SAN DIEGO (KGTV) - Southcrest neighbors banned together to file a lawsuit against the City of San Diego, claiming a city park was not designed to properly drain and therefore floods the neighborhood each time it rains.Last December was the breaking point for neighbors near Southcrest Trails Park, at S. 37th Street and a dirt road behind houses situated on Beta Street. They say feet of water flooded into their homes."This actually becomes a sinkhole, this area," said Greg Montoya, who is leading the charge with his hefty binder full of decades of documentation of the problem. Montoya has pictures of his white pickup truck sunken rims-deep into his yard due to saturation. The lawsuit describes it as "a 66-acre, 1.2-mile corridor in the Southcrest neighborhood of San Diego to construct Highway 252, which would connect Interstate 805 and lnterstates 5 and 15."The project never materialized, Montoya says, because St. Jude, thinking of the school, put up a fight."So then the City of San Diego put dirt berms in to keep people from driving back here, to keep people from throwing trash back here, because it became a dump," Montoya said. The park took shape in 2003, according to the lawsuit.Montoya and other neighbors say there was not enough drainage put in, sending water running down the five-foot berm every time it rains.A storm in December 2018 left many stranded, including Ricky Vasquez, who was trying to pick up his one-year-old son."Other cars were stuck in the middle of the street because the water was so high," said Vasquez.Neighbor Pastor Nicolas Martinez said his home flooded, ultimately costing ,000.Montoya was fed up."San Diego's America's Finest City for some but not for all because I've got documentation for over 30 years for asking for help for this situation that they've created and I'm just ignored," said Montoya. He went to attorney Evan Walker, who said his team found one of the two storm drains at the park "is not connected to any sort of system despite the city's own plans to connect them to the system."Montoya hopes the lawsuit causes the city to step up.10News reached out to the City of San Diego who said they could not comment on ongoing litigation. 2211

SAN DIEGO (KGTV) -- Saturday marks the first day of the electric scooter and motorized device ban on San Diego's beach boardwalks. They include La Jolla Shores, Pacific Beach, Mission Beach, and the bayside walk area of Mission Bay.The ban comes after multiple reports of wipeouts, severe injuries, and even deaths. It was finalized by a 5-4 city council vote in December. For the first 30 days, San Diego Police will be issuing warnings. After that, they will be giving out citations. Despite being illegal, the scooters will be geo-fenced to 3 miles-per-hour on the boardwalks. This is slower than the average walking speed and the safest way to enforce the ban.10News met Felicia Minton and her mommy group, walking along the boardwalk in Mission Bay. She said she feels much safer since the ban went into effect. "Is it a good thing. I think people are naturally starting to understand that it's not the safest way of transportation," Minton said. Some people said it is not fair to be lumped in with e-scooter renters who are not good at what they do.We also met Will Brockett, who owns and rides a device called the "One-Wheel." It resembles a skateboard with one giant motorized wheel in the center of the board. "I just hit 1,300 miles on it," Brockett said. He is in a Facebook group of enthusiasts who go on group rides, mostly in Mission Bay, including the boardwalk. Before the council vote, his group submitted a petition to stop the ban, arguing that as responsible owners, they take care of their rides and prioritize safety. "You don't ride completely hammered after a Saturday night, on a dark street with no safety gear," Brockett said. California law defines a motorized scooter as a vehicle that has two wheels, handlebars, a floor-board that can be stood up while riding, and a motor. But the local prohibition includes ALL electric devices, including e-scooters, e-bikes, Segways, and one-wheels. "If somebody is acting with no regard for safety or pedestrians, that falls on the individual. Not on a whole group of individuals," Brockett said. He is hoping that the ban gets reversed. The prohibition excludes motorized devices for people with disabilities. 2188

SAN DIEGO (KGTV) — Some long-time roller derby kids are upset after Skateworld management announced their Youth Roller Derby program was cut. Many of these kids were instrumental in the "Save Skateworld" campaign in April. When Skateworld was on the verge of being turned into a big box store, they were there. "We got out of school the day of the City Council meeting," mother, Meadow Beidler said. Armed with their skates and signs, dozens of roller derby kids convinced San Diego City Council to vote to save Skateworld on April 8, 2019. "We really thank the kids for coming out and making their signs," Skateworld general manager, Brett Stang said. His father Gary Stang started the rink in 1975. It has been a Linda Vista institution ever since. Earlier this year, when a developer shared plans to turn Skateworld into a big box store, the derby kids rallied and protested for days.Little did the kids know, that the home they just helped save, would essentially kick them out. Beidler is a proud "Derby Mom" of three fierce girls: "Cheshire Splat," "Hot Sauce," and "Zoom Zoom Kaboom." But now, she doesn't know if she will keep that title. "We don't know if we are going to be able to continue with derby," Beidler said. Days after the city council vote to save their rink, Beidler says her girls were suddenly told that their Youth Derby program would be cut. Management explained it was due to administrative reasons. "The way it went down it was just heartbreaking," Beidler said. The kids were told to join another club instead."We haven't been able to give that derby team the attention it kind of deserves," Brett Stang said. "They've been bumped for private events and other slots, so there is another team out there, 'Derby United,' who offered to take our program under their wing."But Beidler says the problem is that Derby United's new facility in La Mesa has not started construction. She also says Skateworld's prices cannot be beaten. "If we were to continue that and do derby at this new location that hasn't been built yet, then it would cost my family an additional 0 a month," Beidler said. Her girls are now so distraught, they cannot even speak. After all they did for Skateworld, they feel unappreciated. "Having our kids getting excited and politically motivated and going on camera and speaking from the heart how it is family," Beidler said. "They feel very betrayed."Skateworld's management told 10News, although they are closed on Mondays, the kids could have Monday practices if parents and coaches work on an agreement. But hosting home games on the weekends would be tough, considering their free skate schedule. 2663
