SAN DIEGO (KGTV) - On Monday, San Diego City Attorney Mara Elliott announced that the courts officially ordered the closure of a notorious independent living facility home off Ewing Street in the College Area, following a lawsuit brought by the City last November.“The circumstances were egregious,” Elliott told ABC 10News on Monday. She said the facility is no longer allowed to operate anywhere in San Diego County.“It was filthy. There were bed bugs. There were roaches. The air quality was not good,” she added. Officers had reportedly been called out nearly 300 times for issues like disturbing the peace and suicide threats.Now, the facility’s manager, operator and owners are ordered to pay a collective 7,000 in fines and restitution for victims.Eric Ching represents the homeowners who claim they had no idea the property was being used as an independent living facility. “They’re in Hong Kong. They’re elderly…they own this property [and] have a property manager that was supposed to manage this property. They were unaware of this problem until last year,” he told ABC 10News.Generally, independent living facilities provide the most vulnerable people with a last chance for housing before becoming homeless. This house had ten people living inside using disability checks to pay rent of up to ,000 a month.Elliott said the closure was part of a bigger crackdown. “It is one of our biggest objectives at the City Attorney's Office. We feel like we're the office that can stand up for the little guy…the most vulnerable [person] who otherwise would have nobody else to call,” she added.Elliott said that the facility’s operator, Mark Rogers, is charged with elder abuse and threats in a separate criminal case, which is still unresolved in the courts.ABC 10 News reached out to the attorneys for the other parties involved and are waiting for replies. 1875

SAN DIEGO (KGTV) -- More victims have come forward, saying their financial advisor stole thousands of dollars in an alleged Ponzi scheme."He preyed on the elderly folks," said San Diego resident, Brian Taylor. Brian and his wife Sharon have been married for more than 50 years. Brian, a Navy veteran, said this is not how they planned to spend their retirement. "We enjoyed our lives. We don't enjoy our lives anymore," Brian said. Christopher Dougherty was their neighbor. Sharon said they knew their family well and often met for parties or gatherings over the years. They stated investing with Dougherty in the early 2000s. A few years ago, they moved money into his company C & N Wealth Management. The Taylors said Dougherty told them they were investing in tax-free municipal bonds. They learned later that was not true. "It was actually invested in heavy equipment," Brian said. "I couldn't believe it." They said it was all done without their knowledge. The couple learned about this just this past October. "He said, don't worry, you're getting your money back and we didn't know that was the day after he filed bankruptcy," Sharon said. The Taylors are the third couple Team 10 has interviewed regarding this alleged Ponzi scheme. Sharon and David Vega said Dougherty stole about ,000 from them. That money was meant to help their grandchildren when they go to college. "We have not received any funds back," Sharon Vega told Team 10.Diane and Jerry, who declined to use their last name, said Dougherty took more than million dollars from them, meant for their retirement. "We can't even afford a burial plot at this point," Jerry said. Late Tuesday afternoon, the Sheriff's Department confirmed a criminal investigation into Christopher Dougherty with at least 30 potential victims. Bankruptcy attorney Larissa Lazarus is with the Law Offices of Mark Miller. Their firm represents 11 people in the Dougherty bankruptcy case. "They are all just good, really kind people who unfortunately trusted someone who was a licensed financial advisor and wasn't actually looking out for their best interest." She said she could not say whether or not it was elder financial abuse, but Lazarus said Dougherty was "doing things he was not supposed to be doing as a licensed financial advisor." In 2011, Dougherty was charged with a felony for taking thousands of dollars from a youth sports league. He ended up pleading guilty to a misdemeanor and was sentenced to three years summary probation. Records from the Department of Insurance showed that Dougherty "took somewhere between ,000 and ,000 from the League's bank account" when he sered as volunteer treasurer. In a letter dated April 19, 2012, Dougherty wrote to the Department: ".. due to extreme financial hardship and personal issues, I suffered a lapse in judgment that was fortunately resolved within a short period of time due to my efforts." "If he gets away with it, he's going to continue doing it and we don't want anybody else to have to go through what we've gone through," Sharon Taylor said. 3085

SAN DIEGO (KGTV) -- Opponents of  San Diego's new short-term rental regulations are accusing the city council of violating the Brown Act when it passed the new rules earlier this month. A letter drafted by an attorney on behalf of Air B and B, Home Away and Share San Diego was sent to the council Monday. It alleges the council violated the law when it made significant changes to the original proposal up for approval and then voted without allowing for more public comment. What they passed would essentially ban people from renting out anything other than their primary residence or a guesthouse on their property. The opponents are asking the council to hold another hearing. The city council is scheduled to hear a second reading of the short-term rental regulations Wednesday, August 1.  852

SAN DIEGO (KGTV) — Padres all-star pitcher Kirby Yates will be out of his comfort zone Sunday night when he and his wife, Ashlee, host a night of stand-up comedy. The event will raise money and awareness for a cause very close to the Yates' heart: Epilepsy.One night in 2018, the couple was asleep when Kirby heard Ashlee begin making strange sounds. It went from that to a seizure. She was pregnant with their second child at the time."It's the first time I'd ever been involved in anything like that," Yates told 10News. "It's hard to see your wife, she's pregnant with our son, and you have feelings that you've never had before.""He was definitely terrified," Ashlee said. "I obviously don't remember it, but I just know he had a very hard time with that."After a myriad of tests, Ashlee was shocked to be diagnosed with epilepsy. "I didn't know it was random and can come at any time or age," she recalls.When searching for ways to cope with the diagnosis, Ashlee turned to one of her favorite things: Stand-up comedy. She had performed at clubs before, but began integrating humor about her condition into her act. "That was actually my outlet. As soon as this happened, that was the first thing I did. I was like, I need to do something drastic to deal with this and I don't know what those options are," Ashlee said. "I like to make people laugh. I like to have fun, so this seemed like a good fit."That led to the decision to host "Comedy for a Cause", which will take place Sunday night at the American Comedy Co. in the Gaslamp. Ashlee will perform with two other well-known San Diego comedians. Kirby and several of the biggest Padres stars will be in the crowd. They also will likely be the biggest targets for the comics' humor, "I know they're big Padres fans, so I'm sure they've been following the season and have some good jokes," Ashlee said. "I did suggest a roast on Kirby.""I told them they can roast me as much as they want and it's fine," Kirby responded.
