A federal judge has dismissed adult film star Stormy Daniels' defamation lawsuit against President Donald Trump.Daniels sued Trump after he said Daniels' story of a man threatening her not to come forward with her story of her alleged affair with Trump was "a total con job."Daniels argued Trump's tweet "attacks the veracity of her account" of the incident and that Trump's statement was "false and defamatory, and that the tweet was defamation ... because it charged her with committing a serious crime," District Judge S. James Otero wrote in his opinion Monday.Trump had asked Otero to dismiss the lawsuit."The Court agrees with Mr. Trump's argument because the tweet in question constitutes 'rhetorical hyperbole' normally associated with politics and public discourse in the United States. The First Amendment protects this type of rhetorical statement," Otero wrote.Daniels says she and Trump had an affair in 2006, shortly after he married first lady Melania Trump and she gave birth to their son, Barron. Trump has denied the affair.In addition, Trump is entitled to attorney's fees, Otero said.Trump's attorney Charles J. Harder said in a statement to CNN, "No amount of spin or commentary by Stormy Daniels or her lawyer, Mr. Avenatti, can truthfully characterize today's ruling in any way other than total victory for President Trump and total defeat for Stormy Daniels.""The amount of the award for President Trump's attorneys' fees will be determined at a later date," Harder added.Daniels' attorney, Michael Avenatti, responded to the ruling on Twitter and said: "Daniels' other claims against Trump and Cohen proceed unaffected. Trump's contrary claims are as deceptive as his claims about the inauguration attendance.""We will appeal the dismissal of the defamation cause of action and are confident in a reversal," Avenatti continued. 1860

And we're helpless in this situation," said Lester.Also still in the hospital, 19-year veteran Joe Aldecoa, who at one point was in the ICU with a 105-degree fever.The International Association of Fire Fighters (IAFF) is tracking members impacted by the virus; the newest numbers from the U.S. and Canada show more than 20,800 have reported being exposed.The labor union advocates on behalf of fire departments, some of which are still struggling to afford enough personal protective gear.And now, some states are requiring firefighters to help with COVID-19 testing in nursing homes, a job they may not have been trained to do before the pandemic. A long-running dispute between scouts has now ended up in a Manhattan court.The Girl Scouts of the USA has filed a trademark infringement lawsuit against the Boy Scouts of America after it announced that it would drop "boy" from the name of a program in 2019. The boys' group has already begun to welcome older girls.The Girl Scouts said in the complaint filed in Manhattan federal court Tuesday that the Boy Scouts do not have the right to use "scouts" or "scouting."It also alleged that the Girl Scouts brand and activities will be marginalized by the Boy Scouts rebranded program, Scouts BSA. 603

  

A Dallas police officer died Wednesday morning, a day after he and a colleague were shot at a Home Depot, police said.Officer Rogelio Santander, a three-year police veteran, passed away at 8:11 a.m. of his injuries."We ask that you please continue to pray for Officer Santander's family and our department as we all try to cope with this tragic loss," police said on the department blog.Officer Crystal Almeida and loss prevention officer Scott Painter also were shot in the Tuesday incident. They remain in critical condition, but are improving."Prayers for their recovery are still appreciated," police said. "Thank you to our community and everyone at Presbyterian Hospital for your love and support during this time."The suspect, Armando Juarez, 29, was captured after a car chase that started in southeastern Dallas and ended in the northeastern area of the city.Mayor Mike Rawlings thanked police officers from Dallas and other agencies for their efforts in searching for the gunman."Incredible police work," he said on Twitter. "It sobers us to realize what our officers walk into day in and day out and how quickly they can become victims."Police said Juarez was to be charged with at least two counts of aggravated assault on a public servant and two previous felony theft warrants. Additional charges may be added, police said.Bond for Juarez has been set at million, according to jail records.The incident began Tuesday afternoon after an off-duty officer at the Home Depot called to request backup officers for an arrest.It's unclear how the shooting unfolded but authorities began looking for the gunman after he fled in a white pickup truck, police said.The officers who responded to the call were wounded, police said.Nearly two years ago, five Dallas officers were killed and seven others wounded when a military veteran who had served in Afghanistan fired on them.That shooter, Micah Xavier Johnson, 25, of Mesquite, Texas, was killed after a lengthy standoff with police.  2006
