SAN DIEGO (KGTV) -- The United State Marine Corps is ordering the removal of the Confederate battle flag from public display and in work spaces aboard its installations, such as Camp Pendleton.The announcement was made late Friday night amid fiery protests across the country against racism and police killings."Today, the Marine Corps released guidance on the removal of public displays of the Confederate battle flag," read a post on USMC's official Twitter account.The order bans all depictions of the Confederate battle flag, including clothing, posters, mugs, bumper stickers, and the flag itself."Our history as a nation, and events like the violence in Charlottesville in 2017, highlight the divisiveness the use of the Confederate battle flag has had on our society," said USMC. "This presents a threat to our core values, unit cohesion, security, and good order and discipline."In 2017, white nationalists groups rallied against the proposed removal of a statue of Confederate soldier Robert E. Lee in Charlottesville. It was one of several controversial monuments targeted for removal following a massacre two years earlier in which a white supremacist gunned down nine black church members in Charleston. The rally saw violent clashes, including the death of a 32-year-old woman who was killed when a car rammed into a group of counter-protesters.USMC allows for the flag to be displayed in works of art, educational or historical displays depicting a Civil War battle where the flag is present but not the main focus of the work. It also does not ban the display of state flags and license plates which incorporate the Confederate battle flag."It is impossible to specify every possible exception that may apply. Commanders are expected to apply their best judgment informed by the spirit and intent of this maradmin," said USMC. "If a commander encounters questionable circumstances, the command staff judge advocate shall be contacted for legal review and advice." 1995

SAN DIEGO (KGTV) - The San Diego County District Attorney’s office released Friday a detailed report and video evidence in the death of a woman arrested by San Diego Police. Aleah Jenkins, 24, was arrested Nov. 27 on an outstanding warrant for meth possession during a traffic stop in University City. The video released at a news conference Friday shows Jenkins vomiting in the back of a patrol car. The officer initially called for medical aid but it was called off because Jenkins said her illness was due to pregnancy. That was not true, according to District Attorney Summer Stephan. There were several points when Jenkins yelled and asked for help in the back of the patrol car. Officers took Jenkins to SDPD headquarters downtown, where she collapsed. Jenkins was taken to UC San Diego Medical Center and died Dec. 6. A spokesperson for the Jenkins family said San Diego Police could have prevented Jenkins’ death by getting her help when she said she didn’t feel well.The autopsy indicated Jenkins had PCP, THC, morphine, and meth in her system, but no injuries which would have caused her death. District Attorney Summer Stephan said at a news conference Friday that no charges would be filed against the officer who arrested Jenkins after a careful review of the evidence. "I looked at the fact that at the period of time where he didn't get a prompt response he pulled over he pulled over and physically looked at her,” Stephan said. SAN DIEGO (KGTV) - The suspect in the shooting death of a man near the 24 Hour Fitness in the Midway area is an undocumented immigrant with a prior immigration violation, according to law enforcement sources.San Diego Police arrived at the rear parking lot of the gym at 3675 Midway Drive February 25 to find Alexander Mazin, 27, suffering from a gunshot wound to the torso. He died at the scene.After the shooting, officers surrounded an apartment at 30th St and Upas in North Park. The standoff ended hours later without an arrest.RELATED: Parents of Midway shooting victim describe son's life, violent murderLaw enforcement sources told 10News the suspect, Ernesto Castellanos Martinez, had a prior “voluntary departure” agreement which meant he had been asked to leave the country after an immigration conviction in 2004. He left, but eventually made it back into the U.S.Mazin’s family said Castellanos had previously been in a relationship with Mazin’s girlfriend of three months.Two weeks before the shooting, Castellanos had attacked the woman while she was working out with Mazin at a gym, Mazin’s parents said.RELATED: Police release pictures of Midway District homicide suspectTheir son’s death has galvanized their support for President Donald Trump’s plan to build a wall across the southern border.“I want President Trump to know about this,” Jeffrey Mazin told 10News. “I want him to be aware there was a true patriot, a wonderful human being that was an exemplary citizen that was lost because of this problem with our border.”But framing their son’s death as an immigration problem worries Dulce Garcia, an immigration attorney and an undocumented immigrant herself.She has protection from deportation through Deferred Action for Childhood Arrivals (DACA). To her, immigration status should be irrelevant in this case.“Someone is going to commit a crime whether they are undocumented here or not,” she argues.Garcia said her reason is that people like herself, who are otherwise law-abiding members of society, are put at higher risk for deportation when they get grouped in with criminal fugitives.“That’s the truly terrifying part for me because I don’t think that’s American. I don’t think we as a nation agree to paint any group based on what one person’s actions did,” said Garcia.Castellanos remains at large.
