SAN DIEGO (CNS) - An alleged drunken driver was going 121 mph when he caused a fiery freeway pileup that killed two men and seriously injured a woman on Interstate 15 last year, a prosecutor told jurors Tuesday, but a defense attorney claimed an off-duty San Diego police sergeant is actually to blame for the deaths.Jeffrey Brian Levi, 39, is charged with murder, gross vehicular manslaughter while intoxicated, hit-and-run and drunken driving, for the Jan. 2, 2018, deaths of 33-year-old Jesus David Dominguez and 19-year-old Isaac Felix, who were burned to death inside a Toyota Corolla that was struck at about 11:45 that night in the fast lane of northbound Interstate 15 near Miramar Road.Giovanna Dominguez -- Jesus Dominguez's sister and Felix's girlfriend - - was also a passenger in the Corolla. She survived but sustained broken bones and burns across her body.RELATED: Suspected drunk driver facing murder charge in fiery crash that killed twoDeputy District Attorney Andrew Aguilar told jurors in his opening statement of Levi's trial that the defendant rear-ended the Corolla, then walked away from the crash scene unscathed.The Corolla was left disabled in the fast lane with no lights on, its three occupants "sitting ducks" for an ensuing crash, Aguilar said.A short time later, a Ford Explorer driven by off-duty San Diego police Sgt. Raymond Rowe then struck the Corolla, which burst into flames and left Dominguez and Felix trapped inside the burning wreckage, while bystanders pulled Giovanna Dominguez out.The Ford Explorer overturned, coming to rest upside down, and Rowe was treated for minor to moderately serious injuries.Aguilar alleged that about three hours after the crash, Levi had a blood-alcohol content of 0.16%, which is twice the legal limit.Levi, who was charged with murder due to a 2007 misdemeanor DUI conviction, faces 40 years to life in prison if convicted.Defense attorney Amanda Waddle alleged that Rowe was "an unreasonable and negligent driver" who should be held liable for the deadly wreck. According to Waddle, Rowe was speeding, failed to wear his prescription glasses and was looking in his rearview mirror at the time of impact.Aguilar noted that Rowe often used his rearview mirror to spot anyone who might be trailing him from the police station to his home, a risk that Rowe potentially faced as a member of the department's gang unit.In addition to not paying attention, Waddle said that Rowe failed to use evasive maneuvers that were part of his police training."This was the direct result of that secondary, very violent crash where Sgt. Rowe was not paying attention to the roadway in front of him," Waddle said.The defense conceded that Levi was driving too fast in connection with the initial crash, but said "thankfully" there were no significant injuries as a result.Giovanna Dominguez -- who was expected to testify Wednesday -- did indicate during a preliminary hearing earlier this year that no one was injured as a result of the initial crash. SAN DIEGO (CNS) - A rare thunderstorm Friday night is expected to quickly give way to conditions ripe for wildfire by late Sunday, forecasters said.A storm system arrived Friday evening and unleashed heavy rain and lighting on the San Diego area, with precipitation amounting to a few tenths of an inch in most places.The National Weather Service predicted scattered showers to persist through Saturday night. By Sunday night, Santa Ana winds of 25-35 mph -- with isolated gusts up to 70 mph possible in some areas -- were expected to move in.Humidity was expected to drop rapidly to 5-10 percent on Monday as well, prompting the NWS to issue a fire weather watch for San Diego County, as well as Orange, Riverside and San Bernardino counties, from 3 a.m. Monday to 8 p.m. Tuesday.The watch was set to be in effect for mountains, foothills and valleys, but the conditions could cause fire to spark anywhere.Moisture from the thunderstorm will help to alleviate the fire threat, but fuels will dry quickly on Monday, NWS forecasters said.Winds were predicted to gradually decrease Tuesday night and Wednesday, and conditions will be warm and sunny the remainder of the week, forecasters said. 1199

SAN DIEGO (CNS) - In a 6-3 vote, the San Diego City Council today rejected a proposed .5 million sale of the property holding the city's only roller skating rink, Skateworld.The proposal called for the city to sell the parcel of land to big-box store developer Pacifica Companies, much to the chagrin of Skateworld supporters who called on the council to either collect more community feedback before approving the sale or reject it outright in favor of renovating the rink.Skateworld advocates collected thousands of signatures in an effort to save the skating rink, including a change.org petition that garnered more than 19,000 supporters. "I really appreciate that residents of every council district came to speak today about the community that Skateworld fosters,'' said City Councilwoman Barbara Bry. "I think there's so few family friendlyopportunities in that community that it's really essential.''The skating rink was developed under a state redevelopment agency more than 40 years ago. When Gov. Jerry Brown dissolved the redevelopment agencies in 2011, he ordered that their assets be liquidated to the highest bidder.The city put the property up for bid last year and named Pacifica the recommended buyer after three rounds of receiving offers for the site. Supporters of the sale, including City Councilman Scott Sherman, who represents the district Skateworld is in, argued the city's hands were tied and it should honor Pacifica's bid. City Council members Mark Kersey and Chris Cate also voted in favor of the sale."I have to try to make a decision on what is fair,'' Sherman said. SAN DIEGO (CNS) - A man accused of fatally stabbing a 65-year-old clerk inside an adult bookstore in the Midway District pleaded not guilty Friday to felony murder charges that could lead to the death penalty if he's convicted.Shaun Ward, 39, was non-responsive and kept his head down during his arraignment. He was ordered held without bail in the death of 65-year-old Diane Spagnuolo.Ward refused to answer questions from Judge Maureen Hallahan about his true name or date of birth.The judge read Ward his constitutional rights and his attorney entered the not guilty plea for him.Ward was charged with murder and special circumstance allegations that the murder was committed during a robbery and that the murder involved the infliction of torture.District Attorney Summer Stephan will decide later if Ward will face life in prison without the possibility of parole or capital punishment if he's found guilty.The victim was found dead inside the X Spot Adult Store on Midway Drive on Monday afternoon, according to San Diego police. SAN DIEGO (CNS) - A San Diego-based group of environmental activists launched a 100-day campaign today calling on the region's congressional representatives to support the so-called Green New Deal to mitigate the effects and exacerbation of climate change.San Diego 350 hopes to convince Reps. Susan Davis and Scott Peters, D- San Diego, and Duncan Hunter, R-Alpine, to support the resolution by inundating their offices with calls and postcards from constituents between now and the August congressional recess.Reps. Mike Levin, D-Dana Point, and Juan Vargas, D-San Diego, are already co-sponsors of House Resolution 109, which supports the drafting and adoption of a Green New Deal. The proposal would reduce greenhouse gas emissions to a net-zero level, invest in infrastructure and shepherd the country's economic and energy sectors away from fossil fuels and coal by 2030.Rep. Alexandria Ocasio-Cortez, D-New York, first proposed the concept and introduced the resolution in February."Over 80 years ago, (Franklin Delano Roosevelt) and the Democratic Party created a bold plan to address the biggest economic crisis our nation hadever faced,'' said Masada Disenhouse, San Diego 350's executive director.
