SAN DIEGO, Calif. (KGTV) -- A group of University City residents is suing the city of San Diego over its plan to pump sewage under their neighborhood to be turned into tap water. The nonprofit University City Community Foundation filed the lawsuit after raising ,000 from residents to challenge the environmental impact report for the city's Pure Water pipeline. The suit doesn't challenge the city's goal of making heavily treated reclaimed water one-third of its supply by 2035. The city says that will protect against future shortages and price increases. The lawsuit, however, says the city did not explore alternatives and did not adequately notify the public of the project's pipeline. It will pump sewage from the Morena Area, through Clairemont and University City, to a treatment plant at UTC. "There's no 100 percent guarantee that there could not be a leak, there could not be some discharge," said U.C. resident Barry Bernstein, who supports the lawsuit. "There could be some discharge. There may be some problems with the purification system."Ruth DeSantis, who heads the foundation, said the city and foundation are now in settlement talks. A city spokesman declined to comment on the lawsuit, but said there are multiple protections in place - including a system designed to immediately cut off to avoid sewage geysers. SAN DIEGO, Calif. (KGTV) - Wild and violent parties at short-term vacation rentals like Airbnbs continue to make headlines. This past Spring in La n la Jolla, gunfire erupted during a party at an Airbnb mansion, terrifying neighbors. Team 10 investigative reporter Jennifer Kastner has spent weeks looking into whether vacation rental platforms are doing enough to protect our San Diego communities. Popular platforms Airbnb and Vrbo notified 10News that they do background checks, but the system isn’t infallible. Meanwhile, some local safety advocates say that the City of San Diego is, in part, to blame for the problem.10News’ cameras captured the chaos and cop cars on La Jolla’s Blackgold Road after shots rang out in May at a multimillion-dollar mansion that was being rented out on Airbnb. After filing a public records request, 10News recently learned new details from a report released by police. The report describes the "shell casings in the street," "[subjects] refusing to come out," and "[subjects] running upstairs."“I moved here actually 43 years ago,” says Val Arbab. The 87-year-old lives across the street and says the mansion is often rented out for big, loud parties. “It’s always many, many people. It's always adults. I only see males,” she tells us.Arbab and other neighbors say that partygoers clutter the street with cars and trash. The mansion owner declined an interview with 10News.Short Term Vacation Rentals (STVRs) have made headlines across the country after parties at STVRs got out-of-control. Security video from an STVR in Arizona shows a huge crowd. Partiers are seen leaving with the homeowner’s personal belongings, like his clothes. “[I was] watching my house and [I was] seeing them carry out item after item after item,” the homeowner later told a news crew. Security video from Sacramento shows someone firing off a handgun at a party hosted in an STVR. In Arizona, video obtained by a local news crew shows crime scene tape woven through a neighborhood where, earlier, a party at an STVR turned into a fight, leaving a young man dead.Other news crews captured video out of Pennsylvania after a party at an STVR became violent. “A dozen or so gunshots woke me up,” said a neighbor.Ann Kerr is the President of the La Jolla Town Council. We met at her home, a few miles south of the mansion where shots rang out. She's Chair of the San Diego Working Group on Short Term Rentals, which is pushing for better regulation of STVRs.“Our fundamental policy is that we welcome [STVRs] but not at the degradation of the quality of our neighborhood and we want good neighbor policies enforced,” says Kerr.The San Diego Working Group on Short Term Rentals has released 2019 recommendations for STVR regulations. These include establishing a new enterprise fund dedicated to the administration, monitoring, and enforcement of STVRs. The fund would hold all fees, taxes, and fines from the STVR industry. It would be used to help with operations related to permitting, monitoring, and enforcing STVRs. Another primary recommendation to deal with noise and nuisance is to assign STVR complaints to special STVR code compliance officers in an effort to relieve sworn police officers and regular City code compliance officers from responding to STVR issues. The status of STVRs remains a gray area in the City of San Diego. They're technically not permitted, but no one is cracking down on them until the Mayor's office and City Council adopt a resolution on how to regulate and enforce. “Who's enforcing this?,” we ask Kerr. She responds, “That's the whole question. Who's enforcing any of this? No one is right now,” she tells