WASHINGTON — President Donald Trump traveled to Kenosha, Wisconsin, on Tuesday -- a city still reeling from social unrest following the shooting of Jacob Blake. Democratic Nominee Joe Biden has not visited yet although he said he was looking into it on Monday. Trump's visit to Kenosha comes days after the president stopped in Louisiana following the landfall of Hurricane Laura. But do presidential visits during a crisis help or hurt the community? "If I was doing his security, I would advise against it," Grant Whitus, a retired SWAT team leader in Colorado said. Whitus has protected presidents in the past and is a Trump supporter. Whitus says when a president comes to town, hundreds of officers need to be reassigned. "Their resources are already stretched to the max trying to deal with this," Whitus added. Many Wisconsin leaders feel the same way. Gov. Tony Evers (D) of Wisconsin wrote to the president unsuccessfully asking him to cancel his trip. Visits to areas in crisis have been a signature of Trump's since taking office. During his 2016 campaign, Trump visited Louisiana and their flood devastation a full four days before siting President Barack Obama made the trip. When asked if Trump was visiting Kenosha for political reasons, White House Press Secretary Kayleigh McEnany said no. "The president is showing up to see hurting Americans," McEnany said. VISTA, Calif., (KGTV) — The man and woman accused of fatally stabbing a Carlsbad woman in March appeared at their preliminary hearing on Wednesday. Ian Bushee and Malissa James pleaded not guilty to all charges, including murder and burglary. The District Attorney called several witnesses, playing 911 calls and never-before-seen police body camera footage in the courtroom. The 911 call was from the victim, Marjorie Gawitt.Dispatcher: 911. What's your emergency?Marjorie: (inaudible) I've been attacked. That was the beginning of Gawitt's dying message on the morning of March 11, 2019. The 63-year-old woman was sleeping in her Carlsbad home alone when police said Bushee and James tortured and stabbed her fifty times in the face, neck, and back. Dispatcher: We've got help sent out to you, Marjorie. Who did this?Marjorie: I don't know. It took everything Gawitt had left in her to make that 911 call. The call was so tragic, officers testifying on the stand became choked up while listening to Gawitt's voice. Because of her final act of courage, Officer Randy Noa found her minutes later, still alive. On his body camera video, you can hear him trying to speak to Gawitt."You okay ma'am? Oh. Ma'am. Is he still in here or did he leave? (PAUSE) I can't hear you, ma'am," Officer Noa said, breathing heavily."It looked like she was trying to say to me that he was gone. But it was hard," Officer Not testified inside the courtroom. The District Attorney also played a second body camera video, worn by Officer Derek Harvey. On it, you can hear him trying to console the victim. "Ma'am, you're going to be okay. The paramedics are going to be here, any second, okay?" Officer Harvey said. Minutes later, Harvey's camera recorded him finding what looked to be the weapon on the counter."Her eyes were clouded, dilated and fixed," Officer Harvey said. "I knew she was... probably not going to make it." He was right. Despite the paramedics arriving quickly, Gawitt died at Scripps La Jolla Hospital. With the only eyewitness now gone, investigators were back at square one. What they did know was that the victim's gold car was missing, so they worked to track that down. Hours later, surveillance video captured the victim's stolen car in San Marcos. The suspects were taped walking around near a masonry warehouse and at a 7-11 store. Investigators said the two later ditched the stolen car in San Marcos, and for some reason, rode a bus back into Carlsbad. The two were later arrested near the original crime scene. Police said it turns out Gawitt's home was not the first the pair had ransacked that day. "I looked up, and I said something is missing here," neighbor Patricia Gapik said. That same morning, Gapik noticed her sewing basket and her daughter's flute were gone. Random items were also scattered near her sliding glass door. "I then realized that someone was in my house," Gapik testified. "I was scared."Luckily, Gapik was asleep the entire time, and never confronted the burglars. But investigators later found that the two cases were connected. They found some of Gapik's belongings inside the car left in San Marcos. The suspects, Ian Bushee and Malissa James were the same. Thursday morning, the Medical Examiner will be giving his testimony on Gawitt's fatal injuries. 3303

