CARLSBAD (KGTV) -- A slope in Carlsbad is moving, affecting a senior community on top of it. The question of who is responsible for paying to fix it has the City of Carlsbad battling with those who live in Camino Hills.“It’s been a tremendously stressful experience for everyone,” said Mike Perry, who has lived in Camino Hills since 2001. Joe Matthews has called the Camino Hills community his home for about 19 years. “We have lunch out here, sometimes dinner,” Matthews said, as he showed Team 10 the front patio area where he relaxes with his wife. “The grandkids come visit.”“It’s a really wonderful community,” Mathews added. What he did not know was something was going on beneath the surface. “It came as a real surprise,” Matthews said. According to court documents filed by the Camino Hills Homeowners Association in 2018, the City of Carlsbad noticed damage to the pavement and sidewalk right by Camino Hills Drive back in 2007. In January 2009, a geotechnical firm placed devices in the slope to track the movement. There was more slope movement detected during the El Ni?o rainstorms from 2016 and 2017.To fix the issue, it could cost anywhere from 0,000 to about million, according to Elizabeth French. French represents the Camino Hills Homeowners Association. She said the city did not fix the problem properly in the first place. “The city actually knew that there was an ancient landslide at this location and rather than make the developer make a more expensive repair, they allowed the developer to put in a subsurface buttress made of soil, but in recognition that that wasn’t the best repair,” French said. She said when this community was being built, the City of Carlsbad entered an agreement with the developer of Camino Hills. In the indemnity agreement, French said it required the developer to fix any problems for up to 10 years after the community was built. Camino Hills was built in the mid-1980s and the developer is now out of business. French said the city is now asking the residents of Camino Hills to foot the bill.“There’s nothing in this association’s government documents alerting any of the prospective purchasers that there’s this enormous liability out there, that they could be tasked with addressing down the road and that kind of notice is required in the law,” French said.Joanne Stout’s modular home is right by Camino Hills Drive. “This is it. This is where I’m going to be until they carry me out of here,” Stout said. However, if residents are forced to pay for street repairs, she would have to sell.“I would be one of the ones that would have to leave and that would make me very sad,” Stout said.Nobody with the City of Carlsbad would agree to an on-camera interview. CARLSBAD, Calif. (CNS) - The city of Carlsbad announced Thursday it was temporarily suspending its collection fees for sidewalk cafes, outdoor displays and curbside cafe permits to help businesses during the COVID-19 pandemic.This suspension of permit fees also means reimbursement of around ,000 to businesses that paid for these types of permits since March 1 of this year. Fee reimbursement and the revenue offset from the suspension of fee collection will be funded from the Economic Recovery and Revitalization Initiative funds. Of those funds, 5,000 remains for contingency or future city council actions.When the pandemic's public health orders required the closure of indoor operations, Carlsbad relaxed development standards to allow businesses to use these permits to quickly activate outdoor spaces on public sidewalks. Some businesses were also granted no-cost permits allowing them to use private property such as their parking lots, to add to their existing outdoor areas.On July 28, the City Council also relaxed standards for curbside cafes, allowing restaurants to use up to four street parking stalls to expand outdoor dining.The permits normally cost a one-time payment of 1 and ,200 per parking stall per year. These fees are now temporarily suspended until February 28, 2021, or for the duration of the local COVID-19 pandemic emergency, whichever is later.More than 70 businesses have been permitted, including restaurants, fitness classes, hair and nail salons, spas and churches, allowing them to temporarily move their operations outdoors onto private property, public sidewalks and on-street public parking spaces so that they can comply with public health guidelines.According to a statement from the city, even with the county now allowing indoor dining, retail shopping or fitness classes, capacity has been reduced by 50% to 90%, depending on the type of business. CENTERVILLE, Tenn. (WTVF) — Investigators say "recent information" in the 2003 disappearance of Tabitha Tuders led to detectives searching a rural part of Hickman County this week.Metro Nashville Police Department officials confirmed the update on Wednesday morning, saying cold case detectives, along with Urban Search and Rescue officers and FBI agents were on scene.Police spokesperson Don Aaron said the police department has pursued numerous leads in the 17 years since Tuders' disappearance. Aaron said a theory that she may have been on the property in 2003 led to today's search.Tuders was 13 when she vanished in April of 2003. She was on her way to catch the bus near her family's home on Lillian Street in Nashville. She hasn't been seen since.Police described the search area as a six-acre, rugged plot of land with a small, dilapidated house on it. The terrain was described as mostly wooded.Sgt. Charles Rutzky said the search was based on "old and new information." He said information has been developed as to how Tuders possibly got to the property, but that's something they're still investigating.Rutzky said they're looking for any evidence to support the theory that she's been in the area. Car buyers these days love SUVs. They don't, however, love actual cars like hatchbacks and sedans --as Ford has learned.Ford said on Wednesday the only passenger car models it plans to keep on the market in North America will be the Mustang and the upcoming Ford Focus Active, a crossover-like hatchback that's slated to debut in 2019.That means the Fiesta, Taurus, Fusion and the regular Focus will disappear in the United States and Canada.Ford will, however, continue to offer its full gamut of trucks, SUVs and crossovers.By 2020, "almost 90 percent of the Ford portfolio in North America will be trucks, utilities and commercial vehicles," the press release says. "The company is also exploring new 'white space' vehicle silhouettes that combine the best attributes of cars and utilities, such as higher ride height, space and versatility."By "white space," the company is referring to vehicles that don't fall neatly into the typical categories.Ford has hinted it might decide to retire much of its sedan portfolio. Earlier this year, James Farley, the company's president of global markets, said Ford is "shifting from cars to utilities," which have been a bigger profit driver. It also reallocated billion of research funds from cars to SUVs and trucks.And it's not just Ford. Fiat Chrysler did away with the Dodge Dart and Chrysler 200 more than a year ago. Canadian police say an armed man crashed his truck through a gate and breached the grounds where Prime Minister Justin Trudeau lives before being arrested two hours later. The Royal Canadian Mounted Police say Trudeau was not present at the time of the incident in Ottawa on Thursday. Royal Canadian Mounted Police Deputy Commissioner Mike Duheme declined to name the suspect or talk about his motivation, only saying the man had several weapons. Police earlier identified the suspect as a member of Canada’s armed forces.The man has a bail hearing Friday. Police say he’s facing multiple charges. They say the man crashed his truck through the gate early Thursday.