us.The San Diego Working Group is urging the City to adopt its recommendations as a new ordinance. “The longer that the politicians wait to put some kind of enforcement and compliance system in, the more vacation rentals will be established,” she says. She explains that in that time, the less peaceful neighborhood could become.Both Airbnb and Expedia Group (Vrbo and Homeaway) have an online submission form where neighbors can report concerns. An Airbnb spokesperson writes, “The overwhelming majority of Airbnb hosts and guests are good neighbors and respectful travelers. We encourage hosts to outline clear rules regarding minimum night stays, noise, parties, and events and we will take appropriate action -- including suspension or removal -- when our Community Standards have been violated.” On the issue of background checks, Airbnb writes, “While no background check system is infallible, we screen all hosts and guests globally against regulatory, terrorist, and sanctions watch lists. For United States residents, we also run background checks looking for prior felony convictions, sex offender registrations, and significant misdemeanors. We are working with additional governments around the world to identify where we can do more background checks.”A spokesperson for the Expedia Group writes, “We use technology to verify user accounts, giving travelers confidence in the authenticity of owner identities, and we conduct certain background screenings where we're able to. Although we take steps to confirm the identities of our community members, we advise travelers to always read owner profiles and reviews. We will continue to make investments to build impactful trust and safety policies, solutions and support. We support owners by educating them about best practices for creating safe and private spaces for travelers, and we use technology to verify the identities of owners and travelers whenever possible. We advise our community to follow state and local laws that may apply.”The San Diego City Attorney’s Office writes, “Short term rentals are not permitted under the San Diego Municipal Code. However, the Code Enforcement Division of the Development Services Department has not referred to our Office any cases for prosecution. Proposals such as the ones you listed fall under the jurisdiction of the City‘s policy makers, the City Council and Mayor, and can be addressed by them.”Mayor Kevin Faulconer’s Office sent 10News the following statement. "Following through on his commitment, the Mayor introduced a common-sense plan to regulate short term rentals last year. The Council adopted that framework but made modifications, which ultimately resulted in a referendum that prompted the City Council to rescind the ordinance. Our office continues to believe the Mayor’s original proposal was a fair compromise, and will continue meeting with stakeholders to determine if there is a legislative solution to this issue."In a follow-up email, his Office wrote, in part, “…the Mayor has always supported using revenue generated from fees applied to short-term rentals for code enforcement…Mayor Faulconer is committed to active enforcement to ensure hosts, guests and online platforms for short-term rentals are in compliance with the new regulations. That includes a new team of police and code enforcement officers to work evenings and weekends to address code complaints; the creation of a license and registration system that interfaces with City databases; and a new complaint hotline or mobile application for residents to report violations…”We asked the Mayor’s Office and other City communications officers for an update on when the issue of STVRs will be on the Council agenda again, so that a decision can be made about how to regulate and enforce them. SAN DIEGO (KGTV)— The man accused of raping and torturing a woman in his home in Rancho Penasquitos faced a judge today. 32-year-old Uber driver, Seyed Hassan Kaboli pleaded not guilty to 12 counts of sexual crimes. Kaboli peaked through his holding cell, as the judge announced his fate. San Diego Police said Kaboli bound, raped, and tortured a woman, multiple times at his home in Rancho Penasquitos on May 19th and 20th. Sky10 footage showed the victim being consoled by the police on Monday, and she said she ran naked to escape 24 hours of brutal misery. The next day, Kaboli was arrested just north of National City. 10News obtained a copy of the criminal complaint, explaining Kaboli’s 12 felony charges. They include:(5) Forcible oral copulation (2) Rape(1) Rape by a foreign object(1) Torture(1) Assault with great bodily injury(1) Sexual battery(1) False imprisonmentThe complaint also suggests that there may be another person involved in the crimes. Under count three, it reads Kaboli “inflicted aggravated mayhem and torture on the victim and another person.”Under count eleven, it reads “said person was unlawfully restrained by said defendant and an accomplice.”In the courtroom, neither