SAN DIEGO (CNS) - A former San Diego High School teacher who sexually and physically assaulted an underage female student pleaded guilty to 11 felonies Tuesday, including lewd acts on a child and assault.Juan Carlos Herrera, 49, formerly a special needs curriculum instructor, is slated to be sentenced to 10 years in state prison next month for assaulting the unidentified victim "on almost a daily basis" between February 2018 and March of this year, when the girl was 15 and 16 years old, according to Deputy District Attorney Jessica Coto.His plea agreement includes lifetime registration as a sex offender and a strike offense for his plea to a dissuading a witness count for threatening the girl if she told anyone about what happened.RELATED: SDHS teacher accused of having sex with student represents himself in courtIn addition to the sexual assaults, Herrera threatened to cut the girl's arms and legs off if she told anyone what was going on, choked her and threw her on the ground, according to the prosecutor.The crimes occurred in his classroom, his car and at a hotel, prosecutors said.The prosecutor said the girl was a San Diego High School student, but is not a special needs student and was not one of Herrera's students."This case involves emotional manipulation by the defendant, who was verbally abusive and coercive towards the victim in this case, who was particularly vulnerable, as (Herrera) took advantage of information he knew about her background and used it to manipulate her," Coto said following his May arraignment.The investigation into Herrera began earlier this year, when the victim's mother reported finding suspicious and concerning text messages from Herrera on the girl's cellphone, SDPD Lt. SAN DIEGO -- A Los Angeles police officer pleaded not guilty Friday to smuggling two Mexican nationals in East San Diego County.Mambasse Koulabalo Patara was arrested at 1:30 a.m. Wednesday at the Campo Border Patrol Checkpoint, about 12 miles north of the U.S.-Mexico border.The court documents claim Patara told Border Patrol agents he was an off-duty officer and showed them his LAPD identification.Patara had two men inside his black Toyota Corolla and appeared to be very nervous, shaking and avoiding eye contact, the Border Patrol said.Agents seized Patara's service pistol from his waistband after he told them he was armed.Patara was taken into custody after authorities say two of the men inside the vehicle admitted they were not U.S. citizens.Fermin Lopez and his nephew, German Ramirez-Gonzalez, admitted to being citizens of Mexico.At his arraignment, Patara pleaded not guilty. SAN DIEGO (CNS) - A former La Jolla Country Day School teacher pleaded guilty Thursday to having sex with a 17-year-old female student and faces up to one year in local custody.An Oct. 21 sentencing date is scheduled for Jonathan Sammartino, 37, who also could face lifetime sex offender registration and be prohibited from teaching again at any school.San Diego County Superior Court Judge Charles G. Rogers, who took Sammartino's plea to a felony count of unlawful sexual intercourse with a minor, said he was "not inclined" to impose sex offender registration, but still might do so at the sentencing hearing.As part of the plea agreement, felony counts of oral copulation of a minor and digital penetration of a minor were dismissed.Sammartino, the son of U.S. District Judge Janis Sammartino, remains out of custody, pending the sentencing hearing.The victim, identified only as "Jane Doe" in court proceedings, testified earlier this year at Sammartino's preliminary hearing that the first sexual encounter happened in the early part of 2016, when he arrived at her home unannounced around midnight. She said she went outside to meet with him in his car, at which point he told her he didn't trust himself around her.Sexual encounters occurred that night in his car and on several other occasions in his vehicle and his house over the next few months, she testified.The victim, who went on to attend UC Berkeley, filed a report with campus police in the summer of 2018. Charges were filed later that year.In a recorded phone call played during the preliminary hearing, Sammartino admitted to the past encounters with the victim."Why did you do it? You knew I was 17," Doe says on the recording. "You knew I was your student. You knew it was my first time and I lost my virginity to you.""I don't have a good answer, because I wasn't thinking through what I was doing," he replied, apologizing to her several times throughout the call. "I can't believe that I did that."At the preliminary hearing, defense attorney Eugene Iredale unsuccessfully argued to have the charges reduced to misdemeanors, and introduced evidence regarding a 2015 bicycling accident in which Sammartino hit a pothole while riding in La Jolla and landed on his head. Sammartino was hospitalized and had to re-learn some functions before going back to the classroom, according to the defense attorney.Iredale argued that the brain injury affected his emotions and ability to make reasonable judgments, playing "a significant factor" in the commission of the charged acts.Rogers ruled against the defense request in January. Though he said he believed Sammartino had been affected by the injury and was unlikely to re- offend, he stated that the sexual nature of the defendant's relationship with the teen was entirely his idea."She wanted an emotional relationship with Dr. Sammartino. That is abundantly clear, and frankly, I think it's also clear that he wanted and needed an emotional relationship with her. But the sex was not her idea; the sex was his idea," Rogers said. "He was the grown-up and it was his responsibility not to do that." 3129

  

SAN DIEGO (CNS) - A 52-year-old man was struck and gravely injured Sunday in a San Diego trailer park, and the motorist who hit him in a stolen Hummer was arrested.The incident began just after 11:10 a.m. when the San Diego police received a call from Chula Vista police who were involved in the pursuit of the stolen Hummer, SDPD Lt. Andra Brown said.The Hummer was snatched from a RoadOne impound yard in Chula Vista, SDPD Lt. Bryan Brecht told the media.The vehicle initially crashed at a gas station at 1400 Melrose Ave. in Chula Vista, but continued evading police south on Interstate 5, exiting into a trailer park at 1600 Palm Ave., Brown said.Officers tried to stop the driver but he sped away and hit the pedestrian, Brown said. It appeared the collision was intentional, Brown added.The 44-year-old driver was eventually taken into custody with help from a K-9 dog deployed to stop him, Brown said. The driver was taken to a hospital for treatment of minor injuries before being taken into custody. His name was not immediately available.The victim suffered severe trauma and was unresponsive when paramedics transported him to a hospital, Brown said.Because of the severity of the pedestrian's injuries, the case was being investigated by the SDPD's homicide unit, she said.Anyone with information on this crash was asked to call the homicide unit at 619-531-2293 or Crime Stoppers at 888-580-8477. 1417

  

SAN DIEGO (AP) -- Smoke from the fire that ravaged a Navy warship in San Diego Bay contained elevated levels of toxins, but air-quality authorities say area residents have little to fear.The San Diego Union-Tribune says the local Air Pollution Control District found smoke from the USS Bonhomme Richard contained a dozen potentially harmful substances but they were at levels for which there are no known great health risks.The district issued the Navy a notice of violation for creating a public nuisance and contaminating the air.The Navy has yet to say whether the vessel will be repaired. 600
