Cuba Gooding Jr. is due in court Wednesday on charges of misdemeanor forcible touching and sex abuse in the third degree relating to an alleged groping incident this month in New York City.Gooding voluntarily surrendered for questioning after the alleged incident and pleaded not guilty to the charges in a Manhattan court. He was released on his own recognizance after the judge set the next court date.Gooding has cooperated with police and expects to be fully exonerated, his attorney Mark Heller said."In my 50 years, almost, of practicing law, I have never seen a case like this one because there is not a scintilla of criminal culpability that can be attributed to Mr. Cuba Gooding Jr. after I have extensively, with my staff, reviewed the video of almost two hours ... " Heller told reporters."Mr. Gooding has not acted inappropriately in any shape or form. Nothing in the video could even be considered ambiguous and I, frankly, am shocked and horrified that this case is being prosecuted," he said.NYPD met with the Oscar winner after a 29-year-old woman filed a police report claiming he grabbed her breast at Magic Hour Rooftop Bar & Lounge in Manhattan.Gooding has denied the claim. The woman in the alleged incident told police she was with friends when she was confronted by a male patron whom she described as Gooding, 1349

DALLAS, Texas — Some co-workers have found something new to bond them this holiday: A cocktail class at the office.Marisa Jeffrey said her office wanted to do something different this year, so she dressed as a fireplace. “I really liked the light up aspect of this one…,” she said, pointing to the holiday onesie she was wearing. Her colleagues were wearing similar ones with elves and reindeer and more. They are taking a cocktail class at a bar where a fun outfit is almost a requirement.“We really wanted people to step through the door and be transformed,” said Scott Jenkins of Miracle at Hide in Dallas, Texas.Jenkins is co-owner of Dallas bar “Hide,” which, this month, is called “Miracle at Hide” — a temporary holiday pop-up bar. The response?“It’s uh I can’t even put it into words. It’s been insane,” Jenkins said.Word-of-mouth has led to lines out the door… even on a weekday — all for a Christmas bar. It’s a “snowball effect, so to speak,” Jenkins said. That snowball started rolling 5 years ago at New York bar “Mace”— where founder Greg Boehm started the concept, calling it “Miracle on 9th St.” The name pays homage to the 1947 holiday classic, “Miracle on 34th St.”He’s since turned “Miracle” into a franchise. And as of this season, they’ve partnered with 84 bars around the world, including Panama, Mexico and New Zealand. He thinks he knows the secret to its popularity.“Christmas is generally a very stressful time of year for a lot of people, and I think a lot’s happening in the world that’s creating additional stress,” said Greg Boehm, founder of Miracle. “ And when you walk into a Miracle its very much transporting you into a different place, a different time. There’s some nostalgia.”Bars such as Hide pay a flat rate to the Miracle team.Everything from the greeting-card inspired menus, the glassware — even the garnishes — are on theme. Stirring up a signature Christmapolitan cocktail — their take on a cosmo — Jenkins’ co-owner at Hide, Nick Backlund, says he thought he’d quickly get sick of the holiday tunes.“I was gonna be really mad about Christmas music every day but now I’m singing them all the time,” Backlund said.Jenkins says the response to a Christmas bar is, in a way, heartwarming.“To be honest it gives me a little bit of hope. it’s something that, especially in the weird kind of climate we have today, people are out being happy, spreading cheer, having fun, being lighthearted,” Jenkins said. The only thing that could make it better? According to one woman — maybe if the bar … came to you. 2551

COLORADO SPRINGS, Colo. – Bodycam video released by Colorado Springs police Thursday shows 19-year-old De'Von Bailey running from officers when he was fatally shot earlier this month.Police claim Bailey and another man were suspects in a robbery that happened minutes earlier Aug. 3 and that Bailey had a weapon. Video showed police grabbing something from between Bailey's legs, but the footage does not clearly show what it was. Authorities have said officers recovered a weapon at the scene. The bodycam video shows Bailey and the other man standing in the street in front of police with their hands up. The officers, Sgt. Alan Van't Land and officer Blake Evenson, told Bailey and the other man that they had gotten a report of "two people, similar descriptions, possibly having a gun."One officer told the two of them to not reach for their waist and that they would check to make sure they didn't have a weapon. As another officer walked up behind Bailey, the teen took off running to his right. The officer with the bodycam chased Bailey and pulled out his weapon, yelling, "Hands up! Hands up!" The officers then fired at least eights shots at Bailey, striking him in the lower back.Bailey fell to the ground and an officer again yelled, "Hands up! Hands up!" Bailey lifted one hand and then fell back to the ground. The officers immediately called for a medical kit and began tending to Bailey's wound. As the officers searched Bailey's body, they found "something between his legs," Evenson said on the video. Both officers then said the item was a gun, but it was unclear on the footage what the officers found.Watch the edited video of the shooting: 1678

CINCINNATI — After a search-and-recover effort that lasted more than a day, Cincinnati firefighters on Tuesday night located and removed the body of a construction worker who had become trapped in a half-collapsed, half-finished downtown parking garage the day before.Cincinnati City Manager Patrick Duhaney broke the news to members of City Council in an email. “The heart of the City of Cincinnati goes out to the family and friends of the deceased,” he wrote. “This is a truly a sad day for our City. I cannot imagine the grief this family must be going through at this time.”Check back for updates on this developing story. 639
