SAN DIEGO (KGTV) - The family of a YouTube star who drove his McLaren the wrong way on the 805 last year, killing a mom and her daughter, are suing the City of San Diego, County of San Diego, and the Psychiatric Emergency Response Team (PERT).The lawsuit claims the “horrific and tragic event” was entirely preventable.Eighteen-year-old Trevor Heitmann, known as McSkillet, drove his McLaren the wrong way on the freeway in August 2018, killing Aileen Pizarro and her 12-year-old daughter Aryana. The sports car collided with the family's SUV, which burst into flames.RELATED: Autopsy details mental state of McSkillet before deadly crash on Interstate 805 in San DiegoIn the lawsuit Heitmann's family claims "SDPD was warned by Plaintiff's on the day of, but before his death, that Trevor intended to drive his McLaren at a high rate of speed in the wrong direction on a public roadway, under the delusion that he (Trevor) could drive through vehicles traveling in the opposite direction without incident."Worried about their sons' dangerous intentions and fearing for his well-being, as well as the safety of others, Dr. Mary Rusher, a board-certified psychiatrist, called 911 and made a 5150 request for a psychiatric hold, the lawsuit alleges.The lawsuit claims, "Defendants' purported PERT response team conducted either or both no assessment or the wrong assessment of the mental health status of Plaintiffs' son Trevor, pursuant to and under California Welfare and Institutions Code 5150."RELATED: YouTuber's parents requested psychiatric evaluation before deadly I-805 crashIt alleges, defendants also failed and refused requests to take Heitmann into protective detention to transport him to a designated evaluation and treatment facility."As a consequence, and despite Plaintiffs' attempts to ensure their son's safety and the safety of others by blocking the driveway of their residents, Trevor later that day left his residence and drive the McLaren to the Interstate 805 Freeway where he was killed in the beforementioned collision, which also tragically took the lives of the Pizarros."A spokesman for the County of San Diego told 10News they couldn't comment.RELATED: Son remembers mother and sister after release of driver's autopsy in deadly 805 crashAs of this writing, officials with the City of San Diego and PERT have not responded to 10News requests for comment.This is the third lawsuit filed regarding the 2018 crash. SAN DIEGO (KGTV) — The downtown building at 101 Ash Street has been sitting vacant for most of the last four years and as it continues to sit empty, taxpayers are footing the ,000 per day bill.City Council leaders voted 5-4 — with Council members Vivian Moreno, Monica Montgomery, Barbara Bry, and Georgette Gómezto voting in opposition — to request monthly updates on the building's status and costs for several options presented by Mayor Kevin Faulconer's office.The mayor's options included putting millions of dollars more into the building for the needed repairs, buying out the lease, pursue a new landlord, trying to renegotiate its lease, or walking away entirely, the last of which could risk litigation and credit damage.The coronavirus pandemic has cleared out office buildings across downtown San Diego. But emptiness is business as usual for the old Sempra building at 101 Ash.In 2016, the city approved a lease-to-own agreement for the building, valued at million. The idea was to move upwards of 1,100 city employees into the facility.But officials quickly discovered a series of problems requiring major renovations to the site's 19 floors.In December 2019, the city finally began moving workers into the building, only to vacate them a month later when the county found traces of asbestos.So how did the city get into this mess? A new investigation shows it really never did its homework for such a big purchase from the start.The law firm Hugo Parker found that, "at no time, however, did the city formally inspect 101 Ash before closing escrow."In January, councilmember Barbara Bry showed ABC 10News a document that the city accepted the property as is."That is stupid to do when you are doing a long-term lease purchase on a building that was built in the 1960s," Bry said.An additional new report from Kitchell says the building needs 5 million of repairs, which is well more than what the city paid for it. 1947

