SAN DIEGO (KGTV) — New details are emerging about the death of a man in San Diego Sheriff’s deputies’ custody. A recently released Medical Examiner’s report says an arrestee’s death last year was a "homicide." The District Attorney's office said last year that none of the deputies involved in the in custody death will face any criminal charges. Oscar Leal died last February 28 after deputies responded to his apartment in Vista and detained him. The Medical Examiner’s homicide classification is not a legal term, but a medical assessment. The DA's office wrote in part of a nine-page summary and statement in December last year: "... His level of methamphetamine intoxication combined with his active resistance combativeness in the duration of the struggle, all contributed to his death ... The deputies involved in his detention acted reasonably under the circumstances in bear no state criminal liability for their actions."The Sheriff Bill Gore wrote in a statement:"I am aware of the Medical Examiner's conclusion regarding the manner of death of Mr. Leal. I respectfully disagree with the classification of the manner of death in this case as a homicide.The pathologist wrote that his death was due to acute methamphetamine toxicity in the setting of agitation, physical altercation, and prone restraint. It was purely due to Mr. Leal's agitation that he was restrained. Peace officers have a duty to restrain those who are agitated and under arrest, as Mr. Leal was. Were it not for Mr. Leal's abuse of methamphetamine he would be alive today. The deputies and nurses on scene rendered immediate aid to Mr. Leal.Mr. Leal brought upon his own death with his choice to use methamphetamine. His manner of death is more accurately classified as an accident."It has not been made clear yet why the medical examiners report took 13 months to be released. 2135

SAN DIEGO (KGTV) -- Nearly one week after Election Day and with state Assemblyman Todd Gloria holding a comfortable lead, City Council President Pro Tem Barbara Bry conceded in the race for San Diego mayor.As of Nov. 9 vote totals, Gloria was leading Bry 56% to 46%.During a virtual press conference on Monday, Bry said she called Gloria the day before and offered her congratulations. Regarding the campaign, Bry said she felt voters were misled by the media and political ads from the opposition.Bry said, "I want to congratulate Todd Gloria as the next mayor of San Diego. He and I spoke by phone yesterday, and I offered him my congratulations. But for the next few years, our city faces many challenges because of COVID-19, and Mr. Gloria will have a tough job. Thousands of San Diegans are unemployed through no fault of their own and city revenues are declining."She added, "I wish those issues could have been more central to the mayoral campaign. We certainly tried to make them the focus of our communications. Unfortunately, interest groups supporting my opponent took a different approach.Perhaps inspired by the ‘fake news’ rhetoric coming out of Washington, they spent over million on TV commercials and mailers cynically designed to fool voters into thinking they were sponsored by our campaign. In times past, dishonest advertising of that sort would have been called out by responsible journalists, and voters would have been made aware of these cynical tactics. But the media -- like many citizens -- has become so desensitized to such tactics that they no longer pique their interest. And, unfortunately, these dishonest attacks clearly impacted our campaign."When asked if she would run for mayor again, Bry said she may not seek public office again. She added she plans to take time off with her family before her next endeavor.Bry, 71, will remain on the San Diego City Council until Dec. 10. SAN DIEGO (KGTV) -- Police Monday identified the victim in a deadly Mount Hope-area shooting in late December. According to police, 54-year-old Darryl Toliver was shot and killed in an alleyway on the 800 block of Raven Street around 2:45 a.m. December 29. Witnesses told police and unknown man and two vehicles were spotted leaving the area around the time of the shooting. RELATED: 1 dead in Mount Hope-area shootingThe man was described as black and in his 20s, wearing a dark cap, long-sleeved white sweatshirt and dark sweat pants. Police said at the time that the man was only a person of interest. One of the vehicles spotted leaving the scene was described as a white, 1990s Honda Accord while the other was described as a 2006-2010 Chrysler 300. SAN DIEGO (KGTV) -- New numbers show San Diego housing costs are taking up more than a third of people’s income. 57 percent of renters spend more than a third on housing and so do 40 percent of homeowners. That's the result of the annual Equinox Project released Thursday by the Center for Sustainable Energy in San Diego.Mikaella Bolling, the project’s manager says it boils down to supply and demand.“A lot of people say well we don't want development in my neighborhood or we don't want infill development in our neighborhood, but this is actually the solution that's going to allow us to have more affordable units,” she said.She points to the need for more partnerships to bridge the gaps and educate the public.   “We need to have a better conversation between our residents, between our policymakers, and between our developers,” she said.The cost of a median single-family home in the county jumped 6.5 percent from 2016 to 2017. It’s now upwards of 5,000.“We're seeing that increase every year.  Great for homeowners...but not great for buyers,” Bolling added. Krysta Cordill is a certified financial planner with D’Arcy Capital in Carmel Valley.“There's really no magic to it,” she said. “You have to make saving for a home a priority.” Cordill is a past president of the San Diego Financial Planners Association and has seen more clients worry about whether they can afford the high cost of living. “If you have a Roth Ira or traditional IRA, they allow you to take ,000 of that penalty-free for first-time home-buyers," Cordill said.  She says people should consider starting in a condo or townhouse. “Just know that that's part of the process of home ownership,” Cordill said. As for saving, she offered up some simple tricks. “I've never talked to anyone who cannot pair down their expenses,” she said. First, she suggests cutting out easy online spending.  Instead, say to yourself, ‘If I really need it, I'm going to go to the store.’”Cordill also suggests that you make your morning cup of coffee at home. SAN DIEGO (KGTV) - More than million has been spent on Proposition 15 this year, making it the third most expensive ballot proposition in 2020.According to reports from the California Fair Political Practices Commission, supporters have brought in million. Opponents have contributed million.As written on the ballot, Proposition 15 will "increase funding sources for public schools, community colleges, and local government services by changing tax assessment of commercial and industrial property."The Proposition will raise commercial and industrial property taxes by reassessing property based on current values. Under 1978's Proposition 13, property tax has been calculated based on the value when the property was last sold.The change in tax assessments could bring the state anywhere from billion to billion every year.Because so much money is at stake, stakeholders are willing to spend a lot to sway voters."With those being the stakes, we felt compelled to do whatever is necessary to raise funds to defeat this thing," says Michael Bustamante, the Spokesperson for the No on Prop 15 campaign committee. They've raised the most money of any committee listed, at million.A large chunk of that money, million, comes from the California Business Roundtable.
