SAN DIEGO (CNS) - San Diego City Councilman Chris Cate urged prosecutors Friday to take a zero-tolerance stance on predatory scams involving fraudulent checks, particularly amid the COVID-19 pandemic when people may be especially susceptible to fraud. In a letter sent Friday to California Attorney General Xavier Becerra, the councilman suggested removing the possibility of prosecuting Penal Code 476 -- which makes creating or passing a fake check a crime -- as a misdemeanor, increasing the fine amount and maximum jail sentence for those found guilty, and assigning additional Department of Justice resources to investigate check fraud complaints. The councilman wrote that scams in the form of fake check deposits "are becoming widespread in Southern California and are causing our most vulnerable to lost thousands of dollars they cannot afford."Cate said one such fraudulent check was recently received by one of his staff members, which appeared authentic and bore the name of a "legitimate financial institution."He said he worried that with high unemployment rates amid the pandemic, people would be more likely to fall prey to scams of this sort."Taken as a whole, these measures will send a clear message to those who would attempt to prey on the most vulnerable and susceptible in our society that California stands with consumers and will not tolerate this fraudulent conduct," Cate wrote.A copy of Cate's letter, which features examples of a fraudulent check and typical accompanying letter from a supposedly legitimate company, can be viewed at https://www.sandiego.gov/sites/default/files/predatory_check_scam_enforcement.pdf. 1650

SAN DIEGO (CNS) - San Diego State will seek to extend its recent dominance over Pac-12 opponents when it plays at Colorado Saturday after both teams' original opponents couldn't play because of COVID-19 issues. The Aztecs are 5-1 against the Pac-12 since 2016, including victories over Stanford in 2017 and Arizona State in 2018, who were both ranked in The Associated Press Top 25, and UCLA last season, San Diego State's first over the Bruins after 21 losses and a tie.The game matches the Aztecs' defense that is third among Football Bowl Subdivision teams allowing 269.4 yards per game against the Buffaloes' offense, 12th in the FBS in scoring, averaging 41.5 points.Colorado is 2-0 under first-year coach Karl Dorrell, a 1982 graduate of Helix Charter High School in La Mesa.San Diego State's scheduled game Friday at Fresno State was canceled Sunday due to COVID-19 contact tracing within the Bulldogs' program. The Mountain West Conference declared the game a no-contest and has no plans to reschedule it, conference officials said Sunday. The Buffaloes' scheduled game at USC was canceled Thursday by the Pac- 12 and declared a no-contest because USC did not have the minimum number of scholarship players available at a specific position group as a result of a number of positive COVID-19 cases and the resulting isolation of additional players under contact tracing protocols. As a contingency, Colorado athletic director Rick George earlier this week coordinated with his counterpart at San Diego State, John David Wicker, for the Aztecs to visit Boulder in case the issues that had arisen with USC did not improve or worsened."It is unfortunate that our game at Southern California had to be canceled, but as we all continue to maintain, the most important concern we all have is the health and safety of our student-athletes, coaches and staff," George said."After the Pac-12 CEO's created some requirements for possible non-conference opponents to fill any vacancies created by cancellations, we moved earlier this week to find a possible opponent to replace the Trojans. When San Diego State's game at Fresno State was canceled for similar reasons, I spoke with John David and we put an agreement in place if USC could not play."The game will be the season's first non-conference game for a Pac-12 team. The Pac-12 announced Nov. 19 that its CEO Group approved non-conference games, reversing a previous decision. The conference set the following criteria for a non-conference football opponent to be scheduled by a Pac-12 football team:All Pac-12 testing and related protocols must be adhered to by the non-conference opponent;the non-conference game will in all cases be a home game for the Pac-12 team, broadcast by a Pac-12 television partner; andif a Pac-12 opponent becomes available by the end of day Thursday in any given week, the conference game must be played in lieu of any non- conference game.Scheduling the Aztecs (3-2) means the Buffaloes will not be idle on consecutive weekends. Their planned game last Saturday against Arizona State was canceled due to COVID-19 issues in the Sun Devils' program.San Diego State lost to Colorado, 34-14, in the only game between the two teams on Sept. 7, 2002, in Boulder. 3244

