BOSTON (AP) — Prosecutors dropped a case Wednesday accusing Kevin Spacey of groping a young man at a resort island bar in 2016, more than a week after the accuser refused to testify about a missing cellphone the defense says contains information that supports the actor's claims of innocence.Spacey was charged with indecent assault and battery last year in the only criminal case that has been brought against the actor since his career collapsed amid a slew of sexual misconduct allegations. The two-time Oscar winner was among the earliest and biggest names to be ensnared in the #MeToo movement against sexual assault and harassment that swept across the entertainment and other industries.Spacey denies groping the man, whose mother first went public with the allegations in 2017.A phone message seeking comment was left with Spacey's lawyer.The actor's accuser was ordered to take the stand earlier this month after he said he lost the cellphone he used the night of the alleged groping. The defense said it needed the phone to recover deleted text messages it says would help Spacey's case.The man denied deleting messages or manipulating screenshots of conversations he provided to investigators. But when he was pressed by the defense about whether he knew that altering evidence is a crime, he invoked his Fifth Amendment right against self-incrimination, and the judge said his testimony would be stricken from the record.The judge then questioned how prosecutors would be able to bring Spacey to trial if the accuser continued to refuse to testify, and prosecutors told the judge they needed time to decide how to proceed.On Wednesday, Cape and Island District Attorney Michael O'Keefe said in court documents that they were dropping the charge "due to an unavailability of the complaining witness."The hearing at which the accuser testified came days after the man abruptly dropped a lawsuit he had just recently filed against the actor that sought damages for "severe and permanent mental distress and emotional injuries." The suit was dismissed "with prejudice," meaning it cannot be refiled.The man did not receive a settlement to drop the civil case, his mother said. His lawyer said he dropped it because he was emotionally overwhelmed and wanted only "one roller coaster ride at a time" and so chose to focus on the criminal case.The man's mother, former Boston TV anchor Heather Unruh, alleged in 2017 that Spacey got her son drunk and sexually assaulted him at the Club Car, a bar on Nantucket where the teen worked as a busboy.The man told police he went over to talk to Spacey after his shift because he wanted to get a picture with the former "House of Cards" star. He said Spacey bought him several drinks and tried to persuade him to come home with him before unzipping the man's pants and groping him for about three minutes.Unruh's son told police he tried to move Spacey's hands, but the groping continued, and he didn't know what to do because he didn't want to get in trouble for drinking because he was underage. The man said he fled when Spacey went to the bathroom.Shortly after Spacey was charged, he posted a video on YouTube in the voice of his "House of Cards" character who was killed off after the sexual misconduct allegations emerged, saying "I'm certainly not going to pay the price for the thing I didn't do."Spacey has faced several other accusations.His first accuser, actor Anthony Rapp, said Spacey climbed on top of him on a bed when Rapp was 14 and Spacey 26. Now add helping homeless people while black to the list of things that can lead to a visit from police.Employees at a Safeway supermarket in Mountain View, California, called 911 on an African-American woman and her family because they suspected them of shoplifting, police said. Safeway has since apologized for what the store said was a misunderstanding.Erika Martin told CNN that the incident occurred when she stopped at the store last month to help a homeless man she knew hung out there. She gave him a bag of dog food and some treats for his pit bull. Her two sisters were also there and gave two men care packages with soap, toothpaste, hand sanitizer and other hygiene products."I help the homeless as much as I can. I see homeless people weekly and I try help them the best that I can," Martin said.Martin said her son, who's about to turn 10, and her nieces and nephews went into the store to see if the bakery was giving out free cookies and to get samples from the deli.Martin stayed outside and talked to her sisters and the man to whom she gave the dog food.She said a Safeway employee came out of the store, looked directly at her and rushed back inside, which she thought was strange.As Martin prepared to leave, two police cars drove up and one stopped behind her so she couldn't back out of her parking place. They asked why she was there and if she had any warrants, Martin said. She told them that she'd never even had a parking ticket.Mountain View Police spokeswoman Katie Nelson said that a Safeway employee called the police and to report a theft in progress. Five officers were dispatched to interview store employees and the Martin family."It was extremely clear to us that no one who had been identified was potentially involved in any sort of criminal activity, and we explicitly said as much to Safeway employees," Nelson