SAN DIEGO (KGTV) - The Supreme Court ruled Wednesday in favor of providing employers the option to opt out of providing free birth control to their staff, based on religious beliefs.The 7-2 vote was polarizing."It's a huge win for religion," Pastor Andy Ballon said."We are extremely disappointed," Planned Parenthood Affiliates of California’s President/CEO, Jodi Hicks said.Pastor Ballon said the vote is a victory because it allows people of faith the freedom to not do something they don't believe in. "We believe that life starts at conception, so we believe we should have the right to chose to not provide or not pay for these contraceptives."Ballon said women have options to access birth control outside their healthcare plan provided through work.One of those options is Planned Parenthood."We know what [the vote] means. It will have a devastating effect on women trying to plan how they want to live their lives quite frankly," Hicks said.She explained those plans could involve pursuing higher education or a career.Hicks said 5.5 million women in California could have to pay if their employers opt out. Hicks said that leaves minorities much more vulnerable, saying many can't afford birth control."We are planning on campaigning to encourage those companies still cover access to birth control for women," she said.Pastor Ballon said it's not a fight against women. "Women play an important role in my life and it's not about taking anybody's rights. It's about protecting the life in the belly of the woman."He said he has great respect for women.Hicks responded, "your religious choices can't impede on someone else's decisions to be healthy."The ruling rolls back 'Obamacare', but could be reversed in a future administration. 1753

SAN DIEGO (KGTV) - There's a sign inside Hillcrest's Industrial Grind Coffee that reads, "our first, funky little coffee shop opened in 2011 - not too far from where you're standing right now."It's a place that shaped barista Jennifer Bizjak."It's where I learned everything I know about coffee," she said.That original location is a third of a mile away, near the northwest corner of Park Boulevard and University Avenue. It's now shuttered, and untouched. It's part of a complex that includes small homes and mom-and-pop businesses - one owner said she's preparing to leave after 17 years.Real Estate investment group Diversyfund bought the complex in June for .65 million. It plans to replace it with an 80,000 square foot mixed-use building that includes 58 units, including 6 affordable apartments.Shayan Rajabi, an investment analyst for the group, said the new complex is designed with sensitivity to the neighborhood. He said it would bring more housing to a region with a sever under-supply, plus affordable units. He added the building would feature a coffee shop, or microbrew, that would complement the community."I think the scale of our building is comfortable as it adds density without overloading the area. It’s the kind of scale that they do in German cities, which are known to have very people-oriented building codes," he said. That development would be near the northwest corner of Park and University, where a recent city request is now leading to concerns of future overdevelopment.In February, a city planner asked the Uptown Community Planning Group to support rezoning a little more than an acre at the northwest corner of Park and University to allow more intense development than what is in the recently approved community plan.Board member Mat Wahlstrom said the planner gave very few specifics.  "He simply said that a stakeholder, which, I would assume is the property owner, approached us to see about having this done," Wahlstrom said.Rayabi said the Diversyfund project fits within current zoning and that the group did not ask or need a re-zone for the project.Peggy Shapiro, who owns the strip mall that's actually on the corner - which includes the Medical Center Pharmacy - also said she has no redevelopment plans. She added she was unaware of the proposed rezone.On Thursday, City spokesman Arian Collins said REAL Development submitted a rezone application for the properties at 3906 and 3922 Park Boulevard, to accommodate a 58-unit mixed use complex with affordable housing. He added that the application has since been changed for a foundation and podium, but no permits have been issued. Bizjak said she's concerned about extra development hurting Hillcrest's parking situation."I can't even imagine how far they want to go or how that would even make sense," she said.The Planning Commission is going to consider the rezone at its meeting March 15.  2966

SAN DIEGO (KGTV) - The San Diego City Council on Tuesday unanimously voted in favor of a proposal to purchase two city hotels and used them to help hundreds of homeless San Diegans.City leaders want to turn the Residence Inn hotels in Kearny Mesa and Mission Valley to be turned into permanent housing. The proposal was approved in a 9-0 vote.The hotels are price tagged at a combined 6.5 million. The hotels can house 400 people experiencing homelessness; residences of the properties would include people staying at the Convention Center as part of the Operation Shelter to Home, which started in April due to the coronavirus pandemic.Father Joe’s Villages will be providing services for the Kearny Mesa location, while People Assisting the Homeless (PATH) will provide services at the Mission Valley location. The services provided will include mental and behavioral health services, healthcare services, substance use services, and employment assistance.City leaders hope to get people moved in and the services running by the end of the year. 1058

  

SAN DIEGO (KGTV) - The San Diego Fire Marshall explained to 10News in an exclusive interview Wednesday why dozens of residents in a Little Italy apartment complex were trapped when a vandal flooded their stairwell.February 25th, around midnight residents heard the alarm go off, their only route of escape was to head to the stairs, but once they reached the bottom, they realized there was too much water to get out. When they climbed back up the stairs, they realized, they were locked in."It felt like a waterfall coming down on you," Resident Ryan Lange said."It was a freak accident," Fire Marshall Chief Doug Perry said the issue is the doors were supposed to unlock whenever an emergency alarm goes off. "When you're in an interior stair it's supposed to be openable from the egress side and ingress side without any special knowledge," Chief Perry said.Normally the locked hallway doors act as a way to protect residents from intruders. Chief Perry said the building management is being notified of the problem and given three options to fix it.Those are:-Install hardware on the doors so they unlock automatically when an alarm is triggered.-Install a button in the lobby so firefighters may unlock the doors during an emergency.-Install a phone on the 5th floor so anyone in the hallway can call a 24/7 service to unlock the doors remotely during an emergency.Chief Perry said the issue would've become apparent during their annual inspection, "we were right about the time frame where in the next two or three months we would've been in that building, we walk the whole building, check all the life safety stuff."So how did this fall through the cracks in the first place? The building's approved plans on file show the fire code was missed in the developing stages. "The onus is truly on the architect, because the arcitect is the design professional who knows these codes inside and out," Chief Perry said human error is always a concern.Thanks to Chief Perry, a fix is on the way or 1810 State Street. "Channel 10 should take credit for it because of the phone call that you made to me and got me involved with it," he said.If the building was one story taller it would have fallen under more strict codes and this would not have happened. SAN DIEGO (KGTV) - The U.S. Attorney's Office of Southern California announced charges Friday against a man in the death of a Camp Pendleton Marine who had an overdose in his barracks.The unidentified Corporal was found unresponsive on the floor near his computer chair on January 29, 2017. He was wearing headphones and appeared to have been playing video games, investigators said.An autopsy determined the Marine died of fentanyl toxicity. A pill found on the headboard near a powdery substance and a rolled-up dollar bill tested positive for fentanyl.A complaint unsealed Friday detailed drug charges against 25-year-old Kyle Shephard of San Marcos.Investigators said Shephard met the victim in November 2016 and sold him fentanyl and other drugs multiple times over three months.Shepard acknowledged the pills could lead to an overdose, according to the complaint.In December, Shephard was arrested and charged with possessing for distribution roughly 2,000 fentanyl pills.“What a senseless tragedy that another young life has been lost because of fentanyl,” said U.S. Attorney Adam Braverman. “This Marine was serving his country and had his whole life ahead of him. We are going to hold dealers accountable for the deaths that result from their reckless disregard for human life.”Shephard will be in court March 6 for a detention hearing.  1369
