SAN DIEGO (KGTV) - The trial started Wednesday for two San Diego County Sheriff’s deputies facing criminal charges after an arrest in Vista. Deputies Nicholas Morgan and Joshua Nahan are charged with assault for what District Attorney Summer Stephan calls illegal actions during the encounter. Gerardo Martinez Jr. and his father were taken into custody last May after the deputies responded to a domestic violence call. Part of the 911 call was played for jurors during opening statements Tuesday. The panel also saw cell phone video of the arrest recorded by a neighbor. The now-viral video shows Deputy Nahan push Martinez Sr. into a fence while handcuffed. Martinez Jr. was repeatedly struck in the head by Deputy Morgan while on a concrete sidewalk. “Law enforcement officers hold a position of trust in our community and are required to abide by the rules in the exercise of their powers. The evidence on which the charges are based shows the force used by the two deputies exceeded the legal line, violating that public trust. For justice to thrive, it is important that no one is above the law,” Stephan said in November. RELATED: San Diego County DA's Office files charges against deputies involved in violent arrest The San Diego County Sheriff’s Department sent a statement to 10News last fall, which read in part, “The Department does not tolerate misconduct of any kind. We have the utmost confidence in the criminal justice system and we will continue to coordinate with and support the District Attorney's Office as these cases move through the judicial process." If convicted, Deputy Morgan could face up to two years in jail. Deputy Nahan could face one year for misdemeanor assault, if a jury finds him guilty. 1891

SAN DIEGO (KGTV) - This Veterans Day, an online service is offering a deal to help veterans preserve their memories for future generations.Story Terrace is giving vets a discount so that they can write books based on their lives and experiences. The company is calling it the "Speak and Listen" campaign."My grandfather was in the resistance in the Netherlands (in WWII), and I regret not recording his stories," says Story Terrace CEO Rutger Bruining. "That's why I think it's really important for the entire family that these stories are kept and retold, so people remember what happens."The service pairs people up with ghostwriters who spend hours interviewing the subject and then write a book for them. It costs between ,900 and ,450 depending on how long and detailed you want the book to be, and how many pictures you want to include."Ultimately, the content is up to the customer, to change and have it the way they want," says Bruining.Retired Navy Pilot Frank Miley wrote his life story on his own before he knew about Story Terrace. He says putting it in writing was emotional, but also crucial, so his family knows what he went through during the Vietnam War."I didn't do it for glory," Miley says. "I just wanted to let them know that I did my job to keep them safe."Jim Reily, who runs the docent program on the USS Midway, says that first-hand interaction is the best way for people to hear about veterans' contributions to the country."It's gratifying to talk to a bunch of folks who have never been on a ship and explain what happens and see the awe and wonder in their eyes," Reily says. "Our freedom isn't free. It takes sacrifice, and it takes the good efforts of the several hundred thousand folks that are in the service right now to protect our freedoms."Bruining says it's especially important to get these stories preserved now, as generations of veterans from World War II, Korea, and Vietnam are passing away."The understand of what happened and the lessons we have to learn from history about the things that went wrong, but also the heroic tales of humankind, they will slowly get lost," he says. SAN DIEGO (KGTV) — This year marks 75 years since many turning points in World War II, including the end of the war on Aug. 14. Now, the men and women who served are in their 90s and many say despite the time, they remember exactly where they were the moment they found out the war was over.“We were told you’re just going on a flight, and we were told you don’t have to, the wars over,” said 93-year-old Navy veteran Al Hansen.“The war ended and they let us all, gave us liberty for the day,” remembered 94-year-old Navy veteran Don Hubbard.RELATED: WWII veteran honors D-Day anniversary with world-wide bell ringingTo commemorate the day, the USS Midway held a ceremony. Due to coronavirus restrictions, the public was not invited, however, the event was live-streamed on the museum's Facebook page, which can be found here.In attendance were three Navy World War II veterans, including Hansen and Hubbard, along with 95-year-old Jack Scott, who said he wants to use this anniversary to remind the public to find peace.“Right now there seems to be a great deal of unrest in the country and I would like, of course, for the unrest to come to an end and for people to be kind to one another,” said Scott. 1212

  

SAN DIEGO (KGTV) - The San Diego District Attorney's Office announced a new program Thursday that would send low-level offenders to the classroom instead of a jail cell.The Community Justice Initiative requires 12 hours of cognitive behavioral therapy, as well as four hours of community service. The participant then has their case dropped and their record sealed. They wouldn't have to report an arrest on any future job application."Some people deserve second chances," DA Summer Stephan said.The program started in the South Bay in April 2018, expanded to the East County in January 2019, then North County in May. It's funded in part by the county, grants, and 0 from each criminal."That amount is less than any fine they would have gotten on any case," Stephan said.So far the program has seen 586 participants. 296 of them completed the program.Director of Cognitive Behavioral Therapy for Adult Justice Programs and Social Worker Laura Soto spoke of one of her patients who completed the program, "she [Amanda] began to spend more time with her son, she got a diploma and she got an office job, and then she started cosmetology school."Amanda was arrested for stealing. Through the program she shifted her mindset away from entitlement."Amanda began to think about the consequences, and things to be grateful for and that made her happy," Soto said."The most common offenses in the program are in fact shoplifting, non DUI traffic violations or vandalism,." Stephan said only non-violent and non-sexual offenders qualify."Misdemeanor convictions can have damaging affects that last a lifetime," she added. Stephan said criminals will continue turning to a life of crime if they can't find a way out.10News asked Stephan what she would say to critics who believe this program could incentivize criminal behavior. She said, "the people who complete the program recidivate at 2% which is so phenomenally low."She compared it to the 16 percent who didn't complete the program and were arrested for a crime again. 2027
