A family in the San Francisco area received a letter from their son’s middle school recently threatening the child’s arrest for missing 90 minutes of Zoom class, according to local media.“This is our fourth child going through this middle school and out of the blue, we got a letter,” Mark Mastrov told KGO.The letter alleges Mastrov’s son, age 12, missed three 30-minute Zoom sessions as unexcused absences. The district says that makes the boy a truant of the state and makes him “subject to arrest” or a fine."He can become a truant of the state and he could be arrested. I said, ‘Are you going to come and try to arrest my son at my home, or try to fine me for not getting him to his Zoom class perfect, on time, everyday?," Mastrov told KGO.Mastrov’s son spends up to seven hours a day attending virtual school. The middle school told KGO the letter was the result of new state guidelines passed this fall in California that require districts to keep a closer eye on student attendance.“The letter is part of our responsibility to the state for our student attendance review boards. As always, the schools have a responsibility to ensure students are engaged and learning,” Principal Betsy Balmat told KGO.Mastrov says he has heard from other parents in the district who have received similar letters. They are now writing lawmakers asking them to change the law."Obviously we're in a pandemic and Gov. Newsom is trying to manage it, but if the state of California is focusing on arresting twelve year old children for missing 90 minutes of school in ten months... it's ridiculous,” Mastrov told KGO.Like many schools, daily attendance numbers in California are used to determine state and federal funding levels. 1725

A federal judge ruled Monday Pennsylvania’s Governor Tom Wolf’s COVID-19 pandemic restrictions are unconstitutional.Four counties in the state filed a lawsuit claiming the governor’s orders closing non-life-sustaining businesses and limiting outdoor gatherings, and stay-at-home orders were unconstitutional. They stated the orders were "arbitrary, capricious and interfered with the concept of 'ordered liberty' as protected by the Fourteenth Amendment."Plaintiffs included hair salons, a drive-in theater, other businesses, as well as state representatives and congressman Mike Kelly. In his ruling, the judge says the governor’s actions likely had good intentions, “to protect Pennsylvanians from the virus," but that "even in an emergency, the authority of government is not unfettered."U.S. District Judge William Stickman IV ruling reads, “"(1) that the congregate gathering limits imposed by defendants' mitigation orders violate the right of assembly enshrined in the First Amendment; (2) that the stay-at-home and business closure components of defendants' orders violate the due process clause of the Fourteenth Amendment; and (3) that the business closure components of Defendants' orders violate the Equal Protection Clause of the Fourteenth Amendment."In his written opinion, Judge Stickman continued his explanation of his ruling."There is no question that this country has faced, and will face, emergencies of every sort. But the solution to a national crisis can never be permitted to supersede the commitment to individual liberty that stands as the foundation of the American experiment. The constitution cannot accept the concept of a 'new normal' where the basic liberties of the people can be subordinated to open-ended emergency mitigation measures,” Stickman wrote."Rather, the Constitution sets certain lines that may not be crossed, even in an emergency. Actions taken by defendants crossed those lines. It is the duty of the court to declare those actions unconstitutional." 2007

A man shot by a Cuyahoga County, Ohio Sheriff's deputy near Cleveland on I-90 on Thursday has died. The medical examiner identified the man as Brett Luengo, 33, of Westlake, Ohio. He was transported to MetroHealth Medical Center where he was treated, expired and pronounced dead last night. Luengo was a prominent businessman who was the CEO and Vice President of ConstructAbility Inc., a construction services firm in Westlake. The Hispanic Chamber of Commerce awarded ConstructAbility with an award in 2017.The shooting took place along Interstate 90 near West Boulevard Thursday evening. The scene led to a major police presence and traffic back-up in the eastbound lanes between West 44th Street and West Boulevard. The deputy involved was not injured.Witnesses say the incident started after a single-vehicle crash. The driver then got out of the SUV and was acting both erratically and violently to those trying to help him. Authorities say he was involved in an altercation when the deputy exited his own vehicle. When the deputy approached, the sheriff said Luengo "charged (the deputy) in an aggressive manner.""He kept screaming to shoot him. The cop kept asking him to roll over, put your hands behind your back. The man was not cooperating. He kept trying to get up and attack the police officer, he kept lunging at him," witness Jason Geiger said. "I think what happened at that point he ran out of taser cartridges because at that point he shot the guy."Authorities say the deputy fired one shot. The Cuyahoga County Medical Examiner's Office confirmed the cause of death was a gunshot wound to the chest. The family of Luengo released the following statement on Friday afternoon: 1777
