SAN DIEGO (KGTV) - A San Diego veteran and father is defending his son's right to sit during the national anthem.Ray Everett is responding to a letter sent to Lincoln High School's principal, complaining that students on the basketball team were sitting and talking during the national anthem.The man who wrote the letter is a U.S. Air Force veteran and grandfather to a player on the opposing team. Another parent who was offended used her phone to film the students sitting."At the end of the day our students do not have to stand," said Everett. "But you will not make them feel like they did something wrong. They did not harm anyone and they did not break the law."Everett was in the U.S. Army for 15 years. He says he served his country in order to protect the rights of Americans, including the right to sit during the national anthem.Everett's brother-in-law, Antoine Jarvis, says while he was offended by the letter he respects everyone's right to their own opinion. "I think that the biggest challenge in voicing your opinion is when you're close-minded to other's opinions," said Jarvis. "When you're close-minded to their beliefs."Jarvis says he no longer stands during the national anthem after learning more about its history. He only asks that others respect his right to do so.The principal of Lincoln High School, a veteran himself, has been responsive to complaints and plans to sit down with the veteran who wrote the letter about the student's actions.On Thursday the San Diego Unified School District released a statement:Public school districts do not have the authority to require students to observe patriotic or religious rituals in the classroom or at school functions. We believe in our students right to free-speech, but also encourage students to be respectful in the way they choose to exercise their rights.School Administration is reaching out to the students involved and taking the opportunity to use this as a teachable moment. 1980

SAN DIEGO (KGTV) — An autopsy report released on Trevor Heitmann, the teenager known as "McSkillet" on YouTube, is revealing details about what happened before he crashed his vehicle on Interstate 805.The report says Heitmann’s parents called the police to request a psychiatric evaluation stating, “On August 23, the decedent's parents contacted the local police department to request a psychiatric evaluation but were informed that the evaluation could not be performed as the decedent had not broken any laws."The statement means hours before Trevor Heitmann drove his car down the freeway killing two people, police were at his house.RELATED: Autopsy details mental state of McSkillet before deadly I-805 crash"Even though police are trained to identify mental health issues and mental illness issues they just can't take someone off the streets unless there is such conduct to warrant it,” said attorney Kenneth Rosenfeld.Rosenfeld, who has no connection to this case, explained law enforcement does have the ability to detain someone using the 51-50 law. It would allow someone to be involuntarily detained for a psychiatric hold for up to 72 hours.Conduct in many cases needs to be observed. Just saying someone is acting out of nature isn't always good enough.RELATED: YouTuber's family releases statement, offers condolences to crash victims“Police officers are not psychologists or psychiatrists,” he said. “They do their best, but usually when someone’s conduct or behavior is so erratic, that’s when they can factor into the idea that this is probably someone worth taking it.”Police dispatch logs show units arriving at the Heitmann home just after 8:00 a.m., Aug. 23, the morning of the crash.At 9:14 a.m., notes say, “based on statements from parents, there was no credible threat and Subject did not meet 5150 criteria. Parents advised if we went in house to ask subject if he would voluntarily go to hospital, subject may become violent. We did not encounter subject. Dad advised that he convinced son to go talk to doctor later today.”RELATED: Neighbor: Police called to YouTuber's home on day of deadly crashHours later police say Heitmann drove the wrong way on the 805 freeway colliding head-on with an SUV. Aileen Pizarro and her 12-year-old daughter Aryana were killed instantly.Team 10 reached out to the San Diego Police Department about the report but they didn’t have any comment beyond what’s in the dispatch logs. 2465

  

SAN DIEGO (KGTV) - A San Diego Midwife is living her dream of opening her own birth center, helping minority women.We met Nikki Helms in July when her GoFundMe was off the charts, raising more than 1,000.She had been a licensed midwife for about a year and wanted to open a birth center. Fast forward to December and her dream is coming true."We've got signage and I stood at the foot of my stairs and cried about that," Helms said filled with gratitude. The community has continued to wrap their arms around her mission."It's really just been amazing and overwhelming, and I feel so blessed," she said wiping a tear from the corner of her eye. "And so grateful and I get teared up every time I start talking about it because it gives me the opportunity to go care for families and you know it just blows my mind."Since July she's raised another ,000 and packages keep arriving on her doorstep with items for the birth center.Her mission is to support women through childbirth and beyond. Recent studies show Black women in the U.S. have disproportionately higher rates of mortality and harm during delivery."I had heard about different women who had had these experiences where they asked for help and they weren't listened to," Helms said.She hopes to have her first patients in the center in January.During the pandemic she's caring for families in their homes as safely as possible."I am most grateful for my own health which gives me the opportunity to go out and help other people," she said.Helms said she has been honored with a Champion of Reproductive Health Award by the San Diego Coalition for Reproductive Justice for the work she is doing.If you would like to support the San Diego Community Birth Center: click here for her Amazon Wish List or here for her GoFundMe.Helms said she is working to get her programs and services accepted by insurance.Helms is partnering with San Diego Co-Harvest to grow a garden around the birth center to feed families in need.When asked what she hopes for in the future, she replied "abundance." SAN DIEGO (KGTV) - A water line break forced Hard Rock Hotel guests out of their rooms Sunday night.San Diego Fire officials said that about 2 inches of water from the 7th floor leaked down to the 5th and 6th floors beginning around 10 p.m. at the hotel on 5th Avenue. The water was shut off shortly after 11 p.m.Some guests had to leave their rooms because of the flooding. A damage estimate was not available. No other details are available.This is a developing story. 10News will update when details become available. 533
