SAN DIEGO (CNS) - A San Diego federal judge has again denied a Chula Vista church's request to challenge the state's COVID-19-related restrictions on indoor worship services.South Bay United Pentecostal Church, which lost a challenge to the restrictions earlier this year when the case went before the U.S. Supreme Court, filed an amended complaint this summer in its ongoing lawsuit arguing that California's restrictions on indoor services and singing are unconstitutional.U.S. District Judge Cynthia Bashant, who denied the church's request for a preliminary injunction in May, also denied South Bay United's latest request in a written order signed Wednesday.Bashant echoed much of her previous reasoning in denying the church's request, though South Bay United's latest complaint and her ruling took into account the shifting state of the virus locally.South Bay United argued in court papers that the state's "scientific pronouncements" are "largely baseless," as by "all reasonable scientific measurements," the COVID-19 health emergency "has ended."Bashant disagreed with the church's assessment of the current picture, and wrote that limitations to indoor worship attendance do not restrict one's ability to attend religious gatherings, as long as they are held outdoors.The judge wrote that the current COVID-19 situation in San Diego County holds that worship services may be held outdoors, with singing and chanting permitted. Indoor worship is limited to 100 people or 25% of building capacity -- whichever is fewer -- with singing and chanting prohibited.The church has argued that outdoor worship and services held over video-conferencing are "inadequate substitutes" and that the public health orders prohibit the church "from holding the services mandated by scripture."It also argued that California arbitrarily allowed certain sectors considered essential to stay open and conduct indoor operations, while discriminating against religious institutions.Bashant disagreed that public health officials have shown a pattern of discriminatory enforcement of COVID-19 health orders against religious institutions.She wrote that through Aug. 26, the county served 10 cease-and-desist orders or compliance letters to businesses or other entities, three of which were places of worship.Additionally, she wrote that through Aug. 26, 144 citations were issued for health order violations, none of which were to places of worship or people engaged in religious services. 2485

SAN DIEGO (CNS) - A stabbing at a College Area bus stop left a man badly injured Friday, authorities reported.The 50-year-old victim was waiting for a bus in the 6900 block of El Cajon Boulevard when the assailant approached and began arguing with him shortly before 11:30 a.m., according to San Diego police.The quarrel ended when the stranger pulled a knife and stabbed the other man in the arm, then fled on foot, Officer Tony Martinez said.Patrol personnel applied a tourniquet to the victim's bleeding arm and performed CPR on him prior to the arrival of paramedics, who took him to a hospital for treatment of serious but apparently non-life-threatening trauma.Witnesses reported that the assailant -- described as a heavyset, heavily tattooed man in his 20s or 30s, wearing a red shirt and black bandana- style mask -- left the area eastbound and appeared to enter a nearby motel, police said. SAN DIEGO (CNS) - Father Joe's Villages and Connections Housing Downtown will accommodate nearly 300 additional homeless residents on Christmas Eve due to forecasted overnight rain, the San Diego Housing Commission announced Monday. The commission activates the Inclement Weather Shelter Program when temperatures drop below 50 degrees, the chance of rain is higher than 40 percent or in the case of sustained high winds. The program is a partnership between the commission, the city of San Diego, Father Joe's and Connections Housing. The commission also funds the program. Father Joe's can shelter an additional 250 residents throughout the night while Connections Housing can add up to 30 residents. Check-in at Father Joe's begins at 4 p.m. and residents are expected to check out by 5 a.m. the next morning. Check-in at Connections Housing runs from 5:30 p.m. to 7 p.m. and residents are expected to check out by 7 a.m. the next morning. Those at both shelters will have meals provided to them. SAN DIEGO (CNS) - Jurors reached a verdict Tuesday in the trial of a Navy SEAL accused of fatally stabbing a wounded teenage ISIS fighter in the neck, shooting at numerous Iraqi civilians and threatening fellow SEALs to keep them from reporting him.Jurors found Special Operations Chief Edward Gallagher not guilty on six out of seven charges, including not guilty verdicts for premeditated murder, two charges of attempted premeditated murder, obstruction of justice, retaliation, and willful discharge of a weapon. Jurors did find him guilty of wrongfully posing for a photo with the teen's body. That guilty charge carries a possible sentence up to four months. 673

  

SAN DIEGO (CNS) - A woman whose Nissan Versa ended up underneath a semi-truck on Interstate 8 in El Cajon Monday escaped serious injury and was arrested on suspicion of drunken driving, authorities said. Heidi Farst, 56, of El Cajon was driving westbound on I-8 near Main Street when her compact car was rear-ended by another vehicle just before 6 a.m. Farst's car then collided with the semi-truck, flipped over and landed upside down underneath the rig, California Highway Patrol Officer Travis Garrow said. Farst was freed from the wreckage and transported to Sharp Memorial Hospital for what were described as minor injuries, a CHP dispatcher said. She was then booked into the Las Colinas Detention Facility on suspicion of DUI, according to Garrow. No other injuries were reported. The crash triggered lane closures and a SigAlert. All lanes were reopened shortly after 8 a.m. 890
