Walmart and Target are being sued for allegedly selling toys with lead levels up to 10 times more than the federal limit of 100 parts per million, New York Attorney General Barbara D. Underwood announced on Thursday. According to a statement released by Underwood's office, the AG's office was able to find Cra-Z-Jewelz jewelry-making kits from stores. The kits allegedly contained lead at levels of 120 to 980 parts per million. The Attorney General's office had further independent testing done to confirm the results. The toy's maker, LaRose Industries, which is also a plaintiff in the New York lawsuit, issued a national recall. Underwood's office is accusing Walmart, Target and LaRose of "repeated illegality and fraud under New York State law by committing thousands of violations of state law prohibitions on importing, distributing, and selling hazardous toys; deceiving consumers; and false advertising."Underwood's office is seeking civil penalties of  to ,000 for each Cra-Z-Jewelz kit the companies sought to sell in the state.“No parent should have to worry that their child’s toy may be toxic. (KGTV) -- The San Diego District Attorney is expected to decide later this week whether there should be a new trial in the case of Kellen Winslow Junior.Tuesday morning, the judge declared a mistrial after the jury said it was deadlocked on eight remaining counts. The counts include kidnapping, forcible rape and forcible oral copulation involving a hitchhiker last year in Encinitas and forcible rape and rape of an unconscious person for an alleged attack on a teenager at a party in Scripps Ranch back in 2003 when she was 17 and Winslow was 19. The other counts the jury deadlocked on are willful cruelty to an elder and battery against an elder. The prosecutor said the jurors were leaning toward conviction. "On each one of the counts, there were a majority of jurors who voted in favor of guilt. They voted 10-2 in favor of guilt on forcible sodomy of Jane Doe 2. They voted 10-2 in favor of guilt for the forcible rape of Jane Doe 4. They voted 10-2 in favor of guilt on the counts of elder abuse and elder battery regarding Jane Doe 5 and then they voted 8-4 in favor of guilt on the rape of an unconscious person for Jane Doe 4 and they voted 7-5 in favor of guilt on the kidnap for rape, forcible oral copulation and and forcible rape of Jane Doe 1," said Prosecutor Dan Owens. Defense attorneys said the deadlocked jury shows there were credibility issues among the accusers. Jurors also found the former NFL tight end guilty of indecent exposure and lewd conduct involving two other women. He was acquitted of a second count of lewd conduct involving one of those women. Watkins said they'll appeal the three convictions. "We won't be satisfied until he's exonerated and he's back home with his family," said Watkins. Sentencing is on hold until a decision is made about a new trial. Winslow's father, Kellen Winslow Senior, a Chargers Hall of Famer attended every day of the trial, but declined to talk to the media. A hearing is scheduled for 10 a.m. Friday on setting a new trial. (KGTV) - The mother of a 14-year-old girl sexually assaulted by a San Diego Deputy filed a civil lawsuit citing negligence and invasion of privacy.Deputy Timothy Wilson pleaded guilty to lewd acts on a minor and two counts of unlawfully taking computer data. He’s serving jail time. The victim’s mother, Jennifer Tanis, says Wilson accessed her daughter’s police file 44 times. He was able to get her home address, videos, and pictures of her daughter. She tells 10News she’s suing the county, not for money, but change. Currently, all deputies are allowed to access police files, but she thinks the only person who should have access to them is the lead investigator.She says the county failed her.“There was no system in place to protect my daughter, her story or the pictures they took of her during the investigation," Tanis said.Tanis is pushing for change not only in the county but the entire country. She reached out to Congressman Mike Levin’s office for help. San Diego County has said they have the capability of making police reports private, but only in some cases.
