OCEANSIDE, Calif. (KGTV) — Oceanside Police Chief Frank McCoy wrote a letter to Oceanside residents saying he was concerned after watching a video of one of his officers tasing a man to the ground. The letter comes after the department released body camera footage, just two days after the incident. Chief McCoy has since asked the Professional Standards Unit to review the case.A man topples to the ground after being tased by an Oceanside police officer. On Tuesday afternoon, officers learned about a man armed with a knife, punching, stabbing, and attempting to carjack several people in the Mesa Margarita neighborhood. When officers arrived, they found the suspect, David Avila.In the video released on the department's twitter page, you can see two perspectives of the incident. One was from the body camera of the officer who deployed his taser. The other was a cell phone video, shot by a citizen.During a heated altercation, the video shows Avila with his hands up, kicking what looks to be a knife towards the officer in front of him. At the same time, the officer switches to his less-lethal option, the taser."Stay back. Stay back! Down on your knees!" the officer yelled.Avila then takes two steps toward the officer, stops, and is then shot by a taser.Two days after the incident, McCoy not only released the footage but said in a statement, "I have had the opportunity to review this video and it has raised concerns to me."Retired San Diego Police lethal force instructor, Ray Shay, says it could be that the officer tased the suspect who already had his hands up, from the front. Under the department's Policy and Procedures Manual, it states:"A TASER should be aimed at a suspect's upper torso and, when tactically possible, should be aimed at the suspect's back. This provides a larger target and avoids possible injury to a suspect's eyes. (Revised 07/01)"However, Shay believes this was justified."With the taser to the front, and then lethal option behind him, and the bean bag option to the left, in this challenging circumstance, the officers did the best they can do to safely take the suspect into custody," Shay said.Barry Pollard, formerly with the San Diego Citizens Advisory Board on Police Community Relations, says what bothered him was what happened as officers subdued Avila."You would think, in these days, nobody's knee would come close to the neck are," Pollard said. "It looked like a reaction is what it looked like, then he caught himself and moved his knee."However, Pollard says because the knee was not directly on the neck, he does not see this as a blatant violation.ABC 10News reached out to Oceanside Police to see exactly what parts of the video concerned the Chief. On November 13, 2015, terrorists burst into the Bataclan concert hall and several restaurants across Paris, killing at least 130 and wounding hundreds more. Concertgoers and diners were raked by high-powered AK-47s, a cheaper, more primitive cousin of America's popular weapon of choice, the AR-15.Most of these weapons came from Germany and neighboring Belgium -- the bulk of them purchased via internet and mail orders originating in Eastern Europe and the Balkans.None of them was purchased in France, where authorities?have implemented some of the strictest laws and regulations in Europe. And while the black market certainly poses a threat to gun control, it's also clear that France's laws have made significant strides in counteracting many of the dangers created by guns.In France, there is no preordained right to bear arms, absent rigid registration and surveillance of their use. So most modern attacks, excluding terrorist incidents involving weapons obtained from abroad, are undertaken by trucks, cars and even knives.In other words, mass shootings are not the norm in France. And the United States would benefit from closely examining French gun laws in order to reduce the risk of another mass shooting within its own borders.That said, the tradition of gun ownership is deeply embedded in many strata of French society. In the countryside, hunting is a way of life and leisure -- more prevalent than?golf or tennis as weekend recreation. In regions like Sologne, some of the great families of France have practiced hunting back to the Middle Ages. La chasse (the hunt) is the preferred weekend pastime.While gun ownership is allowed, the state takes great pains to make sure guns are not abused. For example, authorities do not make gun ownership easy. Firearms are divided into four categories. In Category A are real weapons of war. As is in the United States, the French can't own a tank or a fighter plane, nor any fully automatic weapon like an Uzi or a Kalashnikov. No exceptions.Category B includes any firearm with a barrel shorter than 18.5 inches and a removable magazine with capacity larger than three rounds. For these, you need a sports shooting license, which means active membership in a shooting club, presenting yourself at a firing range at least three times a year, and visiting a physician annually for a physical and mental certification that you are capable of owning a firearm.The procedure and all accompanying paperwork?must be presented every three years. In between, this license can be revoked in an instant by the local police. When this licensing went into effect several years back, anyone who did not want to go through all the steps had simply to turn in their weapons. As many as 500,000 were relinquished.Category C is a bit easier and includes most regular hunting weapons limited to three rounds. But each such arm -- pistol or long gun -- must be registered, its owner carrying a sports shooting or hunting license. For the latter, the owner must undertake a full day of exams on theory and practice covering safety, protected species, even dog breeds.And in none of these categories can such a weapon routinely be carried ready to fire. It must be locked and disassembled during transport to the shooting range or property where it's to be used for hunting.Finally, Category D includes lightly regulated items, such as pellet and paintball guns, pepper spray and deactivated, display weapons.These categories stem from the reality that the French people really don't like to be massacred, and the statistics support that. The total number