WASHINGTON — Senate Republicans are proposing changes to police procedures and accountability, according to a draft of a bill obtained by The Associated Press.The JUSTICE Act — Just and Unifying Solutions To Invigorate Communities Everywhere Act of 2020 — would establish an enhanced use-of-force database, restrictions on chokeholds and new training and commissions to study law enforcement and race.In addition to the use-of-force database, the JUSTICE Act would also begin tracking — but would not ban — the use of no-knock warrants. In March, a Louisville woman named Breonna Taylor was killed when police entered her home on such a warrant.The JUSTICE Act is the most ambitious GOP policing proposal in years. It's a direct response to the massive public protests over the death of George Floyd and other black Americans.The package is set to be introduced Wednesday. As the outlines emerged, Democrats said it didn't go far enough.The Justice in Policing Act, a bill introduced by Democrats in the House last week, would introduce more sweeping changes, including a ban on police chokeholds. The Democrats' bill would also amend federal law to make it easier to charge police officers with civil rights violations.The introduction of the GOP bill will be introduced a day after President Donald Trump signed an executive order aimed at changing police practices. Trump's order calls on police departments to utilize social workers in some emergency calls. WASHINGTON — As COVID-19 cases skyrocketed before the Thanksgiving holiday weekend, the coordinator of the White House coronavirus response warned Americans to “be vigilant” and to limit celebrations to “your immediate household.” For many Americans that guidance has been difficult to abide, including for Dr. Deborah Birx herself. The day after Thanksgiving, Birx traveled to one of her vacation properties on Fenwick Island in Delaware. She was accompanied by three generations of her family from two households. Kathleen Flynn, whose brother is married to Birx's daughter, told the Associated Press she came forward about the travel out of concern for her own parents, and acknowledged there was family friction over the incident. Birx confirmed to the Associated Press she traveled to the Delaware property, but declined to be interviewed for the report. The Centers for Disease Control and Prevention has asked Americans not to travel over the holidays and discourages indoor activity involving members of different households.Birx joins a growing list of high-profile leaders on the federal and state level who have been criticized for appearing to disregard their own rules and warnings for slowing the spread of the coronavirus. (KGTV) -- The San Diego District Attorney is expected to decide later this week whether there should be a new trial in the case of Kellen Winslow Junior.Tuesday morning, the judge declared a mistrial after the jury said it was deadlocked on eight remaining counts. The counts include kidnapping, forcible rape and forcible oral copulation involving a hitchhiker last year in Encinitas and forcible rape and rape of an unconscious person for an alleged attack on a teenager at a party in Scripps Ranch back in 2003 when she was 17 and Winslow was 19. The other counts the jury deadlocked on are willful cruelty to an elder and battery against an elder. The prosecutor said the jurors were leaning toward conviction. "On each one of the counts, there were a majority of jurors who voted in favor of guilt. They voted 10-2 in favor of guilt on forcible sodomy of Jane Doe 2. They voted 10-2 in favor of guilt for the forcible rape of Jane Doe 4. They voted 10-2 in favor of guilt on the counts of elder abuse and elder battery regarding Jane Doe 5 and then they voted 8-4 in favor of guilt on the rape of an unconscious person for Jane Doe 4 and they voted 7-5 in favor of guilt on the kidnap for rape, forcible oral copulation and and forcible rape of Jane Doe 1," said Prosecutor Dan Owens. Defense attorneys said the deadlocked jury shows there were credibility issues among the accusers. There was no corroborating evidence whatsoever, it's just people's word," said defense attorney Brian Watkins. The case involved 12 counts and the testimony of 5 women."We were always concerned about trying the cases together. Our position was always that these cases would not be able to stand alone. We fought to keep the cases separate. We lost that battle. We took on all these cases at once and we still prevailed to the point that we did not get convicted of everything and we have more litigation to do," said Watkins. Monday afternoon, the jury convicted Winslow of raping a 58-year-old homeless woman in Encinitas last year. Jurors also found the former NFL tight end guilty of indecent exposure and lewd conduct involving two other women. He was acquitted of a second count of lewd conduct involving one of those women. Watkins said they'll appeal the three convictions. "We won't be satisfied until he's exonerated and he's back home with his family," said Watkins. "Right now, he's facing eight years in state prison, life time sex offender registration for the forcible rape of Jane Doe 2. He'd be facing an additional 6 months for each 1 of the misdemeanor counts of indecent exposure and lewd acts committed against Jane Does 3 and 5, for a total of potentially 9 years in prison," said Owens. Sentencing is on hold until a decision is made about a new trial. Winslow's father, Kellen Winslow Senior, a Chargers Hall of Famer attended every day of the trial, but declined to talk to the media. A hearing is scheduled for 10 a.m. Friday on setting a new trial. "Ten jurors did feel very strongly that he had committed forcible sexual offenses against more than one victim, that would lead to a lifetime prison term and that will be another factor we will consider very strongly in determining how to proceed with the case," said Owens. 3618