SAN DIEGO (CNS) - San Diego Gulls coach Dallas Eakins was Monday named the coach of its NHL parent team, the Anaheim Ducks.Eakins coached the Gulls throughout their four seasons in the American Hockey League, guiding them to a 154-95-23 record and three Calder Cup playoff berths. They reached the Western Division finals in the recently concluded 2018-19 season. The Gulls had the best record in the AHL's Pacific Division since its inception in the 2015-16 season. The 52-year-old Eakins called his hiring as the Ducks' coach ``a tremendous honor for my family.''``I am truly humbled,'' Eakins said. ``It was a privilege to serve as head coach of the San Diego Gulls during our first four seasons and I look forward to build off that success here in Anaheim.''Eakins replaces Randy Carlyle, who was fired on Feb. 10. General manager Bob Murray was the interim coach for the remainder of the season. The Ducks were 35-37-10 in the 2018-19 season, finishing sixth in the NHL's eight-team Pacific Division and missing the Stanley Cup playoffs for the first time since the 2011-12 season.``Dallas is an outstanding head coach who has worked well with our players since joining the organization four years ago,'' Murray said. ``He is a tremendous leader and strategist, and deserves this opportunity.''Eakins coached the NHL's Edmonton Oilers to a 36-63-14 record from the start of the 2013-14 season until being fired 31 games into the 2014-15 season after Edmonton got off to a 7-19-5 start. He coached the AHL's Toronto Marlies, the Toronto Maple Leafs AHL affiliate, to a 157-114-4 record from 2009-13, guiding them to the 2012 Calder Cup Final, where they lost to the Norfolk Admirals.Eakins was also an assistant coach with the Marlies in the 2005-2006 season and with the Maple Leafs from 2006-2008.Eakins played 16 seasons of professional hockey as a defenseman, mainly in the AHL. He had nine assists and 208 penalty minutes in 120 NHL games with eight teams. 1969

SAN DIEGO (CNS) - San Diego County health officials have reported a record 736 new COVID-19 cases Saturday and five more deaths as nonessential businesses moved to outdoor-only when the county went from the red to the purple tier of the state's four-tiered coronavirus reopening plan. The data increases the total caseload since the start of the pandemic to 63,681, with the death toll rising to 926. This is the fourth consecutive day that more than 600 new coronavirus cases were reported by the county. On Wednesday, a record 661 COVID-19 cases were reported in the county - - surpassing the 652 cases reported Aug. 7. Another 620 cases were reported Thursday."We have not seen cases this high in months, and it's a clear indication that COVID-19 is widespread," said Dr. Wilma Wooten, the county's public health officer."These totals also show people are not following the public health recommendations that we know work to prevent getting and passing COVID-19."Wooten added that in the weeks following Halloween, this record case jump is a warning sign people "need to follow public health guidance throughout the upcoming holiday season."This comes as state data has landed the county in the most restrictive tier of the state's COVID-19 reopening plan. The restrictions associated with the purple tier went into effect just after midnight Saturday. Many nonessential businesses are now required to move to outdoor-only operations. These include restaurants, family entertainment centers, wineries, places of worship, movie theaters, museums, gyms, zoos, aquariums and cardrooms. The restrictions include closing amusement parks. Bars, breweries and distilleries will be able to remain open as long as they are able to operate outside and with food on the same ticket as alcohol.Retail businesses and shopping centers can remain open with 25% of the building's capacity. No food courts will be permitted.Schools will be able to remain open for in-person learning if they are already in session. If a district has not reopened for in-person learning, it must remain remote only. Offices are restricted to remote work.Remaining open are essential services, personal care services, barbershops, hair salons, outdoor playgrounds and recreational facilities. The county's demotion from the less-restrictive red tier is the result of two weeks of case rates that exceeded the threshold of 7 per 100,000 residents. In recent weeks, the region had an unadjusted rate well above the purple tier guidelines, but a significant effort to increase the volume of tests had allowed for an adjustment to bring it back to the red, or substantial, tier.State officials reported Tuesday that San Diego County had an unadjusted new daily coronavirus case rate of 10.0 per 100,000. The adjusted case rate dropped to 8.9 per 100,000. Last week's unadjusted case rate was 8.7 per 100,000.According to the reopening plan, a county has to report data exceeding a more restrictive tier's guidelines for two consecutive weeks before being moved to that tier. A county then has to be in that tier for a minimum of three weeks before it may move to a less restrictive tier.Even as the number of cases continues to climb, the testing positivity rate for the region continues to decline. From last week's data, it dropped to 2.6%, a 0.8% decline. It still remains high enough for this metric to remain in the orange tier. The state's health equity metric, which looks at the testing positivity for areas with the least healthy conditions, increased from 5.3% to 6.5% and remained in the red tier. This metric does not move counties backward to more restrictive tiers, but is required to advance.Of the 14,663 tests reported Friday, 4% returned positive, increasing the 14-day rolling average of positive tests to 3.8%.Of the total number of cases in the county, 4,154 -- or 6.6% -- have required hospitalization and 947 patients -- or 1.5% of all cases -- had to be admitted to an intensive care unit.Four community outbreaks were reported Friday. The number of community outbreaks in the past week increased to 48.The county launched a COVID-19 case rate map Thursday showing how cities and communities are being impacted by the novel coronavirus. The interactive map allows users to identify the case rate per 100,000 residents in cities and communities or by ZIP codes. The map also shows where each area falls under the different state tiers and whether their case rate and testing positivity are going up or down.