SAN DIEGO (KGTV) - The community is rallying around a North Park Church that provides shelter for homeless youth, Lead Pastor Brandan Robertson said Thursday night at their prayer vigil.The Missiongathering Christian Church was slapped with 29 violations from the City, and told it needed to re-zone to accommodate their music venue, "The Irenic". They were also told to shut down their homeless youth shelter that provides a hot meal and place to sleep Tuesday nights, unless they purchase a conditional use permit."...because the Code says churches can only host shelters 30 times a year without a permit, and we host our shelter 50. A CUP could cost an upwards of ,000 just to cover the 20 extra nights per year that we provide a safe space for homeless youth," the Gofundme raising money for the church stated.The church quickly remedied 7 of the violations, "new fire extinguishers, we put in fire and smoke and CO2 detectors in the area where the youth sleep. We've gone around and fixed panels that are down, put in new exit signs, posted the occupancy in all the rooms," Robertson said.Robertson said they didn't know they were in violation and the fire department completes an inspection every year.Robertson said their concerts pay the mortgage. The church has lived at the corner of Polk Ave. and Illinois St. for 10 years. The concerts end by 10 p.m. to keep in accordance with city noise restrictions, a supporter added.Robertson said the trouble started when a neighbor complained about the noise and the shelter. Robertson said police came to the church multiple times, even on Easter Sunday and one morning, in the end of July, Robertson said eight City inspectors showed up. He said he got a message in the mail August 31st to shut down.The Gofundme raised more than ,000 in two days to help with legal fees. Robertson said they have hundreds of signatures on a petition and community members filled Councilman Chris Ward's voicemail.Dozens showed up to the church's prayer vigil Thursday, praying, singing and donating to the cause."The city hasn't been doing what they need to do, the church is leading in that area and we need to support them on every end," Aeiramique Glass Blake, Executive Director of Generation Justice said.Robertson said he was saved by the church when he was 12, "[I] grew up in an abusive alcoholic family in Maryland... went to this Baptist church and discovered a god who was a better parent than mine was." He said it's heartbreaking they can't help kids in similar situations.Blake said the community will show up to protect the church if they wish to keep their doors open next Tuesday night.Robertson said the city is working to find another place for the youth.Robertson said other groups are already planning benefits for Missiongathering and says he is touched by the outpouring of support. SAN DIEGO (KGTV) — The Border Patrol says it has experienced a major uptick in violence at the border since the arrival of the migrant caravan. Assaults against agents are up 300 percent compared to this time last year, according to San Diego Border Sector Chief Rodney Scott.An agent was struck in the face shield with a rock thrown at the border on New Year’s Eve and was not injured. “These incursions are organized they are bringing people down there for the express purpose of provoking a confrontation,” said Border Patrol agent Joshua Wilson. RELATED: Mexico urges thorough probe into border tear gas incidentWilson is also the executive vice president of the local Border Patrol agent union in San Diego and says the incidents are indicative of why they need more border wall funding. “Having that barrier helps prevent many assaults on agents and that's something the public really needs to understand,” said Wilson, “It’s not just a border security measure it’s a measure for agents safety as well.” Border Angels director and founder Enrique Morones says his group doesn’t condone any violence at the border but he doesn’t believe it’s the immigrants instigating things. “If you’re going to be going across the border to seek asylum, why in the world would you be throwing rocks at the border patrol,” said Morones. “The people… have been reacting to the Border Patrol violence of teargassing and shooting rubber bullets at migrants.” Border Patrol officials say they do not release official statistics from the specific sector level, hence the percentage. 1575

  

SAN DIEGO (KGTV) - The Food and Drug Administration has recalled several types of tattoo ink after determining they were contaminated with bacteria. One of them is the popular black ink made by Dynamic Color. The FDA found that two of their lots tested positive for microorganisms. The recall includes all bottles of Scalpaink SC, Scalpaink PA, and Scalpaink AL basic black tattoo inks manufactured by Scalp Aesthetics. One lot of Color Art’s red Solid Ink-Diablo was also included. Tattoo shops across the country were contacted through their local health departments about the recall. One of the largest tattoo parlors in San Diego, SD Tattoo, says they got the email Wednesday morning and immediately searched through their inks.They did have the Dynamic black ink, but tattoo artist Nicki Ninteman said, "We checked all the lot numbers and all of ours are clean, so we’re good."She said they didn't have either of the other two brands in the shop.According to the FDA, people who have been tattooed with contaminated ink can experience rashes or lesions of red papules.
