San Diego will seek to invalidate its landmark pension law, a citizens' initiative 65 percent of voters approved in 2012.The City Council voted 6-3 Monday to go to court to invalidate 2012's Proposition B, which switched most new hires from a pension to a 401(k) style plan. The decision came after multiple courts ruled the city skipped a key step in the campaign. The courts said then-Mayor Jerry Sanders' involvement meant the city needed to meet and confer with unions, but didn't. The courts required the city to make employees whole plus a seven percent penalty, but didn't invalidate the law. The city will now to go to court along side its employee associations to get it off the books. "It's illogical for the city to believe that having broken the law in order to get Prop B into the charter that you should be allowed to keep it in there," said attorney Ann Smith, representing the Municipal Employees Association. Firefighter John Hernandez II said he's seen a number of his colleagues leave for other departments, which offer better benefits - namely a pension."In my line of work, we can't work as long as most people, and that's why we need pensions," he said. But Councilman Scott Sherman, who voted to protect Prop B, said ultimately going back to pensions could cripple the city. "Every single year we make a 0 million minimum payment on our pension debt from the old system that too us to that point, and now they're asking us to go right back to that system," he said.Sherman said it's low unemployment, not a lack of benefits, leading to the city's worker retention issues. SAN DIEGO, Calif. (KGTV) -- A 64-year-old man is recovering after he was beaten in Kearny Mesa by a group of street racers so severely he had a brain bleed and fractured disk. "I felt my RV jostling around, like maybe they were standing on my bumper, so I got out and went around back to look and I look up and someone's standing on my RV," said the victim, who did not wish to be identified.Police said the beating happened on June 28 around 9:30 p.m. A group of street racers arrived in the area for an apparent “meet up” and gathered into a large group. Multiple vehicles arrived at the location and began doing “burn-outs” in the street. Some members of the group climbed on top of the victim’s RV. When the victim walked out of his vehicle to confront them, three of the men attacked him. Another man stole the man's phone from his pocket as he was lying on the ground unconscious. "The last thing I remember is one of his buddies jumping out and I don’t know what happened after that; I probably got hit from behind."The suspects fled the area in a grey, possibly 2003 Audi A4 sedan. The man was left lying in the street. Employees from a nearby business ran out to help him and called an ambulance. San Diego County Crime Stoppers along with investigators from the San Diego Police Department’s Eastern Division are asking for the public’s help in identifying and locating the attackers. Officers are investigating the attack as a felony battery and robbery case.Anyone with information on the identity or location of the suspects is asked to call SDPD’s Eastern Division at 858-495-7957 or the Crime Stoppers anonymous tip line at 888-580-8477. SAN DIEGO, Calif. (KGTV) - Realtors say all the signs point to a busy spring and summer in San Diego."It's heating up a little bit," says Markus Feldmann, with the Pacific Real Estate Center. "We see a very active market again."Home prices have come down from their record peak in August of 2018. That month, CoreLogic reported that San Diego's median home price was 3,000. In December, it had dropped to 0,000 (see chart above). According to their numbers, homes in San Diego sold for ,000 more in that period than other times of the year. Zillow also says homes are on the market for six fewer days in early May.No matter which side of the sale you're on, Feldmann says there are simple ways you can make sure you get the most for your money.If you're a buyer, he says you don't have to keep increasing your offer. Feldmann says you can increase your deposit. Those small things can have a big payout."Feldmann says it's also crucial that sellers stay patient after they list a home."Let the property sit on the MLS for a few days, don't just accept the first offer that comes," he says. "Let it breathe like a good glass of wine. SAN DIEGO (KGTV) - With home prices skyrocketing San Diegans are turning to remodeling.However, if the home has lead paint or asbestos, it can become a health hazard if not handled correctly. The Environmental Protection Agency is cracking down on companies breaking the rules.The agency has taken action against six companies in Arizona and California for allegedly violating regulations requiring them to protect the public from exposure to lead. The companies paid a combined 7,000 in penalties.According to the EPA, "an inspection found that, between 2014 and 2015, Renovation Realty performed renovation work at six homes in San Diego and Santee without being EPA-certified to perform work in pre-1978 housing where lead-based paint is assumed to be present." The agency says the company also failed to keep records indicating compliance with lead-safe work practices and did not ensure a certified renovator was involved as required."Looking back at it, it was a painful expensive experience to get fined by the EPA" said Keith Christian CEO of Renovation Realty.Christian said, at the time, they didn't understand the EPA's requirements of how much square footage you can disturb per room."We got fined, we paid the fine, we all went to a class we got certified as a company our supervisors got certified and it's been a great experience,” Christian said. “So now that we understand the process we incorporated that into our renovation.”Across the county from October 2016 through September 2017, the EPA finalized 121 civil settlements for alleged violations of at least one of the lead-based paint rules. The settlements they obtained in the cases soared past one million dollars. The EPA requires companies who perform abatement projects in pre-1978 homes to be certified and follow specific work practices.“For a homeowner, the biggest thing is their liability,” said Tim Tilley with Superior Abatement Services Inc. “If they hire a contractor who doesn’t follow the rules, the regulatory agencies will generally cite everyone in the food chain.”Tilley removes hazardous material like lead and asbestos for a living. His team is currently working on a San Diego home that tested negative for lead but positive for asbestos.Tilley tells 10News rules put in place at the federal level down to the local level are there to protect employees and consumers."For a homeowner, it's really important to ask the right questions,” said Gregg Cantor with Murray Lampert Design - Build – Remodel.Cantor says consumers should know if the contractor is licensed and certified and trained to perform hazardous materials work.Consumers also want to ask about types of safety methods they use, digging into specific safety precautions before, during and after the work is done. SAN FRANCISCO (AP) — A California state audit found that the University of California wrongly admitted at least 64 wealthy students over the past six years as "favors to donors, family, and friends."California State Auditor Elaine Howle also found in the audit released Tuesday that campus staff falsely designated 22 of the applicants as student-athlete recruits because of donations from or as favors to well-connected families.The University of California, Berkeley, admitted 42 less-qualified applicants based on connections to staff, leadership, and donors.The audit was conducted in response to the national college admissions scandal that embroiled prestigious universities around the country, athletic coaches and dozens of wealthy parents. 756