the defense nor the district attorney would comment on a possible third party.Still, the judge issued a protective order for the victim— a woman, whose relationship was not disclosed. But Kaboli’s defense attorney said she was not his Uber customer. “There is no prior relationship,” Kaboli’s attorney, Ryan Tegnelia said. “He is not denying that they came into contact with each other on the date of the incident. But before that, they did not have any relationship.”Tegnelia said Kaboli’s family describes him as an introverted man who keeps to himself. They said they are shocked at his arrest. “This obviously came completely out of left field for them, caught everybody by surprise,” Tegnelia said. The judge set Kaboli’s bail amount at 0,000. SAN DIEGO (KGTV)-- It's been more than a year since the first legal cannabis transaction took place in the City of San Diego. Marijuana industry professionals gave members of the City Council an update on revenue, but also pushed for updated laws.The City if San Diego found out that going green generated green. Since San Diego voters approved of Measure N or the Cannabis Business Tax in 2016, the City’s general fund has increased by .3 million. It's the culmination of a 5% tax from the 14 legal pot shops within the city in 2018.Dallin Young with the Association of Cannabis professionals also updated Council members that crime numbers around marijuana establishments are close to none. However, Young also expressed the industry's hopes for updated city rules. He said the permits are a massive hurdle for pot shop operators. As it stands now, both public retailers and harvesting facilities are only permitted in areas one thousand feet from parks, schools, and churches, 100 feet away from residential areas, and they must be in industrial zones. “Those properties are a little more expensive, they’re off the beaten path, and there are not many available," Young said. Because of these strict rules, Young said future operators struggle to open. More people are applying for permits than what the city has made available. He said the supply and demand for marijuana facilities in the city of San Diego do not align. “We’re just asking for this business and industry to be treated like any other business when it comes to commercial sales," Young said.The industry is also asking the city to consider a place for customers to use their products. Now, people can only smoke pot products if they own their home, or if their lease allows for pot smoking. That is why Young is suggesting the city to approve the opening of a pot version of a hookah bar.“[We are asking for] Consumption at these retail locations or a separate use like a cigar bar or more like a tasting room for a brewery,” Young said.Lastly, Young is hoping the city extends the operating hours for pot shops to match the State's. Currently, the city only allows pot shops to operate between 7 am and 9 pm. The State of California allows for sales between 6 am and 9 pm.“We want to make sure that this industry is thriving and it does well. So if it’s one extra hour, that’d be great," Young said. Young understands that changing rules for a new industry is not easy. But he is hopeful with small changes, it will shift the industry away from illegal sales."I think a lot of people would rather go to a licensed facility than to someone down the street," Young said. 2650
San Diego will seek to invalidate its landmark pension law, a citizens' initiative 65 percent of voters approved in 2012.The City Council voted 6-3 Monday to go to court to invalidate 2012's Proposition B, which switched most new hires from a pension to a 401(k) style plan. The decision came after multiple courts ruled the city skipped a key step in the campaign. The courts said then-Mayor Jerry Sanders' involvement meant the city needed to meet and confer with unions, but didn't. The courts required the city to make employees whole plus a seven percent penalty, but didn't invalidate the law. The city will now to go to court along side its employee associations to get it off the books. "It's illogical for the city to believe that having broken the law in order to get Prop B into the charter that you should be allowed to keep it in there," said attorney Ann Smith, representing the Municipal Employees Association. Firefighter John Hernandez II said he's seen a number of his colleagues leave for other departments, which offer better benefits - namely a pension."In my line of work, we can't work as long as most people, and that's why we need pensions," he said. But Councilman Scott Sherman, who voted to protect Prop B, said ultimately going back to pensions could cripple the city. "Every single year we make a 0 million minimum payment on our pension debt from the old system that too us to that point, and now they're asking us to go right back to that system," he said.Sherman said it's low unemployment, not a lack of benefits, leading to the city's worker retention issues.
