After 18 months of deliberation and public consultation, legislators passed the long-awaited Labor Contract Law on Friday to improve workers' basic rights. The law, which would take effect on January 1 next year, won 145 of the 146 votes of the Standing Committee of the National People's Congress (NPC). One vote was not cast. The new law is considered the most significant change in the country's labor rules in more than a decade. It establishes standards for labor contracts, use of temporary workers and severance pay. It makes mandatory the use of written contracts and strongly discourages fixed-term contracts. According to the law, severance should be paid if a fixed-term contract expires but is not renewed without an appropriate reason. It is also stipulated that employers must submit proposed workplace rules or changes concerning pay, work allotment, hours, insurance, safety and holidays to the workers' congress for discussion. After the recent exposure of forced labor in brick kilns in Central and North China, the final draft added stipulations that government officials guilty of abuse of office and dereliction of duty would face administrative penalties or criminal prosecution. Xin Chunying, deputy chairperson of the NPC Law Committee, said the law is not intended to replace the current Labor Law but rather, to further standardize labor contracts in favor of employees. Li Yuan, one of the legislators in charge of drafting the law, said the law targeted bosses and officials who exploited workers. The draft law was first proposed in 2005 amid complaints that companies were mistreating workers by withholding pay, requiring unpaid overtime or failing to provide written contracts. Many workers were also becoming trapped in short-term contracts. Last March, the draft was made public for consultation, and legislators received about 192,000 public responses in a month. Only the Constitution, drafted in 1954, received more. However, business lobbies are worried that stricter contract requirements could raise costs and give them less flexibility to hire and fire employees. Both the European Union Chamber of Commerce in China and the American Chamber of Commerce in Shanghai (AmCham Shanghai) had made submissions to the NPC, suggesting the law might exert negative influence on foreign investment in China. In a letter to the NPC last year, Serge Janssens de Varebeke, then-president of the European Union chamber, warned the "strict" regulations could force foreign companies to "reconsider new investments or continuing their activities in China" because of possible cost increases. But Xin said there wouldn't be a substantial cost increase for companies that strictly follow the existing Labor Law. "All the principles have been included in the current law. The new law just details the provisions to facilitate implementation," she said.
BEIJING, March 21 (Xinhua)-- Personal computer giant Dell Inc. said Thursday that it will raise parts purchases from China by 27.8 percent this year, increasing its presence in the booming market. Dell is to buy 23 billion U.S. dollars worth of computer components and other equipment from Chinese suppliers this year, compared with 18 billion U.S. dollars in 2007, said Michael Dell, chief executive officer of the PC giant, at a press conference. However, Dell's Beijing representative office denied reports that the company was planning to buy 29 billion U.S. dollars of computer parts from China in 2009. To secure a bigger share of the Chinese market, Dell broke with its Internet sales model and sealed a deal in September to sell PCs through the country's top electronics retailer, GOME Electrical Appliances. Dell saw its PC shipments in China up 54 percent year-on-year in 2007. The company plans to expand its retail outlets from 45 cities in 2007 to 1,200 by the end of the year. China, where Dell ranks third in terms of market share, is one of the company's fastest growing markets, said Michael Dell. Dell has two factories in Xiamen, a coastal city in southeastern Fujian Province, a design center in Shanghai and a customer contact center in Dalian, a northeast coastal city, with more than 6,000 employees in China. Meanwhile, Dell estimates it will contribute more than 50 billion U.S. dollars to China's gross domestic product (GDP) this year, and provide about 2 million jobs. Dell also said it would donate 1.7 million yuan (239,436 U.S. dollars) to build six education centers in China to teach computer skills to migrant workers' children.
BEIJING -- China's education officials are joining with employment authorities to mount investigations into reports of agencies and individuals who lure minors to work, said the Ministry of Education on Thursday."We have received reports that some agencies and individuals lured minors to work on the pretense of introducing them to part-time jobs or internships," said the ministry in a circular.Education authorities across the country will join with officials who have law enforcement powers in labor departments and commerce and industry administrations to intensify supervision and management to stop illegal employment of minors by agencies and individuals, it said.The ministry asked its local branches and all schools to be aware and report illegal employment to the authorities.Chinese law bans minors under the age of 16 from working and those between 16 and 18 must be given easier and safer work than adult workers.Employers who violate the law can be fined and, if the crime is serious, their business licenses will be withdrawn.In June, private brick kilns in north China's Shanxi Province were found abusing workers, many of whom were underage, in a forced labor scandal.A total of 95 officials in the province have been punished in the wake of the forced labor scandal.The ministry also warned vocational schools not to violate regulations on internships, which ban students from interning during their first year.Most vocational schools in China take in students who finish three years in secondary school, but do not go to high school.In 2004, a private vocational school in southeast China's Jiangxi Province was caught luring first-year students to work full-time in an electronic hardware factory during their summer vacation by promising free tuition.
A vice-governor of China's central bank, Xiang Junbo, is expected to take the helm at the Agricultural Bank of China (ABC) to steer it through its shareholding reform in order to secure a market listing.It is not clear what post the People's Bank of China's Xiang will take but Caijing magazine, a leading financial publication, reported that the 50-year-old would be appointed as the governor and the chairman of the board upon the accomplishment of the shareholding reform.Analysts say the new appointment will not lead to immediate moves such as inviting strategic investors or financial restructuring as the bank is widely known to be the worst hit by massive lending to the rural sector, with a non-performing loan rate of 23.43 percent at the end of 2006, far higher than those of the other three state commercial banks, which have all been listed in Hong Kong and domestic A share markets.Before being promoted to the post of vice-governor of the People's Bank of China in July 2004, Xiang spent eight years with the National Audit Office. His background will be constructive to strengthening the risk control of the ABC, analysts say.China initiated the reform of the "big four" banks after the first national financial work conference in 1997. The country's fast-developing tourism industry is expected to boost the hotel sector, a senior official has said.About 200,000 new hotels, resorts and guesthouses are likely to be built by 2015, head of China National Tourism Administration (CNTA) Shao Qiwei said on Thursday.Addressing a seminar on domestic and international hotels' groups, he said the new structures will include about 10,000 star-rated hotels. The number of five-star hotels in the country is expected to rise from 361 to 500."The World Tourism Organization has forecast that China will grow into a huge tourism market, and have 100 million each of inbound and outbound visitors and 2.8 billion domestic tourists by 2015," he said.The booming tourism market has created the need for new hotels and other infrastructure facilities, he said.The Shangri-La Hotels and Resorts plan to open five new facilities in the country this year, and at least 13 more in big cities such Beijing, Shanghai and Xi'an in the near future, the general manager of Traders Hotel at China World Trade Center in Beijing, Xin Tao, said.In fact, the group plans to open at least 40 new hotels in the country by 2011."The Olympic Games has brought us unlimited business opportunities and the increase of leisure, as well as business, travel in China will add to the appeal of hotel operators," she said.Investment from home and abroad into hotels will hit 340 billion yuan (.14 billion) between 2006 and 2010, the CNTA has forecast.The hotel sector was one of the first to be opened up in China, with Jianguo Hotel in Beijing being the first foreign-invested hotel to be approved by the State Council in 1979.Since then, 67 hotel brands of 41 international groups have entered the country and are managing 516 hotels at present, according to CNTA statistics.The hotel business has been expanding over the past three decades, and by the end of last year there were more than 14,000 star-rated hotels, 100 times more than in 1978.
