SAN DIEGO (AP) — The American Civil Liberties Union on Wednesday released documents detailing widespread allegations of misconduct by U.S. border authorities toward children, including kicking one in the ribs, denying medical attention to a pregnant teen who complained of pain and threatening others with sexual abuse. Its report is based on more than 30,000 pages of government documents in response to Freedom of Information Act requests and a subsequent lawsuit. The allegations date from 2009 to 2014 and, according to its authors, number in the hundreds.Customs and Border Protection strongly denied the claims, as it has rejected similar accusations of widespread excessive use of force in recent years. The documents compiled by the Homeland Security Department's Office of Civil Litigation and Civil Rights for the ACLU are partially redacted, making it more difficult to assess the allegations and findings.TEAM 10 INVESTIGATES: Increase in arrests of immigrants smuggled into San Diego by seaHomeland Security's internal watchdog agency has reviewed the claims and found them unsubstantiated, said Customs and Border Protection spokesman Dan Hetlage. In 2014, the department's inspector general investigated 16 cases of alleged child neglect and abuse — out of 116 that advocacy groups had compiled — and reported that federal prosecutors declined to file charges because there was no evidence of crimes."The false accusations made by the ACLU against the previous administration are unfounded and baseless," said Hetlage.Mitra Ebadolahi, an attorney for the ACLU's border litigation project, said the quantity of the allegations as well as their consistency — spanning several years and several states and coming from children with differing backgrounds — indicates some level of truth.RELATED: Customs and Border Protection details reasons for San Diego border wall testing"These records document a pattern of intimidation, harassment, physical abuse, refusal of medical services, and improper deportation between 2009 and 2014. These records also reveal the absence of meaningful internal or external agency oversight and accountability," says the report, which was co-authored by the University of Chicago Law School's International Human Rights Clinic. The ACLU began publishing the government documents online Wednesday and plans to post material, including audio recordings. Among the cases described in the initial release of documents: 2466

SAN CLEMENTE, Calif. (KGTV) - Local activists are planning a protest Monday after multiple reports saying fans of San Clemente High School’s football team allegedly shouted racist slurs at students of San Diego’s Lincoln High School at a football game Friday night in Orange County. The NAACP San Diego said that multiple spectators from the home team heckled the Lincoln High players and cheer squad, repeatedly using racial slurs including the "n-word.""Furthermore, cheer squad members were racially harassed in restrooms, again including the 'n-word.' This harassment came not only from high-school-age youth, but also from adult fans,” Clovis Honoré, president of the NAACP San Diego Branch wrote in a letter to San Clemente High School and district officials. “We are shocked and disgusted that such blatant racism would occur in 2019 at an athletic contest for high school students,” said Honoré. Honoré called on San Clemente High School and the Capistrano Unified School District to institute a program of implicit bias training for athletics staff, provide an administration contact to each opposing team for any future incidents, and making an announcement on the public address system before all future games that “respect is to be shown to all visiting athletes.” Lincoln High officials said that "at least several students" were targeted by opposing fans shouting the racist slur.VIDEO REPORT: Man arrested for reportedly making racists threats against SDSU student“Our administration team is continuing to investigate the incident, and we are taking this very seriously,” Lincoln High Principal Stephanie Brown wrote on the school’s Facebook page. “Early information also seems to show our students responded to the racist taunts with the maturity and restraint we would expect. They reported it to school leaders, and together we are taking action.” Brown said Lincoln High Vice Principal Eric Brown would interview all students involved on Monday. “I am sorry to have to share such difficult news with you so early in the school year. We expect our students and staff to stand up against racism and hatred when they see it, and it’s up to us responsible adults in the community to do the same,” Brown said. VIDEO REPORT: Parents rally against bullying at Lincoln High SchoolSan Clemente High School officials provided 10News with a letter Principal Chris Carter sent to Lincoln High. “We are deeply concerned by the allegation that racist and offensive comments were directed towards your students and fans at the football game this past Friday. As the Principal of San Clemente High School, I work with my faculty, staff, students, families, and community to maintain the highest standards of respect for all individuals. We do not condone racist speech or actions at our school, and we unreservedly condemn hateful rhetoric that targets any person or group,” Carter wrote. Carter said the Orange County Sheriff’s department, administration, staff, and others who supervised the game would be part of the SCHS investigation. Any statements or questions will be addressed by Assistant Principal, Cameron Lovett, at cnlovett@capousd.org. The NAACP San Diego branch is considering further action, including requesting the suspension of San Clemente High School from the California Interscholastic Federation, Honoré said.Last year, the Lincoln High School Hornets won the 2018 CIF San Diego Division II football title in a win versus Mira Mesa, 23-3. The Southeast San Diego football team went on to play in the 2018 CIF State Football Division 3-AA Championship in the San Francisco Bay Area where they lost to Menlo-Atherton, 21-7.VIDEO REPORT: San Diego County football teams need funding to reach state tournamentThe Hornets are off this week and next play Mater Dei Catholic High School on the road in Chula Vista Sept. 27.Stay with 10News for updates to this developing story. 3905

SAN DIEGO (CNS) - A 24-year-old La Jolla man who was wearing a Jesus costume when he allegedly sucker-punched a San Diego police officer at a Gaslamp District Halloween street festival was charged Thursday with battery of a peace officer and resisting arrest. Eric Van Vleet, who was arrested in Idaho's Cassia County less than a week after the alleged Nov. 1 attack and extradited to San Diego, faces up to three years in prison if convicted. Deputy District Attorney Will Hopkins said the unnamed officer was breaking up a fight amid a crowd of people outside the Atomic bar about 1 a.m. when Van Vleet allegedly yelled, ``(Expletive) the police'' and punched the lawman in the side of the head. RELATED: Man in Jesus Halloween costume accused of punching San Diego police officerVan Vleet -- who was dressed as Jesus Christ with devil horns -- then walked away from the ruckus, disappearing into a crowd and getting into an Uber vehicle, according to the prosecutor. He traveled to Idaho, where he is the CEO of two companies, according to Hopkins. Defense attorney Marc S. Kohnen said Van Vleet is a majority partner in his companies, which are involved in advertising for medical products. The officer, a three-year member of the San Diego Police Department, was taken to a hospital for treatment of a roughly inch-long laceration and other trauma. The officer missed a week of work with post-concussion symptoms, according to Hopkins. Kohnen emphasized that his client has no criminal record and disagreed with San Diego County Superior Court Judge Jay Bloom's decision to set bail at 0,000. RELATED: San Diego police: Man accused of punching officer while wearing Jesus costume arrestedThe judge cited Van Vleet's travel to Idaho as part of the reason for the high bail, in addition to his apparent financial resources. Along with his ``business ties'' to the Idaho companies, Hopkins said investigators found a vehicle valued at around 0,000 at his home. According to the prosecution, surveillance footage and bar tabs helped investigators identify Van Vleet as the suspect. Kohnen countered that it's not clear whether Van Vleet or someone else in the crowd assaulted the officer, calling it a ``chaotic scene'' in which police arrested multiple people. Van Vleet pleaded not guilty and is due back in court next Tuesday for a bail review hearing. 2370
