SAN DIEGO (KGTV) — A 20-year-old woman claims she was sexually assaulted for about 20 minutes during a Lyft ride in June.She's identified as Jane Roe in a civil lawsuit filed by Estey & Bomberger, LLP on Thursday. Roe tells 10News she has a disability and is unable to drive, she relies on Lyft to get to and from UCSD and around San Diego on a daily basis."I would use Lyft every day for about a year and a half," said Roe. "I would use it about 2-3 times a day."In June, Roe says she was using Lyft to travel from her father's home to her mother's, a 32-minute ride on the Interstate 5 that would forever change her life.RELATED: San Diego women reported in Uber, Lyft sex assault cases"He just asked me inappropriate questions," Roe said, referring to her driver. "He was commenting about inappropriate behaviors that he likes to do."Roe said the driver then told her to sit in the front passenger's seat, and out of fear she complied."The man.. he started touching me.. he groped my vagina, he groped my inner thighs, my thighs, my hamstrings," Roe said. She said the assault lasted between 15 and 20 minutes."I was kind of in a state of shock," Roe said. But Roe and her attorney, Mike Bomberger, say Lyft has been unresponsive."One of the things we don't know is what happened to the driver," Bomberger said.Roe and Bomberger allege that Lyft is not doing enough to keep passengers safe."Lyft fails to cooperate with police when there's an assault. Lyft tries to silence victims from when they report these assaults and Lyft has the technology to prevent these assaults from happening and they don't use it," Bomberger said.RELATED: San Diego City Council votes to ban electric scooters from boardwalksRoe says she's going through therapy and hoping to recover from the traumatic experience, but says she wants safety improvements in every vehicle, like an emergency button or recording device."I don't want anyone to go through this again, I don't want anyone to feel like this, and I don't want him to be able to have a young girl in his car again," Roe said.The Lyft driver has been named in the complaint, but 10News is not naming him because he has not been charged with a crime.In a statement to 10News, Lyft said, in part, that they "recognize the risks that women face and are working to build safety into every aspect of their work."Lyft would not comment as to whether the driver was still driving for the company. 2620

SAN DIEGO (KGTV) - A chlorine spill that prompted evacuations in University City was contained Monday evening. 30 gallons of chlorine spilled in the pump room of the Lawrence Family Jewish Community Center's Friedenburg Pool about 3:30 p.m. on Executive Drive at Regents Road, according to the San Diego Fire-Rescue Department. Just after 4 p.m., the department said about 40 children were sheltered in place while crews developed a plan to mitigate the situation. The location is near corporate offices and housing, including UC San Diego's Mesa Residential Apartments.No injuries were reported.Chlorine spill contained to 30 gallons at the JCC pool. No injuries. SAN DIEGO (KGTV) - A bluff that overlooks Beacon’s Beach in Encinitas is on the brink of collapsing, which could mean changes for the walking trail that leads visitors down to the beach. The City of Encinitas says the bluff is at risk. There is a low-lying failure and the bluff could fall, taking the walking trail with it.“We’ve been told by our experts that there is a chance that the slide could happen at any time,”says Brenda Wisneski, Developmental Services Director for the City of Encinitas. Visitors at Beacon’s Beach say they feel the walking trail makes the beach different from others. “It’s one of my favorite beaches in all of San Diego. A part of that is because of the access, this trail is highly unique and it's not stairs,” says Mark Tayer. The city has a proposal to add a staircase south of the entry to the trail.“That is the most safe, the most secure. It requires a minimal amount of stability at the base of it,” says Wisneski.Wisneski says the city also has plans to move the parking lot back from the failure area. This could mean fewer parking spaces for visitors. The city hopes to begin construction in the fall of 2019. The proposal will go to the planning commission next. The trail will stay there until it poses a safety issue to visitors. On Wednesday, the City of Encinitas will have an open house where members of the community can voice their concerns. San Diego (KGTV) -- A 41-year-old woman suffered serious injuries Monday night when she was hit by an SUV while crossing the street in Pacific Beach.Police say the collision happened shortly before 10:40 p.m. on Grand Avenue west of Mission Bay Drive.A 24-year-old woman was driving a 2018 Jeep Cherokee eastbound of Grand Avenue while the victim was crossing the street southbound, then stepped off the center median and was struck by the Jeep. Paramedics took the victim to Scripps La Jolla Hospital with major injuries. She is expected to survive.The driver remained at the scene. 591
