Police say a white gunman opened fire at a Kentucky grocery store, killing two African-Americans, after he tried and failed to enter a predominantly black church nearby.Gregory Bush, 51 was indicted on five counts Wednesday, including murder and attempted murder; none of them were hate crime charges, despite comments from authorities that the shootings appear to be racially motivated.CNN has reached out to a public defender for Bush and is waiting to hear back.Prosecutor Tom Wine said that because Kentucky's hate crime statute does not include homicides, Bush was not charged with a hate crime for the deaths."A hate crime designation only occurs when the judge makes such a determination at sentencing. If the judge finds a hate crime designation is appropriate, it doesn't add any additional time. The designation is only useful if the judge wishes to deny probation or the parole board wants to defer parole," Wine said in a statement.Hate crimes are considered more difficult to charge and prosecute than other criminal charges, largely because they require law enforcement to prove a specific motivation of bias.Additionally, federal investigators are looking into potential civil rights violations, including hate crimes, said Russell M. Coleman, the US attorney for the Western District of Kentucky.Bush faces two counts of murder for the shooting deaths of Maurice Stallard, 69, and Vickie Jones, 67, inside the Kroger grocery store in Jeffersontown, and in the parking lot outside, Wine said.Bush is also charged with one count of attempted murder stemming from what authorities described as an exchange of gunfire with an armed civilian. (KGTV) - Dramatic body camera video recorded on the first day of Northern California's Camp Fire shows a Butte County Sheriff's deputy in what he thought would be the final moments of his life. BCSO Deputy Aaron Parmley was driving down Pentz Road in Paradise when his vehicle became disabled due to the firestorm. Parmley got out to run to safety.Fearing that he was about to die, Parmley switched on his body camera to document the situation the morning of Nov. 8.Video shows Parmley walking near a home and down the middle of a road with burning embers surrounding him. Other people, including a nurse and police officer, were walking nearby. Parmley's struggle to breathe in the heavy smoke is apparent.The life-saving moment happened roughly an hour and 14 minutes after Parmley turned on his camera. A bulldozer approached Parmley and the police officer, and both men got inside to be taken to safety.The Camp Fire went on to become the deadliest fire in California history, with 88 fatalities and 196 people missing as of Nov. 29. Police and other law enforcement are constantly trying to stay ahead of criminals, but sometimes technology can get in the way.Apple made headlines a couple years back, when the company refused to unlock a phone when asked by law enforcement.Then came Grayshift, a company that specializes in cracking iPhones.  "Apple's fighting these guys pretty hard,” says digital security expert Steve Beaty. “Has been a bit of a chess game right."Beaty is a digital security expert professor with Metropolitan State University of Denver."It appears that people aren't now able to break into the iPhone with the most recent release of version 12 of iOS," Beaty explains.While Apple isn't saying much about what they've done, law enforcement around the country will have to scramble to find new ways to get into these devices.Beaty seems to think it's related to a small change in access by adding a USB restrict mode--that disables devices after a certain amount of time if it’s plugged into your phone."They can plug into iPhones, that historically in general, have what we call brute force them," Beaty explains.Brute forcing allows Grayshift to continue putting in passcodes until they find the right one. But because these external devices deactivate after about an hour, their process is interrupted. That's the main belief in how Apple is thwarting these devices.If you're worried about security, it's simple to activate USB restrict mode on your phone. (KGTV) - Eight border wall prototypes erected along the U.S.-Mexico border crossing in South San Diego County will soon be dismantled, a Border Patrol source confirmed to 10News Friday. The area is being cleared to make way for the secondary border fence, the official said.The Department of Homeland Security hired companies to build the prototypes, which were finished in October 2017. The designs were constructed to the Border Patrol’s requirements and stood 30 feet high, most made of thick concrete. “We’ll look at things like aesthetics, how penetrable they area, how resistant they are to tampering, and then scaling or anti-climb features,” CBP Deputy Commissioner Ronald Vitiello said in 2017. The CBP evaluated the prototypes to determine if anyone could get through by climbing or digging.