of guns -- licit and illicit -- in private hands in France dropped from 19 million in 2006 to 10 million in 2016. The number of guns owned per 100 people plunged from 31.2 in 2006, when gun laws were suddenly tightened in France, to 14.96 in 2016. By contrast, the number of guns per 100 people in the United States is 101.05. In fact, France?isn't even in the top 10 for per capita gun ownership, a list with America as No. 1.Of course, France hardly exists in a vacuum and Europe recognizes that. With its porous borders, a transnational approach is needed. The EU Firearms Directive establishes the same four categories of weapons as used by the French. After that, it's up to the individual country to tighten restrictions further.Some have, but many -- particularly in the old regions of Eastern Europe -- have not. The reality is that a Kalashnikov or a rocket launcher can be bought for as little?as 0 to 0 in some countries of the EU, according to Europol, the European Union's law enforcement agency. It is then up to individual countries to keep them from getting into their country and especially into the wrong hands.France has been among those at the forefront of the efforts to stop both the import and circulation of these weapons. And the mandate clearly begins at the top. French President Emanuel Macron recognized that reality, and has moved to sharply expand stop-and-arrest powers of the police, further tightening the removal of weapons from all individuals on terrorism watch lists. "We're sizing up the situation," said?Macron's Interior Minister Gérard Collomb, "and taking the weapons away."The French, years after gun laws have been tightened, appear to still support gun control measures. One of the first things Richard Phillips did when a judge finally declared him a free man is go on a grocery run. He was amazed to discover how many varieties of orange juice are on sale.It's just one of many revelations Phillips is dealing with these days after 45 years in prison for a crime he didn't commit.Phillips was exonerated earlier this week after a judge threw out his murder conviction. When he went in, the Detroit man was 27. He turns 72 next month.The time he served behind bars makes Phillips the nation's longest serving exoneree in history, says the Innocence Clinic at University of Michigan law school."The world has changed, a lot of people have changed," Phillips told CNN on Thursday. "I have a lot of adjustments to make."The crime for which he was chargedPhillips was an auto worker in Detroit when a man named Gregory Harris was dragged from his car and shot to death in June 1971.Based on the testimony of the victim's brother-in-law, police arrested Phillips. The brother-in-law told investigators he'd met up with Phillips and another man, Richard Polombo, at a bar to discuss Harris' murder.Phillips and Polombo were convicted. And in October 1972, Phillips was sentenced to life in prison without the possibility of parole.The break in the caseYears went by. Phillips' contention that he was innocent fell on deaf ears.Then, in 2010. Polombo said he lied. He told a parole board that he killed Harris along with the brother-in-law; Phillips had nothing to do with it. In fact, Polombo said, he didn't even know Phillips.But Phillips wasn't made aware of this exculpatory evidence until four more years.In 2014, someone tipped off the Innocence Clinic, an organization that investigates prisoner claims of innocence.After speaking with both Polombo and Phillips, the clinic took up his cause -- and began working quickly to get him a new trial.The long legal roadAfter years in and out of court and court of appeals, Phillips was finally granted a new trial late last year."When he first got his new trial, prosecutors dangled a carrot," Phillip's attorney Gabi Silver told CNN. "They said if he agreed to a plea deal, he could get out faster."Phillips refused."He told me, 'I will die in prison before I agree to a plea deal.'"On December 14, a judge overturned his murder conviction, making him the first person to be exonerated by the Wayne County Prosecuting Attorney's new Conviction Integrity Unit.But he had to wait until Wednesday to become a free man permanently.That day, Phillips -- wearing a blue suit and a big smile -- listened as prosecutors dismissed all charges against him."The system failed him. There's no question about it," Wayne County Prosecutor Kym Worthy told reporters. "Justice is indeed being done today."What lies aheadMichigan adopted the Wrongful Imprisonment Compensation Act in 2016, which grants ,000 for every year that a person has been wrongfully imprisoned. This makes Phillips eligible to receive up to ,250,000.Silver, Phillip's attorney, told CNN that she was "hopeful and very confident" that he would receive full compensation."The most difficult part of my journey since being freed has been that I do not have financial assistance from the state," Phillips said. "Exonerees do not get very much compensation from the State of Michigan."Phillips says he has been living off worth of food stamps each month since December."He's a very smart man," Silver said. "He's made some friends. He's living in an apartment with a friend. He wants to get his driver's license. He's very artistic."Despite his struggles, however, Phillips remains optimistic."I am not bitter," he told CNN. "I was upset at first, but mistakes happen in this world. No life is perfect. Everybody has problems. It would be unimaginable for me to be upset because I had problems, because everybody has them."Phillips spoke at length about his amazement at new technology."When I left the streets, if there were any phones at all, they were these big boot-like portable phones," Phillips laughed. "It would look like you had a big shoe up to the side of your face. We didn't have all these gadgets. iPhones didn't exist."When Phillips was convicted, he left behind a wife and two children, ages 4 and 2. He hasn't had contact with them since and hopes to reconnect soon."I have not seen my children in 45 years," Phillips said. "I hope that they will see my story in the news and come find me."In the meantime, Phillips is enjoying life outside of the prison walls."I'm so happy to be free, I'll make any adjustment I have to make," Phillips said.