said.One of the officers told Martin that Safeway had called the police because she matched the description of someone taking items from the store and said the suspect was wearing a spaghetti-strap shirt.Martin said she was wearing a short-sleeved T-shirt that said "Y'all need Jesus," and had not even gone into the store. Nelson said the description "somewhat matched" the top one of Martin's sisters was wearing.The employee told the police that the children were running back and forth to a car parked outside."During the initial dispatch call, a Safeway employee informed our dispatcher that both employees and customers believed a man and a woman as well as children were working together to try and take items from the store," Nelson said.Martin said the questioning scared her son and he started crying while talking to one of the officers.He told her that when the children asked for cookies the woman at the bakery counter told him that "We don't have anymore cookies to give to you," Martin said. He said they looked behind the counter and saw that there were cookies back there.The officer asked if they had taken any cookies and he said no."My son was crying so much, he was so scared because he thought he did something wrong. He thought the police were going to arrest him for looking behind the counter," she said. "To see my child in so much fear broke my heart."She said police let them go after about 30 minutes"In that short amount of time, we not only determined that no crime occurred, we explicitly told Safeway employees as such. None of the people Safeway identified in their call to us nor in their subsequent interview with us committed any crime whatsoever," Nelson said."We were very appreciative of the way the family allowed our officers to wrap up the call, and we apologized for inconveniencing their evening," she said.After one of Martin's sisters, Faith Martin-Ware, posted a video of the July 8 incident on Facebook, news outlets began picking up on the story.Martin said she and her sisters had shopped at that store three or four times a week but are not comfortable going back there now."We were there to do a good deed and we left feeling humiliated, embarrassed, hurt and shocked," she said.Safeway spokeswoman Wendy Gutshall said in a statement that employees called police because a man suspected of shoplifting there in the past was in the store."Safeway has reached out to Ms. Martin to sincerely apologize for the misunderstanding, and we look forward to continuing the discussion regarding her concerns. Body camera video released Friday shows YouTube shooter Nasim Aghdam telling Mountain View Police she had no plans for violence hours before she opened fire at the company's San Bruno headquarters.The police recording shows officers identify Aghdam’s car in a Walmart parking lot in Mountain View at about 1:30 a.m. PT on April 3. Less than 12 hours later, Aghdam would open fire in a courtyard at the YouTube campus, injuring three people before turning the gun on herself. Mountain View Police said the license plate showed Aghdam's vehicle was linked to a San Diego missing persons report filed by her family. The Mountain View Police Department (MVPD) said seven record systems were checked during this time, including the Armed and Prohibited Persons System (APPS). The APPS cross-references records of persons who lawfully purchased weapons with the records of those who are prohibited from owning them. The systems checks for Aghdam came back negative, police said.Two officers knocked on the window and woke up Aghdam, who had been sleeping in the back seat. During their conversation, officers asked Aghdam if she knew her family in San Diego had reported her missing.“We didn’t get along together so I left them,” Aghdam said. She explained that she didn’t get along with her father and drove straight to Mountain View from San Diego. Aghdam also said she went to Northern California to start fresh in a place without memories.Officers asked Aghdam if she was taking medication or needed to take medication. She shook her head, “no."During questioning, Aghdam also told officers that she didn’t want to hurt herself or anyone else, and had no plans to commit suicide.Shortly after the police body camera recording ended, one of the officers called Aghdam’s family in San Diego to report that she had been found. Her father, Ismail Aghdam, answered the phone and confirmed that he had not been getting along with his daughter, police said. He thanked officers for the call and hung up.One hour later, the father called Mountain View Police to let them know his daughter had recently become upset about changes on the YouTube platform that had impacted videos she had created on living a vegan lifestyle, police said. The father suggested that may have been one of the reasons Aghdam was in Mountain View.Scripps station KGTV in San Diego talked with Aghdam’s family at their home in Menifee the evening of April 3. They said that they tried to warn authorities before the shooting.The family said she felt she reached the most people through her YouTube page but her relationship with the company turned ugly when YouTube changed its filters and she began to lose followers and viewers."I Googled 'Mountain View' and it was close to YouTube headquarters, and she had a problem with YouTube," her brother said.
