SAN DIEGO (KGTV) - A North Park family is appealing for tips after a former high school football star - and recent college graduate - was injured in a drive-by shooting."They thought it was fireworks at first," said Dawn Kinder.Sisters Denisha Montgomery and Dawn Kinder say two Fridays ago, their brother Devante Kinder, 24, and three friends had spent a day at the beach and were driving up to his driveway near Meade Ave. around 9:40 p.m. Devante was at the wheel of the used Mercedes SUV he had saved up to purchase, when neighbors heard about nine shots ring out, and a car drive away. Devante was shot twice in the face."The only thing he could think of was to save his life, and he drove himself to the hospital," said Montgomery.Soon after, his sisters got the news."Unreal and didn't believe it at first actually. There is no way he could be injured in this way," said Montgomery.One of the bullet entered Devante's neck, shattered his cheekbone and lodged in his sinus cavity. The other one grazed his cheekbone."He's devastated ... asking himself why it was him," said Montgomery.His sisters say Devante does not have any enemies. Devante, a football standout at Mission Bay High School, went on to graduate from San Jose State six months ago. He returned home and recently got hired for engineering position in March."Starting his career, saving money. All he could talk about was buying his own condo," said Montgomery.Those plans have been put on pause by the drive-by shooting. Amid a national dialogue on racial injustice, Devante's sisters say they know many families impacted by violence."It's something that shouldn't be happening. We don't like to think it was the color of his skin. We don't want to," said Montgomery."But the thought is there as well," said Kinder.Devante remains on a feeding tube and faces a long road to recovery. A Gofundme campaign has been set up to help with expenses.Witnesses saw a newer-model black Ford Mustang driving from the scene. SAN DIEGO (KGTV) - A judge declared a mistrial Monday in the retrial of an undocumented immigrant accused of being the driver in a San Ysidro hit-and-run crash which seriously injured a young boy.Constantino Banda Acosta was charged with the crash on Camino de la Plaza May 6, 2017.Investigators said Banda ran a stop sign at Dairy Mart Rd. and crashed his pickup truck into the Lake family’s Honda Accord.6-year-old Lennox Lake was in a child safety seat at the back of the car. He suffered serious head injuries.Banda left the scene but was arrested about two miles away after Border Patrol agents spotted his damaged truck parked on a street, police said.RELATED: Retrial begins for undocumented immigrant in crashDuring Banda's first trial, his passenger, Jorge Adame Ariza, also an undocumented immigrant from Mexico, testified under a grant of immunity during the defendant's two-day preliminary hearing in June that he and Banda had a number of beers that night before the accident.Adame said Banda got into a fight with another man outside a Chula Vista restaurant. Adame told them he picked up Banda but later moved into the passenger seat with Banda behind the wheel during the crash.San Diego police Officer Michael Muniz testified in the first trial that Banda's blood-alcohol content measured .151 and .152 percent -- the legal limit is .08 -- during two breathalyzer tests.Federal immigration officials said Banda has been deported from the United States 17 times.Immigration and Customs Enforcement officials told 10News if Banda is not tried again (and effectively not convicted) he may or may not be deported.  ICE has requested that he be forwarded to the agency's custody upon any potential release. Banda's release will be subject to the Sheriff's Department under the California Sanctuary Law, ICE officials said. A judge will decide Friday whether a third trial will take place. 1938

SAN DIEGO (KGTV) -- A judge has ordered a man charged with attacking and stabbing two women to stand trial. A preliminary hearing was held Tuesday for Patrick Douglas, 51.Douglas is charged with two counts of attempted murder in connection with two stabbings in El Cajon and La Mesa on the same day.Police in La Mesa said a female Frito Lay delivery driver, later identified as 35-year-old Dina Hammond, staggered into a 7-Eleven where she had just made a delivery after being stabbed several times.RELATED: Pursuit suspect arrested for pair of stabbings in La Mesa, El Cajon?Hammond was rushed to the hospital in stable condition following the stabbing.Shortly after, Police in El Cajon received a call after a woman was found with stab wounds at a strip mall. The woman, later identified as Shawntey Palmer, was also in stable condition after being taken to the hospital.After the stabbings, Douglas led police on a chase after a Mercedes-Benz matching the description of his car was spotted.During the pursuit, Douglas reached speeds of more than 100 miles-per-hour before the car was found abandoned.Douglas was eventually located and arrested. 1161

  

SAN DIEGO (KGTV) - A local Naval officer is making a plea for tips after thieves made off with some priceless military heirlooms.On Tuesday, Gervy Alota's wife called him after she returned to their home on Linbrook Drive."Just completely ransacked my house...my heart sunk," said Alota.Since there were no clear signs of entry, Alota believes the thieves got in through the doggie door in the back of the home.Among the missing items were several dozen collectible Jordan sneakers and about 15 pieces of jewelry, including Alota's class ring from the Naval Academy.  He calls it a symbol of the start of his 20-year Navy career.  A class ring belonging to his wife - also a graduate - was also stolen. 720

  

SAN DIEGO (KGTV) - A San Carlos woman's trip to the San Carlos library turned into nightmare after she was bitten by a dog.A large bruise and two puncture marks remain stamped on Tricia Erler's left thigh."I was in total shock," said Erler.On Tuesday afternoon, she had just finished a mind-and-body class inside the library, grabbed some magazines, and was headed into a lounge area to read."I was behind this woman's chair, and she got up abruptly and swung around in one movement ... she sort of fell into me, and I fell into the books. I felt a stabbing pain in my leg. I thought something had stabbed me from her backpack," said Erler.RELATED: Service dog or pet? Hillcrest businesses take action against the fakes Erler limped to the front desk area and pulled up her pant leg. "You're in total disbelief. You're bleeding and there are teeth marks on your leg," said Erler.Nearby, she saw what bit her: a leashed white dog, possibly an Australian Shepard, with black markings on its head. Next to the dog was the woman who had bumped into her. She was in her 20s or 30s with a stocky build. RELATED: Fake service animals attacking peopleAccording to the librarian, the woman claimed she was going to go to her car to get the dog's information. The woman walked out and never came back."I was upset and shaking. You would think you'd be totally safe in a public library," said Erler.Erler just received her second of four shots for a rabies regimen. Back at the library, an animal policy is posted on the front door: only service animals allowed. RELATED: Dog attack traumatizes Normal Heights neighbors"This proves we need better regulations. Definitely feel dogs should be checked," said Erler.Under federal law, dog owners can be asked if the animal is a service dog, but can't be asked for documentation. A city spokesperson says their policy is to ask every animal that enters a library. In this case, officials say staff did ask and the woman confirmed it was a service animal.Anyone with information on the case is asked to call the San Diego Humane Society at 619-299-7012. 2097
