SAN DIEGO (KGTV) - Approximately 900,000 San Diegans who pay for sewer services may have had their rights violated.It’s part of what being alleged in a massive new class action lawsuit against the City of San Diego, its Public Utilities Department and the San Diego City Council.The suit calls it an “illegal financing scheme”. Attorneys who brought the suit claim the issue surrounds the city’s million smart water meter system and how it was paid for.  The lawsuit alleges the city knowingly used about million from the city's sewer fund instead of the city's water fund to help pay for that meter system.Subsequently, hundreds of thousands of San Diego sewer ratepayers were allegedly misinformed about what their money was being used for. Attorneys argue sewer ratepayers were quite possibly paying for a system that they did not necessarily benefit from- the smart water meter system. It’s still unknown whether there were any rate hikes directly tied to this.The suit claims the situation was an unconstitutional grab of million in funds.The San Diego City Attorney’s Office is reviewing the complaint and will respond through the court. 1183

SAN DIEGO (KGTV) – County leaders are continuing to urge San Diegans that 2020 is not the year to skip the flu shot as we head into colder months amid a nearly year-long pandemic.On Wednesday, the fourth of six flu vaccine clinics was held by San Diego County’s Health and Human Services in Logan Heights. All hands were on deck with nurses from across the county, as more people are heading to the free clinics to get their flu shot this season."This is a year to be vigilant of protecting yourself from influenza and getting a vaccine, so we don't run into a situation where people are not only getting COVID, but getting influenza, and clogging our medical response system," said Thomas Zurek, public health nurse manager with the county.Zurek said while we can't control the spread of COVID-19 with a vaccine, we can when it comes to the spread of influenza, which hits hard during cold months when more people are indoors.Zurek added he hopes the free clinics will help keep people out of hospitals this season so staff can focus patients affected by COVID-19."Our numbers have been above what we're normally than seeing this time of year, which is great," Zurek said.The county will hold two more vaccine clinics Thursday and next Tuesday:Thursday, Oct. 29, at East Public Health Center, 367 N. SAN DIEGO (KGTV) - Campaign ads against San Diego District Attorney Summer Stephan over a backlog of rape kits to be tested were recently pulled from television.More than a hundred people stood on the steps of San Diego's Hall of Justice, showing support for Stephan, as she blasted her opponent's television campaign ads. The ads were paid for by the Justice and Public Safety PAC, funded by billionaire financier George Soros."We need your help to get the word out, San Diego is not for sale!" Stephan said, flanked by several crime victims who shared their personal stories.RELATED: Billionaire backs candidate for San Diego District AttorneyThe ad in question is about rape kits not being tested. Stephan announced in April that her office is spending million for an out-of-state laboratory to test 1,000 rape kits to end a backlog.Stephan's opponent, Genevieve Jones-Wright, stands by the ads, saying she hopes they'll be updated with larger numbers."My reaction ... hopefully, they make it more accurate; not hundreds of backlogged rape kits," Jones-Wright said. "There are thousands still sitting on our shelves, collecting dust as a result of her failed leadership."It's not clear why the ads were pulled. 1249

  

SAN DIEGO (KGTV) - California Governor Gavin Newsom talked with 10News Thursday in a one-on-one interview.He addressed key topics, including his revised budget plan for 3.5 billion in the upcoming fiscal year. The governor also talked about the death penalty in light of the Poway synagogue shooting, and if cases like it make the Governor rethink his decision to place a moratorium on the death penalty. Newsom also addressed the debate over gun control, his plan to provide more funding for healthcare for undocumented immigrants and an idea to impose a tax on water. 581

  

SAN DIEGO (KGTV) - Border officials say the man shot and killed on Friday night by a Border Patrol agent behind the Las Americas Premium Outlets mall was trying to enter the U.S. illegally.A statement from Aaron Heitke, Chief Patrol Agent for the U.S. Border Patrol, San Diego Sector reads:“On Friday, October 23, 2020, at approximately 5:45 p.m., a United States Border Patrol agent responded to apprehend a man illegally entering the United States immediately west of the port of entry in San Ysidro, California. During the arrest, an altercation ensued and the agent discharged his firearm, wounding the man, who was later identified as an adult Mexican national. Nearby agents and law enforcement personnel responded immediately and initiated lifesaving efforts until emergency medical services arrived. At approximately 6:25 p.m. the man was pronounced deceased at the scene. The investigation is currently being led by the San Diego Police Department. Customs and Border Protection will continue to fully cooperate with the ongoing investigation. The specifics of this incident have also been shared with FBI, DHS OIG and CBP Office of Professional Responsibility. Additional updates will be provided by the San Diego Police Department, inquiries should be directed to them.”SDPD added Saturday that the 30-year-old man was shot once in the torso by the agent after he fought the agent, who sustained minor injuries.Social justice leaders with the American Friends Service Committee and Alliance San Diego have sent a letter to SDPD calling in part for an independent investigation to be handled only by police, not border officials or unions. Part of the letter reads, “Any involvement or coordination with these agencies, and specifically with CIIT has the potential to corrupt the investigation and could be considered an obstruction of justice.”Pedro Rios with the American Friends Service Committee said that he and others are considering holding a demonstration on Sunday. “I think for us it's important to ensure that people are treated with dignity regardless of who they are and we shouldn't jump to conclusions about the person who is now a victim and is now deceased,” Rios told ABC 10News on Saturday. He added, “I think we should permit the investigation — an unobstructed investigation — to move forward and that way we get to know exactly what took place that led to the demise of this individual.”There's now a call for evidence related to the shooting to be released right away. “We know that there's a lot of surveillance cameras in the area, not only belonging to Customs and Border Protection and [the] Department of Homeland Security but also the Las Americas mall has a lot of cameras in the area,” said Rios.Officials are not releasing the name of the man who was shot or the name of the agent who fired at him. 2848
