SAN DIEGO (CNS and KGTV) - San Diego's City Council voted 6-3 Tuesday night to place restrictions on sleeping and living in vehicles on city streets and parking lots.The vehicle habitation ordinance goes into effect immediately and restricts people from living in their vehicles anywhere within 500 feet of a school or residence. It also places an overnight ban between from 9 p.m. to 6 a.m. anywhere in the city, with the exception of approved lots. According to a news release from the city, the ordinance aims to address illegal dumping, public urination and drug use on city streets and in parking lots. “We are creating a balance that provides opportunities to those in need while protecting our neighborhoods from behavior that creates unsanitary conditions and hurts quality of life,” Mayor Faulconer said. “If you want to work toward finding a permanent home, we have programs that can help. We will not allow the proliferation of ‘van life’ culture that takes advantage of San Diego’s generosity and destroys community character.”The ordinance will be enforced using criteria including sleeping, bathing, meal preparation, grooming items and containers of human waste. SAN DIEGO (AP) — A judge delayed the court-martial of a Navy SEAL accused of murder on Wednesday while lawyers resolve questions over whether the government's monitoring of emails compromised his right to a fair trial.Lawyers defending Special Operations Chief Edward Gallagher want the judge in the case removed because he was aware prosecutors planted tracking software in emails sent to the defense team and a journalist in an effort to find the source of news leaks."What we believed is that the judge authorized prosecutors to spy on the defense team," attorney Tim Parlatore said after the hearing. "Now looking at things it appears that prosecutors may have lied to the judge and that he didn't authorize it and he didn't know what they were really doing."Gallagher, who was dressed in Navy whites at the hearing, was scheduled to face trial May 28 on charges he killed a wounded Islamic State prisoner under his care in 2017. He is also charged with shooting two civilians in Iraq and opening fire on crowds.Now that date is uncertain as the defense tries to learn more about the email tracking and whether it violated the attorney-client privilege and protections against illegal searches.Parlatore said leak investigation documents he was provided show the effort was done without a search warrant or proper authorization.Parlatore asked who else knew about the email tracking and Judge Capt. Aaron Rugh told the prosecution to provide a list of "anybody that put their hands on this."Dozens of Republican congressmen have championed Gallagher's cause, claiming he's an innocent war hero being unfairly prosecuted. SAN DIEGO — A College Area nonprofit that is seeing record requests for its services may not survive the pandemic itself.Sharia's Closet provides free clothes to people who have an emergency need. Founder Shamine Linton said with the Coronavirus pandemic, the organization has already served more than 2,500 families in 2020, a record pace. "Due to unemployment, homelessness and domestic violence, our needs have grown," Linton said. Sharia's Closet, named for Linton's daughter, operates out of a former dental office near San Diego State University. It's divided into five rooms that are filled with clothes for children, teens, men and women - casual to professional. Linton said the organization gets connected to families through 54 social service organizations. While the demand is at an all-time high, the prospects of surviving past 2020 are not. "I don't think I'll have the money to continue for the next year," Linton said. Linton said the organization survives off community donations, but those have lagged in this economy. She has reduced hours for her staff of two, and the closet is now only open three days a week. The formerly manageable ,500 in monthly operating costs is now becoming daunting. "I'm hoping for financial donations to help keep our doors open, to help keep the service for the community that needs it the most," Linton said.Linton said Sharia's Closet has been able to receive public assistance for personal protective equipment, but not operations. SAN DIEGO (CNS) - A 30-year-old man was killed when he lost control of his motorcycle and crashed into a fire hydrant in a neighborhood north of Scripps Ranch, police said Thursday.The crash was reported around 4:20 p.m. on Stonebridge Parkway near Stockwood Cove, off Pomerado Road in the Rancho Encantada neighborhood, San Diego police Officer John Buttle said.The victim was riding his 2019 Indian Scout motorcycle between 80-100 mph eastbound on Stonebridge Parkway when he lost control at a curve in the road, jumped the curb and slammed into a fire hydrant, Buttle said.The rider was ejected onto the roadway and pronounced dead at the scene, he said. SAN DIEGO (CNS) - A bicyclist riding with a group of cyclists was seriously injured Saturday when he was struck by a motorcycle in Pacific Beach, police said.The collision happened at 3:14 p.m. Saturday at the intersection of Ingraham Street and Reed Avenue, according to Officer John Buttle of the San Diego Police Department.A 23-year-old man riding a 2017 Harley Davidson Sportster was southbound in the 4200 block of Ingraham as a group of cyclists were eastbound in the 1500 block of Reed Avenue, Buttle said.The cyclists entered the intersection and the motorcycle struck one of them, a 49-year-old man, the officer said.The motorcyclist suffered road rash to his right leg, Buttle said. The bicyclist suffered a broken left femur and broken ribs. Medics took the cyclist to a hospital.Officers from the SDPD traffic division were investigating the collision, Buttle said.Ingraham was closed in both directions at Thomas and Oliver avenues and was expected to last a couple of hours, the SDPD said. 1012
