a nine-year member of the federal agency who is assigned to its Imperial Beach station, opened fire on 30-year-old David Angel Villalobos-Baldovinos early on the evening of Oct. 23 near Las Americas Premium Outlets mall on Camino De La Plaza, according to the San Diego Police Department.The events that led to the deadly gunfire began about 5:45 p.m., when Villalobos-Baldovinos allegedly tried to enter the United States illegally and was confronted by Gonsalves, SDPD Lt. Andra Brown said.When the agent tried to detain Villalobos-Baldovinos, a struggle broke out. During the fracas, the lawman shot the suspect once in the upper body.Gonsalves suffered minor injuries during the fight, Brown said. The SDPD Homicide Unit was called in to investigate the case, as is standard protocol in all instances of law enforcement shootings in the city.The findings of the probe will subsequently be reviewed by the U.S. Attorney's office, the lieutenant said. 1175

SAN DIEGO (CNS) - Eight people were selected to serve on the county's Independent Redistricting Commission, in a random drawing during today's San Diego County Board of Supervisors meeting.Commissioners will redraw boundaries for the county's five supervisorial districts by December 2021, based on new federal census numbers.Those chosen to serve are David Bame, Colleen Brown, Amy Caterina, Chris Chen, Sonia Diaz, Barbara Hansen, Arvid Larson and John Russ.Bame lives in District 1; Russ lives in District 2; Caterina is in District 3; Diaz, Hansen and Larson live in District 4; and Brown and Chen live in District 5.The redistricting process happens every 10 years. Andrew Potter, clerk of the Board of Supervisors, said the commission will have 14 members with the appropriate skills, and also reflect the county's political diversity.Using a raffle roll cage, Potter and two colleagues drew names from a pool of 59 qualified applicants. Nearly 300 people applied to serve on the volunteer commission.The commission will meet later this month, and choose six more members out of 51 qualified applicants. There must be a full commission seated by Dec. 31, according the county.The commission must hold at least seven public hearings, and at least one must take place in each supervisorial district.
