SAN DIEGO (CNS) - A San Diego-based telemarketer was fined nearly million by the Federal Communications Commission Wednesday for making more than 47,000 robocalls over a two-day period leveling false accusations against a local state Assembly candidate and manipulating caller ID information to appear as though a competitor was making the calls.Kenneth Moser and his company, Marketing Support Systems, were fined ,997,750 for making the calls on May 30 and May 31, 2018, about one week prior to the primary election, in which Philip Graham unsuccessfully sought to represent the 76th Assembly District.Shortly before the primary, a woman accused Graham of kissing her against her will in an Encinitas bar, triggering a sheriff's department investigation that concluded the claim was unfounded. Nichole Burgan, the woman at the heart of the allegation, later pleaded guilty to filing a false report.According to the FCC, the robocall messages repeated Burgan's claim and caller ID information was manipulated to make the calls appear as though they originated from another telemarketing company, HomeyTel, described as a competitor to Moser's company. As a result, HomeyTel received "a multitude of angry complaints" from people who received the calls, as well as a cease-and-desist letter from Graham, according to the FCC.The agency said 47,610 robocalls were made during the two-day period, with multiple calls sometimes sent to the same recipients.The calls violated the Truth in Caller ID Act prohibiting manipulation of caller ID information -- otherwise known as spoofing -- with the intent to defraud, cause harm or wrongfully obtain anything of value, according to the FCC. 1697
SAN DIEGO (CNS) - Four local restaurants and gyms are suing the state and county over its coronavirus restrictions as a shutdown of indoor operations takes effect for many county businesses.The lawsuit was filed Thursday in San Diego Superior Court on behalf of Cowboy Star Restaurant and Butcher Shop, Home & Away Encinitas, Fit Athletic Club and Bear Republic.The suit comes as San Diego County is slated to shut down indoor operations for nonessential businesses at midnight Saturday due to its recent entry into the most restrictive, purple tier of the state's coronavirus reopening plan.The businesses allege that San Diego's increased case numbers are not a result of exposures at restaurants, gyms and other types of businesses that will be impacted by the impending closures. The lawsuit cites recent figures indicating restaurants/bars, retail businesses, places of worship, schools and gyms make up a small percentage of confirmed community outbreaks.San Diego County Public Health Officer Dr. Wilma Wooten recently submitted an adjudication request to the state seeking to have San Diego County remain in the red tier. The request was rejected by the state last week.``Penalizing the impacted sectors for case increases is wrong, as these sectors continue to do the right things, while trying to weather the ongoing pandemic and the back forth of reopenings,'' Wooten's request states.The businesses allege in their complaint that they may be forced to shut down permanently if the shutdown is not averted. SAN DIEGO (CNS) -- Low-income San Diegans who have experienced financial hardships due to the COVID-19 pandemic can begin applying Monday for one-time emergency financial help to pay their rent.The program, which the San Diego Housing Commission is administering for the city, will provide up to ,000 per household to help eligible families and individuals pay past-due and upcoming rent.Online applications will be accepted through Aug. 7. Payments are expected to be made beginning in mid-August and continuing through September and potentially into October."San Diego's rental assistance program will directly assist individuals and families struggling to make rent and help recover the financial loss of landlords," said City Councilman Chris Ward, who proposed San Diego's COVID-19 Emergency Rental Assistance Program. "We have protected our unsheltered. We have supported our small businesses. Now we must meet our obligations to the renters of this city."The council voted 9-0 on June 30 to authorize the expenditure of .1 million in federal Coronavirus Aid, Relief, and Economic Security Act funds for the emergency rental assistance program.The public can apply for the program at covidapplication.sdhc.org."The launch of this online application is a crucial first step to help provide this essential financial assistance as soon as possible to San Diego households struggling because of COVID-19," San Diego Housing Commission President and CEO Richard C. Gentry said.Around 3,500 households could receive emergency rental assistance through the program, if all households received the maximum of ,000. SDHC staff will coordinate with selected applicants and their landlord or property management company to disburse payments. All payments will be made directly to the landlord or property management company by direct deposit.To be eligible for the program, households must have a San Diego address; 60% or below of the area median income -- ,200 per year for a family of four; must not be receiving any rental subsidies; must not be a tenant of a property owned or managed by SDHC, must not have savings with which they can meet the rent; have eligible immigration status; and have experienced hardship related to the pandemic.All applicants who meet the eligibility requirements will have the opportunity to be selected to receive assistance. Priority will be given to families with minor children and households with at least one person age 62 or older. Applications will be sorted and assigned numbers at random to identify the applicants who will receive help to pay their rent.To apply, tenants need to have their landlord's name, email address, mailing address and phone number. Applicants are also required to upload and submit supporting documents such as a driver's license, most recent lease agreement, current utility bill, documentation of household income and documentation demonstrating loss of income or increase in medical expenses due to COVID-19.SDHC will be partnering with community-based organizations, which will assist with community outreach and will be available to help eligible households complete the online application.Philanthropic donations also are encouraged to support the program. SAN DIEGO (CNS) - Circulate San Diego released a report today detailing how cities in southern San Diego County can make progress toward eliminating traffic deaths.The report outlined ways in which Imperial Beach, National City, Chula Vista and Coronado can prevent fatal traffic accidents by making improvements to the cities' most dangerous intersections and roadways.Circulate San Diego suggested the cities should take steps to calm traffic flows like restriping roadways to narrow them and reduce speeds. Circulate also recommended that the highlighted cities should asses driving behaviors that lead to serious injury and fatal car accidents and work with local law enforcement officers to target those behaviors through education and traffic law enforcement."Every city has room for improvement to make streets safe and we look forward to working with each South County city to save lives,'' said Maya Rosas, co-author of the study and the organization's director of policy.The report is part of the organization's participation in the Vision Zero campaign, which aims to eliminate fatal traffic accidents altogether. Circulate San Diego and the city of San Diego have already set a goal of eliminating traffic deaths in the city by 2025.The organization made similar recommendations to the city of San Diego last year and the city subsequently repaired its 15 most dangerous intersections. SAN DIEGO (CNS) - A San Diego judge's ruling today clears the way for the proposed Plaza de Panama project in Balboa Park to proceed.San Diego Superior Court Judge Gregory W. Pollack ruled both the project's proposed bond funding mechanism and an agreement of cooperation with the Plaza de Panama Committee to be legal, allowing the city to proceed with the plan to reduce traffic congestion in the park, according to the city attorney's office.San Diegans for Open Government argued that the city should have allowed voters to decide whether the city should rely on million in bonds to help fund the project.The City Council approved the project by a 7-1 vote in 2012, but six years of challenges and litigation stalled its implementation.The project will limit vehicle access and improve parking in order to restore the Plaza de California and Plaza de Panama as dedicated pedestrian areas."Balboa Park truly is the jewel of San Diego, and I am excited that the city can finally move forward with its plans to revitalize the Park for the enjoyment of San Diegans and tourists alike," City Attorney Mara W. Elliott said after the ruling.The Plaza de Panama project will also include improvements to more than six acres of park space and improved park access. The city will select contractors through a competitive bidding process and plans to break ground on the project as soon as next spring. 1407
