In a victory for employers and the Trump administration, the Supreme Court on Monday said that employers could block employees from banding together as a class to fight legal disputes in employment arbitration agreements.Justice Neil Gorsuch delivered the opinion for the 5-4 majority, his first major opinion since joining the court last spring and a demonstration of how the Senate Republicans' move to keep liberal nominee Merrick Garland from being confirmed in 2016 has helped cement a conservative court."This is the Justice Gorsuch that I think most everyone expected," said Steve Vladeck, CNN contributor and professor of law at the University of Texas School of Law. "Not only is he endorsing the conservative justices' controversial approach to arbitration clauses, but he's taking it an important step further by extending that reasoning to employment agreements, as well."Justice Ruth Bader Ginsburg took the rare step of reading her dissent from the bench, calling the majority opinion in Epic Systems Corp. v. Lewis "egregiously wrong.""The court today holds enforceable these arm-twisted, take-it-or-leave-it contracts -- including the provisions requiring employees to litigate wage and hours claims only one-by-one. Federal labor law does not countenance such isolation of employees," she said.In the majority opinion, Gorsuch maintained the "decision does nothing to override" what Congress has done."Congress has instructed that arbitration agreements like those before us must be enforced as written," he said.As the dissent recognizes, the legislative policy embodied in the (National Labor Relations Act) is aimed at 'safeguard[ing], first and foremost, workers' rights to join unions and to engage in collective bargaining," he wrote. "Those rights stand every bit as strong today as they did yesterday."Gorusch, responding to Ginsburg's claim that the court's decision would resurrect so-called "yellow dog" contracts which barred an employee from joining a union, said that "like most apocalyptic warnings, this one proves a false alarm."The case was the biggest business case of the term, and represented a clash between employers who prefer to handle disputes through arbitration against employees who want to be able to band together to bring their challenges and not be required to sign class action bans.It also pitted two federal laws against each other.One, the National Labor Relations Act (NLRA), gives employees the right to self organization to "engage in concerted activities for the purpose of mutual aid or protection" the other, the 1925 Federal Arbitration Act (FAA) allows employers to "settle by arbitration."Lawyers for employers, who have long backed arbitration as a means of resolving disputes, argued that class action waivers are permissible under the 1925 law. They say the NLRA does not contain a congressional command precluding enforcement of the waivers.The Trump administration supported the employers in the case, a switch from the Obama administration's position.  3034

If you've been looking for a new kitchen appliance this year, locating certain models can be as tough as finding a new Xbox Series X or PlayStation 5.The appliance shortage that began in March shows no sign of letting up.Tommy Conougher is among the many frustrated shoppers. He needs more space in his refrigerator."This is one we've had since we built the house 17 years ago," he said.Like many families during this pandemic, he wants to stock up on frozen beef and chicken."We thought we would just invest in a freezer we would put in the garage, so we started to look."But finding a freezer was tougher than finding Nemo."We have been searching all summer long, nine months, for a freezer," Conougher told us in a Zoom interview from his kitchen."And even when the big box stores have their specials, they don't have them in stock."Many brands, price ranges affectedIt doesn't matter if you are looking for a freezer, refrigerator, range, oven, or washing machine.It also doesn't matter if your budget is 0 or ,000, or what brand you want (though American brands like Whirlpool and Maytag appear to be in better shape than European or Korean brands).You are going to find spot shortages just about everywhere, according to Ken Reiman, co-owner of an appliance distributor.He supplies builders and remodelers, who he says now have to delay finishing some projects due to ongoing shortages."When I check our vendor websites," he said, "they are just not available."He says the shortages that started when factories shut down for two months early in 2020 have not let up."For instance," Reiman explained, "they will give an estimated time of December 5, and December 6 comes around and they have moved to January."Why the shortage hasn't endedReiman says there are 3 reasons for the current shortages.Originally, it was factory shutdowns in March, April and May, along with delays getting appliances shipped from China during that time.The second reason is shortages of foreign-made parts, such as wiring harnesses and compressors, which forces U.S. factories to shut down their assembly lines until product arrives.The third reason is high demand, as people spend their vacation dollars this year on their kitchens instead, Reiman said.His suggestion: Be flexible on brand and model."We have products coming in," he said. "Our warehouses are more stuffed now than ever. In a sea of graduation caps, how do you stand out? Increasingly, students are decorating their caps to showcase some part of their life.UNLV professor and folklorist Sheila Bock began studying trends behind graduation caps after she first arrived in Las Vegas in 2011. She began formally researching in 2015, taking photos from around the country and interviewing students on their graduation cap design choices."So one category is one of celebration and optimism and looking into the future, 'I did this', 'the best is yet to come', which isn't that surprising because that's kinda the whole point of the graduation ceremony," Bock said.Some examples include "Today is a perfect day to start living your dreams" or "Adventure is out there." While Bock said many celebrate "education as this stepping stone towards people's own individualized version of pursuing the American Dream," she also found a lot of examples of people pushing back against that story, rather by "Game of Loans" referencing college loan debt or highlighting the less positive aspects of their college experience. "Family relationships, whether they have kids, whether they have been dealing with a brain tumor, this is a space where students or graduates are really trying to highlight 'I did this' and here are the struggles I had to go through in order to get to this moment," Bock said, also noting that some students use the caps as a memorial to family and friends they've lost. But one thing she has noticed in the past few years is the caps have started to take more of a lean toward the political. Bock noted that there has been a long tradition of political themes, dating back to the 1960s and caps decorated with peace signs in reference to the Vietnam War. "It's not to say people weren't doing it before but I'm seeing it happen as a more widespread practice. People are asserting overtly political messages, like Black Lives Matter," she said. "Or making references to language from the political landscape, 'nevertheless she persisted.' Or calling attention to specific identities that have recently become very politicized, immigrant identities."Hashtags on social media, such as #Immigrad and #Latinxgrad, also inspire others of similar identities to create their own caps, Bock said."They want to use this space of the graduation ceremony, this space of celebration, this space to recognize accomplishment, to make themselves visible," she said. "To make these marginalized identities visible and say I'm in this space, I belong in this space and I want to make myself known."But what about students who decide not to decorate their caps? "The main reason is that people feel this sense of formality to the ceremony that they would like to keep intact," Bock said. "Oftentimes, it's not necessarily that they see other people decorating their cap that they're doing something wrong. They're saying I don't have something to say badly enough to put it on a cap and kind of disrupt the formality of the occasion."The majority of the caps Bock and her student assistants have documented so far are from UNLV, along with some from Ohio State University, where Bock received her graduate degrees. Bock approached the university's Center for Folklore Studies to create a digital archive of her materials.Officially titled “Decorated Mortarboards: Forms and Meanings,” the project invites participation through surveys, interviews, and social media posts with #gradcaptraditions.Bock emphasized any graduate, no matter when or where they graduated, is welcome to share their caps.
